Congress explains why it's setting up a kiwifruit program: kiwifruit is grown by many small producers, mostly in California, and moves through interstate and foreign trade, even as imports have grown. The goal is a coordinated national program of research, promotion, and consumer education that producers, handlers, and importers couldn't afford to run on their own, treating domestic and imported kiwifruit the same way.

(a) Findings. Congress finds that: (1) domestic kiwifruit is grown by many individual producers; (2) it's grown mostly in California, though other areas could grow it too; (3) kiwifruit moves through interstate and foreign trade, and even the kiwifruit that doesn't move directly still affects that trade; (4) large amounts of kiwifruit have recently been imported into the U.S.; (5) keeping and growing markets for kiwifruit matters a lot to producers and everyone else involved in growing, marketing, and processing it; (6) a coordinated program of research, promotion, and consumer information is needed to maintain and grow those markets; and (7) kiwifruit producers, handlers, and importers can't set up and pay for such a program without working together. (b) Purposes. This part of the law is meant to: (1) set up an orderly way to develop and pay for (through an assessment, or fee) a coordinated program of research, promotion, and consumer information about kiwifruit; (2) use that program to strengthen kiwifruit's position in domestic and foreign markets and grow those markets; and (3) treat domestically grown and imported kiwifruit the same way.

(6)

a coordinated program of research, promotion, and consumer information regarding kiwifruit is necessary for the maintenance and development of the markets; and

(7)

(1)

to authorize the establishment of an orderly procedure for the development and financing (through an assessment) of an effective and coordinated program of research, promotion, and consumer information regarding kiwifruit;
