10 U.S.C. § 14004 — Reserve active-status lists: eligibility for Reserve promotion

Unless some other law says differently, an officer^* must appear on a reserve active-status list^* in order to be eligible under chapter 1405 of title 10. Being on that list is what makes the officer eligible either for the board to consider them for promotion, or for the promotion itself. If an officer's name isn't on the reserve active-status list, chapter 1405 does not let them be considered for, or receive, a promotion -- unless a different statute specifically provides otherwise.
