32 U.S.C. § 302 — Enlistments, reenlistments, and extensions

National Guard members can enlist for set terms based on their military background. Reenlistment terms can be set or, for senior enlisted members, open-ended. Enlistments can also be extended by request or during a declared emergency.
(a) Original enlistments: Under rules the Secretary concerned prescribes, a first enlistment in the National Guard may be accepted for (1) any specified term of at least three years, for people who have not served in an armed force, or (2) any specified term of at least one year, for people who have served in an armed force.
(b) Reenlistments: Under those same rules, a reenlistment in the National Guard may be accepted for any specified period — or, if the person's last service was in one of the top five enlisted grades, for an unspecified period.
(c) Extensions: An enlistment or reenlistment may be extended (1) under Secretary rules, at the member's request, for any period of at least six months, or (2) by presidential proclamation, if Congress declares an emergency, until six months after that emergency ends.
Under regulations to be prescribed by the Secretary concerned, original enlistments in the National Guard may be accepted for—
any specified term, not less than three years, for persons who have not served in an armed force; or
any specified term, not less than one year, for persons who have served in any armed force.
Under regulations to be prescribed by the Secretary concerned, reenlistment in the National Guard may be accepted for any specified period, or, if the person last served in one of the highest five enlisted grades, for an unspecified period.
Enlistments or reenlistments in the National Guard may be extended—
under regulations to be prescribed by the Secretary concerned, at the request of the member, for any period not less than six months; or
by proclamation of the President, if Congress declares an emergency, until six months after termination of that emergency.
