The Director may publish Institute research, statistics, evaluations, and reports without Department approval, but advance copies and rigorous peer review are required. Certain budget, classified, legally protected, and disclosure-prevention information is excluded.
(a) Publication. Without the Secretary's or another Department* office's approval, the Director* may prepare and publish, including orally, Institute* research, statistics consistent with part C, evaluation information, and reports needed for Institute priorities and mission.
(b) Advance copies. Before publication, the Director must give the Secretary* and relevant offices an advance copy.
(c) Peer review. Institute-conducted or supported research, statistics, and evaluation reports must undergo rigorous peer review before publication or other public release.
(d) Items not covered. Subsections (a), (b), and (c) do not apply to (1) current or proposed budgets, appropriations, or legislation; (2) information whose disclosure is barred by law or the Constitution, classified national-security information, or information described in 5 U.S.C. § 552(b); or (3) United States officers' review to prevent unauthorized disclosure of the information in (1) or (2).
The Director* may prepare and publish (including through oral presentation) such research, statistics (consistent with part C), and evaluation information and reports from any office, board*, committee, and center of the Institute*, as needed to carry out the priorities and mission of the Institute without the approval of the Secretary* or any other office of the Department*.
The Director shall provide the Secretary and other relevant offices with an advance copy of any information to be published under this section before publication.
All research, statistics, and evaluation reports conducted by, or supported through, the Institute shall be subjected to rigorous peer review before being published or otherwise made available to the public.
Nothing in subsections 1 (a), (b), or (c) shall be construed to apply to—
information on current or proposed budgets, appropriations, or legislation;
information prohibited from disclosure by law or the Constitution, classified national security information, or information described in section 552(b) of title 5; and
review by officers of the United States in order to prevent the unauthorized disclosure of information described in paragraph (1) or (2).
