This article punishes willfully and wrongfully hazarding an armed-forces vessel or aircraft, including allowing it to be hazarded. Negligent hazarding is also punishable, but the article does not specify death as the punishment for negligence.
(a) A person subject to this chapter who willfully and wrongfully hazards, or allows to be hazarded, an armed-forces vessel or aircraft may be punished by death or another punishment a court-martial directs. (b) A person subject to this chapter who negligently hazards, or allows to be hazarded, such a vessel or aircraft must be punished as a court-martial directs.
Any person subject to this chapter who, willfully and wrongfully, hazards or suffers to be hazarded any vessel or aircraft of the armed forces* shall be punished by death or such other punishment as a court-martial may direct.
Any person subject to this chapter who negligently hazards or suffers to be hazarded any vessel or aircraft of the armed forces shall be punished as a court-martial may direct.
