The term “advanced research and development” means research and development activities used to address research challenges in agriculture and food through— (A) targeted acceleration of novel, early stage innovative agricultural research with promising technology applications and products; or (B) development of qualified products and projects, agricultural technologies, or innovative research tools, which may include— (i) prototype testing, preclinical development, or field experimental use; (ii) assessing and assisting with product approval, clearance, or need for a license under an applicable law, as determined by the Director; or (iii) manufacturing and commercialization of a product.

“agricultural technology” applies in that section

The term “agricultural technology” means machinery and other equipment engineered for an applicable and novel use in agriculture, natural resources, and food relating to the research and development of qualified products and projects. (3) Director

“Director” applies in that section

The term “Director” means the Director of the Agriculture Advanced Research and Development Authority established under subsection (b)(1). (4) Other transaction

“other transaction” applies in that section

The term “other transaction” means a transaction other than a procurement contract, grant, or cooperative agreement, including a transaction described in subsection (b)(6)(A). (5) Person

“person” applies in that section

The term “person” means— (A) an individual; (B) a partnership; (C) a corporation; (D) an association; (E) an entity; (F) a public or private corporation; (G) a Federal, State, or local government agency or department; and (H) an institution of higher education, including a land-grant college or university and a non-land-grant college of agriculture. (6) Qualified product or project

“qualified product or project” applies in that section

The term “qualified product or project” means— (A) engineering, mechanization, or technology improvements that will address challenges relating to growing, harvesting, handling, processing, storing, packing, and distribution of agricultural products; (B) plant disease or plant pest recovery countermeasures to intentional or unintentional biological threats (including naturally occurring threats), including— (i) replacement or resistant plant cultivars or varieties; (ii) other enhanced management strategies, including novel chemical, biological, or cultural approaches; or (iii) diagnostic or surveillance technology; and (C) veterinary countermeasures to intentional or unintentional …

“research tool” applies in that section

The term “research tool” means a device, technology, procedure, biological material, reagent, computer system, computer software, or analytical technique that is developed to assist in the discovery, development, or manufacture of a qualified product or project. (b) Agriculture Advanced Research and Development Authority (1) Establishment There is established within the Department of Agriculture a pilot program that shall be known as the Agriculture Advanced Research and Development Authority (referred to in this section as the “AGARDA”) to carry out advanced research and development.

“eligible institution” applies throughout its subchapter

the term “eligible institution” means an institution of higher education (as defined in section 1001(a) of title 20 ) in an insular area that has demonstrable capacity to carry out teaching and extension programs in the food and agricultural sciences.

The term “Department” means the United States Department of Agriculture.;

“end product” applies throughout its chapter

The term “end product” means any product which contains processed wheat as an ingredient and which is intended, as produced, for consumption as human food, notwithstanding any additional incidental preparation which may be necessary by the ultimate consumer.;

“end product manufacturer” applies throughout its chapter

The term “end product manufacturer” means any person who commercially produces an end product within the United States, but such term shall not include such persons to the extent that they produce end products on the premises where such end products are to be consumed by an ultimate consumer, including, but not limited to, hotels, restaurants, and institutions, nor shall such term include persons who produce end products for their own personal, family, or household use.;

“nutrition education” applies throughout its chapter

The term “nutrition education” means any action to disseminate to the public information resulting from research concerning the economic value or nutritional benefits of wheat, processed wheat, and end products.;

“person” applies throughout its chapter

The term “person” means any individual, partnership, corporation, association, or other entity.;

“processed wheat” applies throughout its chapter

The term “processed wheat” means the wheat-derived content of any substance (such as cake mix or flour) produced for use as an ingredient of an end product by changing wheat grown within the United States in form or character by any mechanical, chemical, or other means.;

“processor” applies throughout its chapter

The term “processor” means any person who commercially produces processed wheat within the United States.;

“research” applies throughout its chapter

The term “research” means any type of research to advance the nutritional quality, marketability, production, or other qualities of wheat, processed wheat, or end products.;

“Secretary” applies throughout its chapter

The term “Secretary” means the Secretary of Agriculture of the United States.;

“United States” applies throughout its chapter

The term “United States” means the several States and the District of Columbia, including any territory or possession.

“wheat” applies throughout its chapter

The term “wheat” means all classes of wheat grains grown in the United States.;

“wheat producer” applies throughout its chapter

The term “wheat producer” means any person who grows wheat within the United States for market.;

“agricultural land” applies throughout its chapter

the term “agricultural land” means any land located in one or more States and used for agricultural, forestry, or timber production purposes as determined by the Secretary under regulations to be prescribed by the Secretary;

“foreign government” applies throughout its chapter

the term “foreign government” means any government other than the Federal Government or any government of a State or a political subdivision of a State;

“foreign person” applies throughout its chapter

the term “foreign person” means— (A) any individual— (i) who is not a citizen or national of the United States; (ii) who is not a citizen of the Northern Mariana Islands or the Trust Territory of the Pacific Islands; or (iii) who is not lawfully admitted to the United States for permanent residence, or paroled into the United States, under the Immigration and Nationality Act [ 8 U.S.C.

The term “Agreement” means the International Sugar Agreement, 1977, signed at New York City on December 9, 1977 .;

The term “entry” means entry, or withdrawal from warehouse, for consumption in the customs territory of the United States.

“sugar” applies throughout its chapter

The term “sugar” has the same meaning as is given to such term in paragraph (12) of Article 2 of the Agreement.;

“garbage” applies throughout its chapter

the term “garbage” means all waste material derived in whole or in part from the meat of any animal (including fish and poultry) or other animal material, and other refuse of any character whatsoever that has been associated with any such material, resulting from the handling, preparation, cooking, or consumption of food, except that such term shall not include waste from ordinary household operations which is fed directly to swine on the same premises where such household is located;

“person” applies throughout its chapter

the term “person” means any individual, corporation, company, association, firm, partnership, society, or joint stock company or other legal entity; and;

“Secretary” applies throughout its chapter

the term “Secretary” means the Secretary of Agriculture;

“State” applies throughout its chapter

the term “State” means the fifty States, the District of Columbia, Guam, Puerto Rico, the Virgin Islands of the United States, American Samoa, the Commonwealth of the Northern Mariana Islands, and the territories and possessions of the United States.

“agricultural grain” applies in that section

The terms “agricultural grain” and “grain” mean any agricultural commodity (A) that is suitable for processing into alcohol for use as a fuel, and (B) with respect to which a price support operation is in effect.;

“grain” applies in that section

The terms “agricultural grain” and “grain” mean any agricultural commodity (A) that is suitable for processing into alcohol for use as a fuel, and (B) with respect to which a price support operation is in effect.;

“processor” applies in that section

The term “processor” means any person engaged within the United States in the business of manufacturing grain into alcohol for use as a fuel either by itself or in combination with some other product.;

“producer storage program” applies in that section

The term “producer storage program” means the producer storage program provided for under section 1445e 1 of this title. (5) The term “small scale biomass energy project” shall have the same meaning as defined in section 8802(19) of title 42 . (b) Loans on stored grain; processors eligible To assist processors in obtaining a dependable supply of grain at reasonable prices, the Secretary may formulate and administer a program under which processors purchasing and storing grain needed by them for manufacturing into alcohol for use as a fuel may obtain a loan from the Secretary on such grain.

“Secretary” applies in that section

The term “Secretary” means the Secretary of Agriculture.;

“farmland” applies throughout its chapter

the term “farmland” includes all land defined as follows: (A) prime farmland is land that has the best combination of physical and chemical characteristics for producing food, feed, fiber, forage, oilseed, and other agricultural crops with minimum inputs of fuel, fertilizer, pesticides, and labor, and without intolerable soil erosion, as determined by the Secretary. Prime farmland includes land that possesses the above characteristics but is being used currently to produce livestock and timber.

“Federal program” applies throughout its chapter

the term “Federal program” means those activities or responsibilities of a department, agency, independent commission, or other unit of the Federal Government that involve (A) undertaking, financing, or assisting construction or improvement projects; or (B) acquiring, managing, or disposing of Federal lands and facilities. The term “Federal program” does not include construction or improvement projects that on the effective date of this chapter are beyond the planning stage and are in either the active design or construction state; and;

“Secretary” applies throughout its chapter

the term “Secretary” means the Secretary of Agriculture.

“State” applies throughout its chapter

the term “State” means any of the fifty States, the District of Columbia, the Commonwealth of Puerto Rico, the Commonwealth of the Northern Mariana Islands, the Trust Territory of the Pacific Islands, or any territory or possession of the United States;

“unit of local government” applies throughout its chapter

the term “unit of local government” means the government of a county, municipality, town, township, village, or other unit of general government below the State level, or a combination of units of local government acting through an areawide agency under State law or an agreement for the formulation of regional development policies and plans;

“commodity group” applies throughout its chapter

The term “commodity group” means that portion of the flower and plant industry devoted to the production and importation of any one of the following: (A) cut flowers; (B) potted flowering plants; or (C) foliage plants.;

“consumer education” applies throughout its chapter

The term “consumer education” means any action to provide information on the care and handling of cut flowers, potted flowering plants, and foliage plants.;

“cost of plant material” applies throughout its chapter

The term “cost of plant material” means the actual price paid by a producer for any propagational material or any other flowers and plants used in the production of flowers and plants. This term does not include the cost of seeds.

“cut flowers” applies throughout its chapter

The term “cut flowers” means all flowers and decorative foliage used as fresh-cut flowers, fresh-cut decorative foliage, dried, preserved, and processed flowers, or dried and preserved decorative foliage, produced either under cover or in field operations.;

“Floraboard” applies throughout its chapter

The term “Floraboard” means the board provided for under section 4306 of this title .;

“flowers and plants” applies throughout its chapter

The term “flowers and plants” means cut flowers, potted flowering plants, foliage plants, and propagational material.;

“foliage plants” applies throughout its chapter

The term “foliage plants” means those plants, normally without flowers, primarily produced in pots or similar containers, that are primarily used for interior decorations, whether grown under cover or in field operations.;

“importer” applies throughout its chapter

The term “importer” means any person who imports cut flowers, potted flowering plants, or foliage plants from outside of the United States or who acts as an agent, broker, or consignee of any person or nation that produces flowers and plants outside of the United States for sale in the United States.;

“marketing” applies throughout its chapter

The term “marketing” means the sale or other disposition in commerce of cut flowers, potted flowering plants, and foliage plants. (13) Unless otherwise noted,

“person” applies throughout its chapter

The term “person” means any individual, group of individuals, partnership, corporation, association, cooperative, or any other entity.;

“potted flowering plants” applies throughout its chapter

The term “potted flowering plants” means those plants that normally produce flowers, primarily produced in pots or similar containers, that are primarily used for interior decoration, whether grown under cover or in field operations.;

“producer” applies throughout its chapter

the term “producer” means any person who produces domestically, for sale in commerce, cut flowers, potted flowering plants, or foliage plants.;

“promotion” applies throughout its chapter

The term “promotion” means any action, including paid advertising, to advance the image or desirability of cut flowers, potted flowering plants, and foliage plants.;

“propagational material” applies throughout its chapter

The term “propagational material” means any plant material used in the propagation of cut flowers, potted flowering plants, and foliage plants, including cuttings, bulbs and corms, seedlings, canes, liners, plants, cells or tissue cultures, air layers and bublets, 1 rhizomes, and root stocks. This term does not include seeds.;

“research” applies throughout its chapter

The term “research” means any type of research to advance the image, desirability, or marketability of cut flowers, potted flowering plants, and foliage plants.;

“Secretary” applies throughout its chapter

The term “Secretary” means the Secretary of Agriculture of the United States Department of Agriculture.;

“United States” applies throughout its chapter

The term “United States” means the fifty States of the United States of America, the territories and possessions of the United States of America, and the District of Columbia.;

“agreement” applies throughout its chapter

The term “agreement” means the Agreement on the International Carriage of Perishable Foodstuffs and on the Special Equipment to be Used for Such Carriage, and the annexes and the appendices thereto, done at Geneva, September 1, 1970 , under the auspices of the Economic Commission for Europe of the United Nations.;

“contracting party” applies throughout its chapter

The term “contracting party” means any country that is eligible under article 9 of the agreement and that has complied with the terms of such article.;

“equipment” applies throughout its chapter

The term “equipment” means the special transport equipment that complies with the definitions and standards set forth in annex 1 to the agreement, including, but not limited to, railway cars, trucks, trailers, semitrailers, and intermodal freight containers that are insulated only, or insulated and equipped with a refrigerating, mechanically refrigerating, or heating appliance.;

“international carriage” applies throughout its chapter

The term “international carriage” means transportation of perishable foodstuffs if such foodstuffs are loaded in equipment or the equipment containing them is loaded onto a rail or road vehicle, in the territory of any country and such foodstuffs are, or the equipment containing them is, unloaded in the territory of another country that is a contracting party, where such transportation is by— (A) rail, (B) road, (C) any combination of rail and road, or (D) any sea crossing of less than one hundred and fifty kilometers, if preceded or followed by one or more land journeys as referred to in clauses (A), (B), and (C) of this paragraph, and the perishable foodstuffs are shipped in the same …

“perishable foodstuffs” applies throughout its chapter

The term “perishable foodstuffs” means quick deep-frozen and frozen food products listed in annex 2 and food products listed in annex 3 to the agreement.;

“United States” applies throughout its chapter

The term “United States” means the fifty States of the United States, the District of Columbia, the Commonwealth of Puerto Rico, Guam, American Samoa, the Virgin Islands of the United States, the Commonwealth of the Northern Mariana Islands, and any other territory or possession of the United States.

“Board” applies throughout its subchapter

the term “Board” means the National Dairy Promotion and Research Board established under section 4504 of this title ;

The term “Department” means the Department of Agriculture.;

“exporter” applies throughout its chapter

The term “exporter” means any person who exports honey or honey products from the United States. (5) Handle.— (A) In general .—

“handle” applies throughout its chapter

The term “handle” means to process, package, sell, transport, purchase, or in any other way place or cause to be placed in commerce, honey or a honey product. (B) Inclusion .—

“handler” applies throughout its chapter

The term “handler” means any person who handles honey.;

“honey” applies throughout its chapter

The term “honey” means the nectar and saccharine exudations of plants which are gathered, modified, and stored in the comb by honey bees.;

“Honey Board” applies throughout its chapter

The term “Honey Board” means the board provided for under section 4606(c) of this title . (9) Honey production .—

“honey production” applies throughout its chapter

The term “honey production” means all beekeeping operations related to— (A) managing honey bee colonies to produce honey; (B) harvesting honey from the colonies; (C) extracting honey from the honeycombs; and (D) preparing honey for sale for further processing.;

“honey products” applies throughout its chapter

The term “honey products” means products produced, in whole or part, from honey.;

“importer” applies throughout its chapter

The term “importer” means any person who imports honey or honey products into the United States or acts as an agent, broker, or consignee for any person or nation that produces honey outside of the United States for sale in the United States and who is listed in the import records as the importer of record for such honey or honey products. (12) Industry information .—

“industry information” applies throughout its chapter

The term “industry information” means information or a program that will lead to the development of new markets, new marketing strategies, or increased efficiency for the honey industry, or an activity to enhance the image of honey and honey products and of the honey industry.;

“marketing” applies throughout its chapter

The term “marketing” means the sale or other disposition in commerce of honey or honey products. (14) National honey marketing cooperative .—

“national honey marketing cooperative” applies throughout its chapter

The term “national honey marketing cooperative” means a cooperative that markets its products in at least 2 of the following 4 regions of the United States, as determined by the Secretary: (A) The Atlantic Coast, including the District of Columbia and the Commonwealth of Puerto Rico. (B) The Mideast. (C) The Midwest. (D) The Pacific, including the States of Alaska and Hawaii.;

“person” applies throughout its chapter

The term “person” means any individual, group of individuals, partnership, corporation, association, cooperative, or any other entity.;

“producer” applies throughout its chapter

The term “producer” means any person who produces honey in the United States for sale in commerce.;

“producer-packer” applies throughout its chapter

The term “producer-packer” means any person who is both a producer and handler of honey.;

“promotion” applies throughout its chapter

The term “promotion” means any action, including paid advertising, pursuant to this chapter, to present a favorable image for honey or honey products to the public with the express intent of improving the competitive position and stimulating sales of honey or honey products. (19) Qualified national organization representing handler interests .—

“qualified national organization representing handler interests” applies throughout its chapter

The term “qualified national organization representing handler interests” means an organization that the Secretary certifies as being eligible to recommend nominations for the Committee handler, handler-importer, alternate handler, and alternate handler-importer members of the Honey Board under section 4606(b) of this title . (20) Qualified national organization representing importer interests .—

“qualified national organization representing importer interests” applies throughout its chapter

The term “qualified national organization representing importer interests” means an organization that the Secretary certifies as being eligible to recommend nominations for the Committee importer, handler-importer, alternate importer, and alternate handler-importer members of the Honey Board under section 4606(b) of this title .;

“research” applies throughout its chapter

The term “research” means any type of research designed to advance the image, desirability, usage, marketability, production, or quality of honey or honey products.;

“Secretary” applies throughout its chapter

The term “Secretary” means the Secretary of Agriculture.;

“State” applies throughout its chapter

The term “State” means any of the several States, the District of Columbia and the Commonwealth of Puerto Rico.;

“State association” applies throughout its chapter

The term “State association” means that organization of beekeepers in a State which is generally recognized as representing the beekeepers of that State.

“existing Honey Board” applies in that section

The term “existing Honey Board” means the Honey Board in effect on the date of enactment of this paragraph. (B) Conduct of referenda .— Notwithstanding any other provision of law, subject to subparagraph (C), the order providing for the establishment and operation of the existing Honey Board shall continue in force, until the Secretary first conducts, at the earliest practicable date, but not later than 180 days after the date of enactment of this paragraph, referenda on orders to establish a honey packer-importer board or a United States honey producer board.

“person” applies in that section

(b) Authority of Secretary If the Secretary finds that an order issued under this chapter, or any provision of the order, obstructs or does not tend to effectuate the purposes of this chapter, the Secretary shall terminate or suspend the operation of the order or provision.

The term “order” means a pork and pork products promotion, research, and consumer information order issued under section 4803 of this title .;

The term “person” means an individual, group of individuals, partnership, corporation, association, organization, cooperative, or other entity.;

“porcine animal” applies throughout its chapter

The term “porcine animal” means a swine raised for— (A) feeder pigs; (B) seedstock; or (C) slaughter.;

The term “pork” means the flesh of a porcine animal.;

“pork product” applies throughout its chapter

The term “pork product” means a product produced or processed in whole or in part from pork.;

“producer” applies throughout its chapter

The term “producer” means a person who produces porcine animals in the United States for sale in commerce.;

“promotion” applies throughout its chapter

The term “promotion” means an action, including paid advertising, taken to present a favorable image for porcine animals, pork, or pork products to the public with the intent of improving the competitive position and stimulating sales of porcine animals, pork, or pork products.;

“research” applies throughout its chapter

The term “research” means— (A) research designed to advance, expand, or improve the image, desirability, nutritional value, usage, marketability, production, or quality of porcine animals, pork, or pork products; or (B) dissemination to a person of the results of such research.;

“Secretary” applies throughout its chapter

The term “Secretary” means the Secretary of Agriculture.;

“State” applies throughout its chapter

The term “State” means each of the 50 States.;

“State association” applies throughout its chapter

The term “State association” means— (A) the single organization of pork producers in a State that is— (i) organized under the laws of the State in which such association operates; and (ii) recognized by the chief executive officer of such State as representing the pork producers of such State; or (B) if such organization does not exist on January 1, 1986 , an organization that represents not fewer than 50 pork producers who market annually, in the aggregate, not less than 10 percent of the volume (measured in pounds) of porcine animals marketed in such State.;

“to market” applies throughout its chapter

The term “to market” means to sell or to otherwise dispose of a porcine animal, pork, or pork product in commerce.

“Board” applies throughout its chapter

The term “Board” means the National Watermelon Promotion Board provided for in section 4906 of this title .;

“handler” applies throughout its chapter

The term “handler” means any person (except a common or contract carrier of watermelons owned by another person) who handles watermelons in a manner specified in a plan issued under this chapter or in regulations promulgated thereunder.;

“importer” applies throughout its chapter

The term “importer” means any person who imports watermelons into the United States.;

“person” applies throughout its chapter

The term “person” means any individual, group of individuals, partnership, corporation, association, cooperative, or other entity.;

“plan” applies throughout its chapter

The term “plan” means an order issued by the Secretary under this chapter.;

“producer” applies throughout its chapter

The term “producer” means any person engaged in the growing of 10 or more acres of watermelons.;

“promotion” applies throughout its chapter

The term “promotion” means any action taken by the Board, under this chapter, to present a favorable image for watermelons to the public with the express intent of improving the competitive position of watermelons in the marketplace and stimulating sales of watermelons, and shall include, but not be limited to, paid advertising.;

“Secretary” applies throughout its chapter

The term “Secretary” means the Secretary of Agriculture.;

“United States” applies throughout its chapter

The term “United States” means each of the several States and the District of Columbia.

“watermelon” applies throughout its chapter

The term “watermelon” means all varieties of watermelon grown by producers in the United States or imported into the United States.;

“Board” applies throughout its chapter

the terms “Interagency Board for Nutrition Monitoring and Related Research” and “Board” mean the Federal coordinating body established by section 5311(c) of this title ;

“comprehensive plan” applies throughout its chapter

the term “comprehensive plan” means the comprehensive plan prepared under section 5313 of this title ;

“coordinated program” applies throughout its chapter

the term “coordinated program” means the National Nutrition Monitoring and Related Research Program established by section 5311(a) of this title ;
