49 U.S.C. § 41312 — Ending or suspending foreign air transportation

A carrier with a certificate to fly to a place must give at least 90 days' notice before ending or pausing that service. If the carrier is the only one flying nonstop or single-plane service between two places, it needs only 60 days' notice. The Secretary of Transportation may allow a temporary suspension if it serves the public interest.
(a) Notice before ending service. A carrier holding a section 41102 certificate for foreign air transportation to a place (1) may end or suspend that service only after giving at least 90 days' notice to the Secretary of Transportation, any affected community, and the relevant state authority; and (2) if it is the only carrier flying nonstop or single-plane service between two places, may end or suspend that service only after giving at least 60 days' notice to the Secretary and each directly affected community.
(b) Temporary suspension. The Secretary may allow a temporary suspension of service under subsection (a) when the Secretary finds it serves the public interest.
An air carrier holding a certificate issued under section 41102 of this title to provide foreign air transportation—
may end or suspend the transportation to a place under the certificate only when the carrier gives at least 90 days notice of its intention to end or suspend the transportation to the Secretary of Transportation, any community affected by that decision, and the State authority of the State in which a community is located; and
if it is the only air carrier holding a certificate to provide non-stop or single-plane foreign air transportation between 2 places, may end or suspend the transportation between those places only when the carrier gives at least 60 days notice of its intention to end or suspend the transportation to the Secretary and each community directly affected by that decision.
The Secretary may authorize the temporary suspension of foreign air transportation under subsection (a) of this section when the Secretary finds the suspension is in the public interest.
