54 U.S.C. § 302705 — Agreement for review under tribal historic preservation regulations

The Advisory Council on Historic Preservation may let an Indian tribe review projects on tribal land under the tribe's own preservation regulations instead of the Council's. This is allowed only if the Council decides, after consulting with the tribe and State officers, that the tribal rules protect historic property equally well.
The Advisory Council* on Historic Preservation* may agree with an Indian tribe* to let projects on tribal land* be reviewed under the tribe's own historic preservation* regulations, instead of under the Council's regulations for section 306108 of this title. The Council can only do this after consulting with the tribe and the relevant State* Historic Preservation Officers, and only if the Council decides the tribe's regulations will protect historic property* just as well as the Council's own regulations would.
The Council* may enter into an agreement with an Indian tribe* to permit undertakings on tribal land* to be reviewed under tribal historic preservation* regulations in place of review under regulations promulgated by the Council to govern compliance with section 306108 of this title, if the Council, after consultation with the Indian tribe and appropriate State* Historic Preservation* Officers, determines that the tribal preservation regulations will afford historic property* consideration equivalent to that afforded by the Council’s regulations.
