submitted 60 years ago by Pub. L. 89-554 to r/title-5-GOVERNMENT-ORGANIZATION-AND-EMPLOYEES · 157 words · no verdicts yet
This section gives the Office of Personnel Management authority to classify and reclassify federal positions. It also lets an affected employee or agency request that the Office use that authority.
(a) Despite section 5107 of this title, the Office of Personnel Management may: (1) find the current facts about a position's duties, responsibilities, and qualification requirements; (2) put a newly created position, or a position first covered by this chapter, in the proper class and grade; (3) decide whether a position is in the proper class and grade; and (4) move a position from one class or grade to another when the facts support the change. The Office must certify its action under paragraph (2) or (4) to the agency involved. The agency must follow the certificate. The certificate binds all officials responsible for administration, certification, payroll, payments, and accounting. (b) An affected employee or an agency may ask at any time for the Office to use the authority in subsection (a). The Office must act on the request.
Notwithstanding section 5107 of this title, the Office of Personnel Management may—
ascertain currently the facts as to the duties, responsibilities, and qualification requirements of a position;
place in an appropriate class and grade a newly created position or a position coming initially under this chapter;
decide whether a position is in its appropriate class and grade; and
change a position from one class or grade to another class or grade when the facts warrant.
The Office shall certify to the agency concerned its action under paragraph (2) or (4) of this subsection. The agency shall act in accordance with the certificate, and the certificate is binding on all administrative, certifying, payroll, disbursing, and accounting officials.
An employee affected or an agency may request at any time that the Office exercise the authority granted to it by subsection (a) of this section and the Office shall act on the request.
