10 U.S.C. § 20110 — Strength in grade: Space Force general officers in a Space Force active status, not on sustained duty
submitted 1 year ago by Pub. L. 119-60 to r/title-10-ARMED-FORCES · 208 words · no verdicts yet
The Space Force can have five general officers in active status, not on sustained duty. Certain joint-duty officers don't count toward that limit, up to two at a time. Officers just leaving joint duty get a temporary 60- to 180-day exclusion from the count.
(a) Authorized Strength*. The authorized number of general officers serving in the Space Force in a Space Force active status* but not on sustained duty* is five.
(b) Exclusions. These Space Force general officers don't count toward that number: (1) those counted under section 526 of this title; and (2) those serving in a joint duty assignment for purposes of chapter 38 of this title — except that no more than two officers can be excluded this way.
(c) Permanent Grade*. A Space Force general officer* can't be reduced in permanent grade just because the number authorized under subsection (a) goes down.
(d) Temporary Exclusion. The limit in subsection (a) doesn't apply to an officer* who was released from a joint duty assignment or other non-joint active service* assignment, but only for the 60-day period starting when the officer leaves that assignment. The Secretary of Defense can let the Secretary of the Air Force extend that 60-day period by another 120 days, except that no more than three Space Force officers can be covered by such an extension at the same time.
The authorized strength of general officers in the Space Force serving in a Space Force active status* but not on sustained duty* is five.
The following Space Force general officers shall not be counted for purposes of this section:
Those counted under section 526 of this title.
Those serving in a joint duty assignment for purposes of chapter 38 of this title, except that the number of officers who may be excluded under this paragraph may not exceed two.
A Space Force general officer* may not be reduced in permanent grade because of a reduction in the number authorized under subsection (a).
The limitations of subsection (a) do not apply to an officer* released from a joint duty assignment or other non-joint active service* assignment, but only during the 60-day period beginning on the date the officer departs the joint duty or other active service assignment. The Secretary of Defense may authorize the Secretary of the Air Force to extend the 60-day period by an additional 120 days, except that not more than three Space Force officers may be covered by an extension under this subsection at the same time.
