2 U.S.C. § 162b — Little Scholars Child Development Center; employee compensation and personnel matters

(a) Election of coverage; creditable service; qualification for survivor annuities and disability benefits; contributions to thrift savings plan; certification concerning creditable service (1) This subsection applies to anyone who works at the Library of Congress Child Development Center — called the "Little Scholars Child Development Center," or "the Center" — and who elects, with the Librarian of Congress, to be covered by this subsection. They must make that election within 60 days after December 21, 2000, or within 60 days after starting the job, whichever is later. (2)(A) Such an employee may get retirement credit under section 8411 of title 5 for Center service performed before December 21, 2000, if they pay the deposit required under section 8411(f)(2) of title 5, without needing to meet the condition in section 8411(b)(3) of title 5. (B) For Center service performed on or after December 21, 2000, the employee must get retirement credit under section 8411 of title 5, if amounts are withheld from their pay the way they would be withheld from a regular federal employee's pay under section 8422 of title 5. (3) Regardless of any other rule in this subsection, Center service counts as federal civilian service creditable under section 8411 of title 5, for qualifying for survivor annuities and disability benefits — if the employee pays the amount that would have been withheld from their pay under section 8422 of title 5 for that period, plus interest. (4) Such an employee is treated as a federal employee for purposes of the retirement system in chapter 84 of title 5, including its Thrift Savings Plan subchapter, and may start making Thrift Savings Plan contributions under section 8432 of title 5, beginning with the first pay period after they elect coverage under this section. (5) The Office of Personnel Management must accept the Librarian of Congress's certification about an employee's creditable service. (b) Health insurance coverage Any individual employed by the Center on or after December 21, 2000, is treated as a federal employee under section 8901(1) of title 5, for health insurance coverage under chapter 89 of title 5. An employee working at the Center on December 21, 2000, could elect this coverage before the 60th day after that date; later hires may elect during periods the Office of Personnel Management sets. (c) Life insurance coverage Anyone employed by the Center is treated as a federal employee under section 8701(a) of title 5, for life insurance coverage under chapter 87 of title 5. (d) Government contributions by Librarian from available appropriations The Librarian of Congress must pay the government's share of contributions for Center employees' benefits under this section — as figured under sections 8423, 8432, 8708, and 8906 of title 5 — from money appropriated to the Library of Congress. (e) Payroll and personnel functions of Library of Congress The Library of Congress, directly or through its designated representative, must: (1) process payroll for Center employees, including making the deductions and withholdings required under sections 8422, 8432, 8707, and 8905 of title 5; (2) keep proper personnel and payroll records for Center employees, and send the right information and records to the Office of Personnel Management; and (3) send the government's and employees' contribution funds under this section to the Office of Personnel Management. (f) Responsibilities of Center The Center must: (1) except as subsection (g) allows, pay the Library of Congress enough money to cover Center employees' gross salary and the employer's share of taxes under section 3111 of title 26, in amounts the Library of Congress figures; (2) reimburse the Library of Congress for reasonable administrative costs from subsection (e)(1), if the Library requires it; (3) follow the Librarian of Congress's regulations and procedures for running this section; (4) keep proper records on all Center employees, as the Librarian requires; and (5) consult with the Librarian on running this section. (g) Reimbursement for certain compensation As an exception to subsection (f)(1): for the pay of the Center's Executive Director and Deputy Executive Director, the Librarian of Congress may instead reimburse the Center for those costs, using money appropriated or otherwise made available for the Library of Congress's salaries and expenses. (h) Regulations The Librarian of Congress may write regulations to carry out this section.
