10 U.S.C. § 430b — Executive agent for open-source intelligence tools

(a) Designation. By April 1, 2016, the Secretary of Defense had to name a senior Defense Department official as the Department's executive agent for open-source intelligence tools — tools for systematically collecting, processing, and analyzing publicly available information to meet known or expected intelligence needs. (b) Roles, Responsibilities, and Authorities. (1) By July 1, 2016, following Department of Defense Directive 5101.1 (the standard rules for how executive agents work, or any directive that replaces it), the Secretary had to spell out this executive agent's exact roles, responsibilities, and authorities. (2) Those roles and responsibilities must include: (A) keeping a full, current list of open-source intelligence tools and technical standards; (B) setting priorities for developing, buying, and integrating these tools into the intelligence system, and into other command-and-control systems as needed; (C) certifying that open-source intelligence tools meet the technical standards required by the Intelligence Community's IT framework, the Defense Intelligence Information Enterprise, and the Joint Information Environment; (D) assessing and recommending ways to protect privacy in how open-source information from around the world is collected, analyzed, and shared; and (E) performing any other assessments the Secretary considers appropriate. (c) Support Within Department of Defense. Following the same Directive 5101.1, the Secretary must make sure the military departments, the Defense Agencies, and other parts of the Department give this executive agent the support and resources needed to carry out the job. (d) Definitions. "Directive 5101.1" means that specific Defense Department directive (or any directive that replaces it) covering the responsibilities of a Defense Department executive agent. "Executive agent" has the same meaning as "DoD Executive Agent" in that directive. "Open-source intelligence tools" means tools for the systematic collection, processing, and analysis of publicly available information for known or anticipated intelligence needs.
