10 U.S.C. § 12106 — Army and Air Force Reserve: transfer to upon withdrawal as member of National Guard
submitted 32 years ago by Pub. L. 103-337 to r/title-10-ARMED-FORCES · 133 words · no verdicts yet
An enlisted Army National Guard member who leaves the Guard automatically joins the Army Reserve. This doesn't happen if they're also discharged from the Reserve. The same rule sends Air National Guard members into the Air Force Reserve. Becoming a Reserve member this way ends their National Guard membership.
An enlisted member* of the Army National Guard of the United States* who ceases to be a member of the Army National Guard* becomes a member of the Army* Reserve unless he is also discharged from his enlistment* as a Reserve.
An enlisted member of the Air National Guard of the United States* who ceases to be a member of the Air National Guard* becomes a member of the Air Force Reserve unless he is also discharged from his enlistment as a Reserve.
An enlisted member who becomes a member of the Army Reserve or the Air Force Reserve under this section ceases to be a member of the Army National Guard* of the United States or the Air National Guard of the United States, as the case may be.
