19 U.S.C. § 4586 — Subsidy negotiations

This section addresses subsidy negotiations. It sets the rules and duties stated in the section.
For a trade agreement the President may make with a USMCA country, United States negotiating goals on subsidies must include: (1) stronger rules on foreign-government domestic subsidies, including capital, loans, or guarantees on noncommercial terms; preferential prices for goods or services; funds or debt forgiveness covering a specific industry’s operating losses; and government assumption of manufacturing, production, or distribution costs; (2) stronger rules on foreign export subsidies, especially for farm products; and (3) effective remedies against subsidized imports, including countervailing duties when appropriate.
In the case of any trade agreement which may be entered into by the President with a USMCA country, the negotiating objectives of the United States with respect to subsidies shall include—
achievement of increased discipline on domestic subsidies provided by a foreign government, including—
the provision of capital, loans, or loan guarantees on terms inconsistent with commercial considerations;
the provision of goods or services at preferential rates;
the granting of funds or forgiveness of debt to cover operating losses sustained by a specific industry; and
the assumption of any costs or expenses of manufacture, production, or distribution;
achievement of increased discipline on export subsidies provided by a foreign government, particularly with respect to agricultural products; and
maintenance of effective remedies against subsidized imports, including, where appropriate, countervailing duties.
