16 U.S.C. § 441 — Badlands National Park; establishment

This section is the founding provision of Badlands National Park. The park will be dedicated once a certain amount ("a quantum") of the privately owned land inside the described area has been acquired and transferred to the United States for park purposes — and this must happen without costing the federal treasury anything. The Secretary of the Interior decides when enough land has been acquired to satisfy this requirement. Once that happens, the described area is set apart and dedicated as a national park, to benefit and be enjoyed by the public, under the name "Badlands National Park." But there's a condition attached: this can only happen after the State of South Dakota has first built the highways described later in this part of the law (in the following sections).
