This section limits who may access information collected under the Act and penalizes improper disclosure or access. It also makes the information generally protected from legal process and assigns agencies responsibility for information exchanges.

(a)(1) Officers and employees with access to information covered by 13 U.S.C. § 9 must take the oath required by § 23(c), follow § 9(a)’s limits, and be subject to § 214 to the same extent as Census Bureau staff. (2) Only officers and employees who have sworn to follow 22 U.S.C. § 3104(c) may access information covered by that provision; they face § 3104(e) penalties to the same extent as staff performing that Act’s functions. (3) They also face every other legal disclosure restriction or penalty. (b) Anyone possessing information provided under this Act who discloses it in a form that can identify a person, business, or establishment faces a fine of $2,500–$25,000, imprisonment up to 5 years, or both. (c) The same punishment applies to anyone who gets access by fraud, misrepresentation, or another unlawful act. (d) Information obtained under this Act is immune from legal process and may not be used as evidence or for any purpose in a federal, state, or local action or proceeding, except to enforce legal collection requirements or (b) and (c). (e)(1) The Commerce Secretary manages information exchange between Census and Economic Analysis, resolves their access, data, and methodology questions, and may not interpret this section to block better international data. The two bureaus must agree in writing on shared data. (2) The OMB Director manages exchange between Economic Analysis and Labor Statistics and resolves their questions, subject to the same rule protecting improvement of international data.
