10 U.S.C. § 226 — Special operations forces: display of service-common and other support and enabling capabilities

(a) In General: Starting with the budget for fiscal year 2022 and every fiscal year after, the Secretary of Defense and the Secretary of each military department must include, in the budget materials submitted to Congress under 31 U.S.C. § 1105, a budget justification display for each relevant appropriation, showing service-common and other support and enabling capabilities provided for special operations forces requested by a military service or Defense Agency. Each display must include: (1) details at the appropriation and line-item level, including amounts for service-common support, acquisition support, training, operations, pay and allowances, base operations sustainment, and other common services and support; (2) an identification of any change, compared to the prior fiscal year, in the level or type of support and enabling capabilities each military service or Defense Agency provides to special operations forces, including the reason for the change and any steps taken to soften its impact; (3) an assessment of how the display for that fiscal year, along with any expected future changes in staffing or force structure, is likely to affect each military service's ability to keep providing that support; and (4) anything else the Secretary of Defense or a military department secretary decides is relevant. (b) Consolidated Budget Justification Display: The Secretary of Defense must also include, starting with fiscal year 2022, a single consolidated budget justification display containing the same information required in the individual displays under subsection (a). This consolidated display may be presented as a summary by appropriation for each military department and a summary by appropriation covering all Defense Agencies. (c) Service-common and Other Support and Enabling Capabilities: In this section, that term means capabilities provided to support special operations that are not counted within Major Force Program-11 and are not classified as special-operations-forces-specific.
