36 U.S.C. § 151704 — Officers and employees

(a) Secretary of the Board.—(1) The Librarian of Congress must appoint a Secretary of the Board to serve as the corporation’s executive director. The Librarian may remove the Secretary. (2) The Secretary must know about and have experience in: (A) film preservation and restoration; (B) financial management; and (C) fundraising. (b) Appointment of Officers.—Except as subsection (a) provides, the board appoints, removes, and replaces the corporation’s officers. (c) Appointment of Employees.—Except as subsection (a) provides, the Secretary appoints, removes, and replaces the corporation’s employees. (d) Status and Compensation of Employees.—Corporation employees, including the Secretary: (1) are not Library of Congress employees; (2) are appointed and removed without following title 5 rules for appointments in the competitive service; and (3) may be paid without following title 5, chapter 51, and subchapter III of chapter 53. However, no employee may be paid more than the annual basic-pay rate for GS–15 of the General Schedule under title 5, section 5107.
