21 U.S.C. § 394Scientific review groups

submitted 88 years ago by Pub. L. 101-635 to r/title-21-FOOD-AND-DRUGS · 106 words · no verdicts yet

in plain englishAI-generated · not legal advice

This law lets the Commissioner of Food and Drugs set up scientific and technical review groups. The Commissioner can appoint and pay their members without following normal civil service hiring and pay rules. Federal employees on these groups do not get extra pay for serving.

The Commissioner of Food and Drugs may act without following certain federal personnel rules — specifically, the rules in title 5 about hiring through the competitive civil service, and the rules about job classification and General Schedule pay rates. Using that freedom, the Commissioner may: (1) create technical and scientific review groups needed to carry out FDA functions, including functions this chapter assigns to the agency; and (2) appoint people to these groups and pay them — except that if the person is already a U.S. government officer or employee, they cannot receive extra pay for serving on one of these groups.
