32 U.S.C. § 310 — Federal recognition of National Guard officers: automatic recognition
submitted 68 years ago by Pub. L. 85-861 to r/title-32-NATIONAL-GUARD · 335 words · no verdicts yet
Certain promoted National Guard officers and warrant officers automatically get Federal recognition in their new grade, without a separate exam. This applies once they finish required time-in-grade and stay in active status. It also covers Army or Air Force Reserve officers appointed to fill a National Guard vacancy.
(a)(1) Normally, sections 307 and 309 of this title would apply, but not here: if a National Guard second lieutenant is promoted to first lieutenant to fill a vacancy in a federally recognized unit, Federal recognition in that new grade kicks in automatically. This happens once the officer has completed the required time in grade under section 14303(a)(1) of title 10 and met any other requirements the Secretary concerned set under section 14308(b) of that title — as long as the officer has stayed in active status since being recommended.
(a)(2) The same kind of automatic recognition applies to a warrant officer, W-1, promoted to chief warrant officer, W-2, to fill a Guard vacancy. It kicks in once the officer completes the time in grade the Secretary concerned requires under section 12242 of title 10, as long as the warrant officer stayed in active status since being recommended.
(b) Also despite sections 307 and 309, if an Army Reserve or Air Force Reserve officer above second lieutenant is appointed to the next higher grade in the National Guard to fill a vacancy, Federal recognition in that new grade is automatic — as long as the officer was recommended for promotion under chapter 1405 of title 10 and has stayed in active status since. This recognition takes effect the day the officer is appointed into the National Guard.
Notwithstanding sections 307 and 309 of this title, if a second lieutenant of the National Guard is promoted to the grade of first lieutenant to fill a vacancy in a federally recognized unit in the National Guard, Federal recognition is automatically extended to that officer in the grade of first lieutenant, effective as of the date on which that officer has completed the service in the grade specified in section 14303(a)(1) of title 10 and has met such other requirements as prescribed by the Secretary concerned under section 14308(b) of that title, if the officer has remained in an active status since the officer was so recommended.
Notwithstanding sections 307 and 309 of this title, if a warrant officer, W–1, of the National Guard is promoted to the grade of chief warrant officer, W–2, to fill a vacancy in a federally recognized unit in the National Guard, Federal recognition is automatically extended to that officer in the grade of chief warrant officer, W–2, effective as of the date on which that officer has completed the service in the grade prescribed by the Secretary concerned under section 12242 of title 10, if the warrant officer has remained in an active status since the warrant officer was so recommended.
Notwithstanding sections 307 and 309 of this title, if an officer of the Army Reserve or the Air Force Reserve in a reserve grade above second lieutenant is appointed in the next higher grade in the National Guard to fill a vacancy in a federally recognized unit in the National Guard, Federal recognition is automatically extended to that officer in the grade in which the officer is so appointed in the National Guard if the officer has been recommended for promotion under chapter 1405 of title 10 and has remained in an active status since the officer was so recommended. The extension of Federal recognition under this subsection is effective as of the date when the officer is appointed in the National Guard.
