42 U.S.C. § 12617 — Service projects
submitted 34 years ago by Pub. L. 101-610 to r/title-42-THE-PUBLIC-HEALTH-AND-WELFARE · 343 words · no verdicts yet
Corps service projects must meet a real public need, especially infrastructure, energy, and development needs. Federal agencies and local groups propose projects, and campus directors pick which ones get done. Campus directors are encouraged to arrange cost-sharing with local communities.
(a) What projects must do. Corps* service projects must: (1) meet an identifiable public need, focusing especially on infrastructure improvement, energy conservation, and urban and rural development; (2) emphasize community service that gives real community benefits and chances to learn through service and build skills; (3) as much as practical, encourage diverse teams working together; and (4) include ongoing education and technical training.
(b) Proposing projects.
(1) Developing proposals. (A) Once the Program* starts, certain officials — the Secretaries of Agriculture, the Interior, Housing and Urban Development, Transportation, and Energy, plus the Administrators of the Environmental Protection Agency and the Federal Emergency Management Agency, and the Chief of the Forest Service — must develop project* proposals, following guidance the Director* sets. (B) Other public and private groups — including community organizations and local representatives near a Corps campus* — may also propose projects. Corps members* are encouraged to suggest projects too.
(2) Consultation. Developing proposals must include talking with the Corporation*, local community representatives, State* Commissions, and people involved in other youth service programs.
(c) Choosing and running projects.
(1) Each campus director picks the projects for that campus's units, choosing from the proposals described in (b).
(2) The Director encourages campus directors to negotiate creative local arrangements with community representatives for running projects — which can include cost-sharing* and communities providing in-kind or other support.
The service projects carried out by the National Civilian Community Corps* shall—
meet an identifiable public need, with specific emphasis on projects in support of infrastructure improvement, energy conservation, and urban and rural development;
emphasize the performance of community service activities that provide meaningful community benefits and opportunities for service-learning* and skills development;
to the maximum extent practicable, encourage work to be accomplished in teams of diverse individuals working together; and
include continued education and training in various technical fields.
Upon the establishment of the Program*, the Secretary* of Agriculture, the Secretary of the Interior, the Secretary of Housing and Urban Development, the Administrator* of the Environmental Protection Agency, the Administrator of the Federal Emergency Management Agency, the Secretary of Energy, the Secretary of Transportation, and the Chief of the Forest Service shall develop proposals for Corps projects pursuant to guidance which the Director* shall prescribe.
Other public and private organizations and agencies, including community-based entities and representatives of local communities in the vicinity of a Corps campus*, may develop proposals for projects for a Corps campus. Corps members* shall also be encouraged to identify projects for the Corps.
The process for developing project proposals under paragraph (1) shall include consultation with the Corporation*, representatives of local communities, State* Commissions, and persons involved in other youth service programs.
The campus director of a Corps campus shall select the projects to be performed by the members of the Corps assigned to the units in that campus. The campus director shall select projects from among the projects proposed or identified pursuant to subsection (b).
The Director shall encourage campus directors to negotiate with representatives of local communities, to the extent practicable, innovative arrangements for the performance of projects. The arrangements may provide for cost-sharing* and the provision by the communities of in-kind support and other support.
