15 U.S.C. § 637d — Subcontracting plan reports

(1) Reporting requirements. Within one year after January 2, 2013, the Administrator of the Small Business Administration must take the actions needed to modify the electronic subcontracting-reporting system established by the Administration under section 637(d)(6)(E). The modified system must be able to identify entities that fail to submit required reports. (2) Annual report. By March 31 of each year, the Administrator must give the House Committee on Small Business and the Senate Committee on Small Business and Entrepreneurship a report based on data available through existing systems. The report must provide the following information for each agency, and, as far as practicable, for each type of goal or plan: (A) For the prior fiscal year, the percentage of entities required to submit reports under section 637(d)(6) that filed those reports, and the percentage that failed to file them. (B) For the prior fiscal year, among the entities that filed those reports, the percentage that met, exceeded, or failed to meet the goals in their subcontracting plans. (C) For the prior fiscal year, the total value by which those entities exceeded or failed to meet their subcontracting goals.
