The Federal Acquisition Regulation must encourage offerors to consider alternative dispute resolution before filing a protest. This applies before contract award and before an offeror is excluded from the competitive range or otherwise removed from consideration.
The Federal Acquisition Regulation* must include a provision that encourages the use of alternative-dispute-resolution techniques to provide informal, expeditious, and inexpensive procedures for an offeror to consider using before filing a protest, before the contract is awarded, about the offeror’s exclusion from the competitive range or otherwise from further consideration for that contract.
The Federal Acquisition Regulation* shall include a provision encouraging the use of alternative dispute resolution techniques to provide informal, expeditious, and inexpensive procedures for an offeror to consider using before filing a protest, prior to the award of a contract, of the exclusion of the offeror from the competitive range (or otherwise from further consideration) for that contract.
