54 U.S.C. § 305106 — Historic light station sales

(a) In General. (1) When a sale may occur. If nobody is approved to receive a historic light station for free under sections 305101 through 305105, the government offers it for sale instead. (2) Terms of sale. (A) The Administrator sets the sale terms. (B) Those terms must match the requirements in section 305104 — specifically paragraphs (1) through (4) and (8) of subsection (a), and all of subsection (b). (3) Covenants to be included. The sale documents must include covenants that protect the station's historic character and make sure the United States keeps operating and maintaining any Federal aid to navigation there for as long as it's needed. (b) Net Sale Proceeds. (1) Disposition and use of funds. Money left over from selling a light station goes to different places depending on who controlled it. (A) If the station was on public domain land, the money goes to the National Maritime Heritage Grants Program in the Department of the Interior. (B) If the station was under the Secretary of Homeland Security's control, the money (i) is credited to the Coast Guard's Operating Expenses account, and (ii) can be spent on maintaining other light stations still under the Secretary of Homeland Security's control. (2) Availability of funds. This money stays available until it's all spent, on top of whatever else the Coast Guard already has for that purpose.
