This law defines key terms for the chapter on migrant worker transportation. A "migrant worker" is someone traveling to or from farm work, as defined in tax and labor law. A "motor carrier of migrant workers" is generally anyone who drives at least 3 migrant workers to their job.

This section defines terms used throughout the chapter. (1) "Migrant worker" means someone traveling to or from agricultural work, using the same meaning given in a section of the tax code, 26 U.S.C. § 3121(g), and a section of the Fair Labor Standards Act, 29 U.S.C. § 203(f). (2) "Motor carrier," "motor common carrier," "motor private carrier," "motor vehicle," and "United States" all mean the same thing they mean in section 13102 of this title. (3) "Motor carrier of migrant workers" means a person, other than a motor common carrier, who provides transportation covered by section 13501, using a vehicle, other than a passenger car or station wagon, to carry at least 3 migrant workers at a time to or from their job. It does not include a migrant worker who is just driving other migrant workers and their immediate families.
