The Department of the Treasury has a United States Customs Service headed by a Commissioner of Customs. The President appoints the Commissioner with Senate advice and consent, and the Commissioner performs duties set by the Treasury Secretary.
There must be a United States Customs Service and a Commissioner of Customs in the Department of the Treasury. The President appoints the Commissioner with the Senate’s advice and consent. The Commissioner must (1) head the Customs Service, (2) perform the duties and use the powers prescribed by the Treasury Secretary, and (3) report to the Treasury Secretary through officials the Secretary designates.
There shall be in the Department of the Treasury a service to be known as the United States Customs Service, and a Commissioner of Customs.1 The Commissioner of Customs,1 who shall be appointed by the President by and with the advice and consent of the Senate, shall—
be at the head of the United States Customs Service;
carry out the duties and powers prescribed by the Secretary of the Treasury; and
report to the Secretary of the Treasury through such other officials as may be designated by the Secretary.
