10 U.S.C. § 382 — Execution and administration of programs and activities

(a) Policy Oversight and Resource Allocation. The Secretary of Defense must give one official and office — at the level of Under Secretary of Defense or below, inside the Office of the Secretary of Defense — responsibility for overseeing strategic policy and guidance and for allocating overall resources for the Department's security cooperation programs. (b) Execution and Administration of Certain Programs and Activities. (1) In general. The Director of the Defense Security Cooperation Agency is responsible for running and managing all Department of Defense security cooperation programs that provide defense articles, military training, or other defense-related services by grant, loan, cash sale, or lease. (2) Designation of responsibility. The Director can assign a military service, combatant command, Defense Agency, Field Activity, or other Department element to run one of these programs, if doing so would make it more effective, efficient, and economical. (c) Availability of Funds. (1) In general. Money available to the Defense Security Cooperation Agency, and other Department of Defense money set aside for security cooperation, can be used to carry out the security cooperation programs this chapter authorizes. (2) Budget justification. Any money needed to carry out these programs for a given fiscal year must be identified, with proper justification, in the consolidated budget required for that year under section 381.
