The Navy Secretary must create an official Navy Reserve flag. Certain merchant ships can fly it. The ship must be U.S.-documented, fit for wartime naval use, and mostly staffed by Navy members.
The Secretary of the Navy must design an official flag called the Navy Reserve flag. A seagoing merchant ship is allowed to fly this flag, but only if it meets three conditions. First, the ship must be officially documented under U.S. law. Second, the Secretary must have designated the ship, following his own regulations, as suitable to serve as a naval auxiliary if a war happens. Third, the ship's master or commanding officer*, plus at least half of its other licensed officers, must be members of the Navy.
The Secretary of the Navy shall prescribe a suitable flag to be known as the Navy Reserve flag. This flag may be flown by a seagoing merchant vessel if—
the vessel is documented under the laws of the United States;
the vessel has been designated by the Secretary, under such regulations as he prescribes, as suitable for service as a naval auxiliary in time of war; and
the master or commanding officer* and at least half of the other licensed officers of the vessel are members of the Navy.
