16 U.S.C. § 459f–4Hunting and fishing provisions

submitted 61 years ago by Pub. L. 89-195 to r/title-16-CONSERVATION · 171 words · no verdicts yet

in plain englishAI-generated · not legal advice

The Secretary must allow hunting and fishing on Assateague land under state law. He can still ban it in certain zones or times for safety reasons. This law doesn't change state shellfishing rules or federal migratory bird laws.

This section has no lettered subsections. The Secretary must permit hunting and fishing on the land and water he controls within the seashore, following the applicable state laws. However, he can designate zones and set time periods where no hunting or fishing is allowed, for reasons of public safety, park administration, fish or wildlife management, or public use and enjoyment. Nothing in sections 459f through 459f–11 limits or interferes with a state's authority to permit or regulate shellfishing in seashore waters, and nothing adds to or takes away federal authority over migratory waterfowl. Except in emergencies, the Secretary must consult the relevant state hunting-and-fishing agency before any regulation takes effect. This section does not apply to the Chincoteague National Wildlife Refuge.
