7 U.S.C. § 7917 — Relation to remaining payment authority under production flexibility contracts

The Secretary generally cannot make old production flexibility contract payments for fiscal year 2002 after May 13, 2002, unless the producer asks for them. If a producer already got that fiscal year 2002 payment, the Secretary must subtract it from that producer's 2002 direct payment.
(a) Termination of superseded payment authority. Despite section 7213(a)(7) or any other law, the Secretary* cannot make fiscal year 2002 payments under an old "production flexibility contract" after May 13, 2002, unless the producer* who is party to that contract specifically asks for it.
(b) Contract payments made before enactment. If a producer already received all or part of that fiscal year 2002 production flexibility contract payment, the Secretary must reduce that producer's 2002 direct payment* (under section 7913) by whatever amount was already received.
Notwithstanding section 7213(a)(7) of this title or any other provision of law, the Secretary* shall not make payments for fiscal year 2002 after May 13, 2002, under a production flexibility contract entered into under section 7211 of this title unless requested by the producer* that is a party to the contract.
If a producer receives all or any portion of the payment authorized for fiscal year 2002 under a production flexibility contract, the Secretary shall reduce the amount of the direct payment* otherwise due the producer for the 2002 crop year under section 7913 of this title by the amount of the fiscal year 2002 payment received by the producer under the production flexibility contract.
