32 U.S.C. § 309 — Federal recognition of National Guard officers: officers promoted to fill vacancies

National Guard officers promoted to fill a vacancy in a federally recognized unit must be examined for Federal recognition. This applies to officers who have served at least one year on the reserve active-status or active-duty list. They must also meet the minimum time-in-grade rules in section 14303 of title 10.
This law applies to a National Guard officer who is promoted to fill an open position in a federally recognized National Guard unit.
To qualify, the officer must have been on the Army's or Air Force's reserve active-status list, or its active-duty list, for at least one year. The officer must also have completed the minimum years of service in their current grade, as set out in section 14303 of title 10.
If the officer meets both requirements, they must be examined for Federal recognition in the higher grade they were promoted to.
Each officer of the National Guard who is promoted to fill a vacancy in a federally recognized unit of the National Guard, and who has been on the reserve active-status list or the active-duty list of the Army or the Air Force for at least one year and has completed the minimum years of service in grade specified in section 14303 of title 10, shall be examined for Federal recognition in the grade to which the officer is promoted.
