10 U.S.C. § 500b — Annual report on electromagnetic spectrum operations strategy of the Department of Defense

(a) In General. At the same time the President submits the federal budget to Congress, for each of fiscal years 2025 through 2029, the Secretary of Defense — working with the Department's Chief Information Officer, the Chairman of the Joint Chiefs of Staff, and the Secretary of each military department — must send the congressional defense committees an annual report on the Department's Electromagnetic Spectrum Superiority Strategy. (b) Contents of Report. Each report must include: (1) A description of (A) the Department's electromagnetic spectrum strategy; (B) how that strategy supports the national defense strategy; and (C) the organization set up to oversee the strategy, requirements, capabilities, programs, and projects. (2) A list of every electromagnetic spectrum operations acquisition program and research-and-development project, explaining how each supports the strategy. (3) For each unclassified program or project on that list: (A) who is responsible for overseeing it and from which organization; (B) whether it has validated requirements, and if so, when and by whom they were validated; (C) how much money it has received, spent, and is projected to need, by fiscal year, including the funding line it draws from; (D) its development or purchase schedule; (E) an assessment of its cost, schedule, and performance against its baseline, comparing the current baseline to the original one if they differ; (F) how mature its critical technologies are; (G) whether it duplicates or overlaps work by another military department; and (H) what capability gap it is meant to fill. (4) A classified annex covering the same information — items (A) through (H) above — for each classified program or project on the list.
