7 U.S.C. § 8506 — Role of brown tree snake Technical Working Group
submitted 22 years ago by Pub. L. 108-384 to r/title-7-AGRICULTURE · 592 words · no verdicts yet
A Technical Working Group coordinates government efforts against the brown tree snake. It reviews programs, recommends control and eradication steps, and reports its progress to Congress. It must meet at least once a year. Congress may fund the group up to $450,000 each year through 2010.
(a) Purpose: The Technical Working Group* makes sure that federal, state, territorial, and local agencies work together against the brown tree snake* in a way that is coordinated, effective, complementary, and cost-effective.
(b) Specific duties and activities: The Group must (1) evaluate government programs and policies that might spread the brown tree snake into the United States or the Freely Associated States*, and recommend ways to reduce that risk; (2) recommend and monitor programs to reduce and eventually wipe out the brown tree snake in Guam and any other place in the United States where it has taken hold; and (3) revise the Brown Tree Snake Control Plan, first published in June 1996, which coordinates government efforts to control, block, eradicate, or study the snake.
(c) Reporting requirement: If Congress provides money for it, the Group must write a report covering: (1) progress toward large-scale reduction or elimination of the snake in Guam and other infested sites; the steps needed to stop this snake or other foreign snakes from reaching Guam, the Northern Mariana Islands, Hawaii, American Samoa, and the Freely Associated States; research that could improve control, blocking, and eradication efforts; and the programs governments have funded, are running, or are planning for control, blocking, research, and eradication. The report must also (2) rank government efforts as high, medium, or low priority in four areas — control, blocking, research, and eradication — and (3) assess current funding gaps and future funding needs, plus any regulations that get in the way of these efforts. (4) If Congress has provided money for it, the Group must send this report to Congress within one year of October 30, 2004.
(d) Meetings: The Group must meet at least once a year.
(e) Inclusion of Guam: The responsible Secretaries* must make sure Guam's government is properly represented in the Group.
(f) Support: As much as practical, the Secretaries must give the Group enough resources to run efficiently, and may assign staff to help it do its work.
(g) Authorization of appropriations: Congress may provide up to $450,000 to each Secretary, for each year from 2006 through 2010, to carry out this section.
The Technical Working Group* shall ensure that Federal, State, territorial, and local agency efforts concerning the brown tree snake* are coordinated, effective, complementary, and cost-effective.
The Technical Working Group shall be responsible for the following:
The evaluation of Federal, State, and territorial activities, programs and policies that are likely to cause or promote the introduction or spread of the brown tree snake in the United States or the Freely Associated States* and the preparation of recommendations for governmental actions to minimize the risk of introduction or further spread of the brown tree snake.
The preparation of recommendations for activities, programs, and policies to reduce and eventually eradicate the brown tree snake in Guam or other areas within the United States where the snake may be established and the monitoring of the implementation of those activities, programs, and policies.
Any revision of the Brown Tree Snake Control Plan, originally published in June 1996, which was prepared to coordinate Federal, State, territorial, and local government efforts to control, interdict, eradicate or conduct research on the brown tree snake.
Subject to the availability of appropriations for this purpose, the Technical Working Group shall prepare a report describing—
the progress made toward a large-scale population reduction or eradication of the brown tree snake in Guam or other sites that are infested by the brown tree snake;
the interdiction and other activities required to reduce the risk of introduction of the brown tree snake or other nonindigenous snake species in Guam, the Commonwealth of the Northern Mariana Islands, Hawaii, American Samoa, and the Freely Associated States;
the applied and basic research activities that will lead to improved brown tree snake control, interdiction and eradication efforts conducted by Federal, State, territorial, and local governments; and
the programs and activities for brown tree snake control, interdiction, research and eradication that have been funded, implemented, and planned by Federal, State, territorial, and local governments.
The Technical Working Group shall include in the report a list of priorities, ranked in high, medium, and low categories, of Federal, State, territorial, and local efforts and programs in the following areas:
Control.
Interdiction.
Research.
Eradication.
Technical Working Group shall include in the report the following assessments:
An assessment of current funding shortfalls and future funding needs to support Federal, State, territorial, and local government efforts to control, interdict, eradicate, or conduct research on the brown tree snake.
An assessment of regulatory limitations that hinder Federal, State, territorial, and local government efforts to control, interdict, eradicate or conduct research on the brown tree snake.
Subject to the availability of appropriations for this purpose, the Technical Working Group shall submit the report to Congress not later than one year after October 30, 2004.
The Technical Working Group shall meet at least annually.
The Secretaries* shall ensure that adequate representation is afforded to the government of Guam in the Technical Working Group.
To the maximum extent practicable, the Secretaries shall make adequate resources available to the Technical Working Group to ensure its efficient and effective operation. The Secretaries may provide staff to assist the Technical Working Group in carrying out its duties and functions.
