54 U.S.C. § 302704 — Contracts and cooperative agreements

If an Indian tribe's preservation^* program has already been approved to take over functions and responsibilities under section 302702 of this title, and the tribe asks, the Secretary^* must enter into a contract or cooperative agreement with the tribe. That agreement lets the tribe take over any part of the responsibilities described in section 302304(b) of this title, on tribal land^*, if three conditions are met: (1) the Secretary and the tribe agree on any extra financial assistance the tribe will get to cover the costs; (2) the Secretary finds that the tribe's historic preservation^* program has shown it can carry out the contract or agreement and this division; and (3) the contract or agreement spells out what responsibilities still belong to the Secretary or the right State^* Historic Preservation Officers, and provides for proper participation by (A) the tribe's traditional cultural authorities, (B) representatives of other tribes whose traditional land falls under the jurisdiction of the tribe taking over responsibilities, and (C) the interested public.
