10 U.S.C. § 500f — Evaluations of abilities of armed forces and combatant commands to perform electromagnetic spectrum operations missions

(a) Evaluations of Armed Forces. (1) Starting October 1, 2024, and every year through 2029, the Chief of Staff of the Army, the Chief of Naval Operations, the Chief of Staff of the Air Force, the Commandant of the Marine Corps, and the Chief of Space Operations must each evaluate whether their branch can perform the electromagnetic spectrum operations missions required by (A) the Electromagnetic Spectrum Superiority Strategy, (B) the Joint Staff's concept of operations for these operations, and (C) the operations and contingency plans of the combatant commands. (2) By December 31 of each year an evaluation is required, each official must certify to the congressional defense committees that their evaluation happened. (3) Each evaluation must assess: (A) current programs of record, including (i) whether weapon systems can perform missions in contested electromagnetic environments, and (ii) the ability to disrupt enemy operations through electromagnetic attack; (B) future programs of record, including (i) the need for distributed, network-centric electromagnetic warfare and signals intelligence capabilities, and (ii) the need for automated or AI-assisted electromagnetic spectrum operations capabilities; (C) order of battle; (D) individual and unit training; (E) tactics, techniques, and procedures, including (i) maneuver, spreading out assets, and using decoys, and (ii) combining non-kinetic and kinetic fires; and (F) any other matter relevant to judging the branch's readiness. (b) Evaluations of Combatant Commands. (1) Starting October 1, 2024, and every year through 2029, the Chairman of the Joint Chiefs of Staff — acting through the Electromagnetic Spectrum Enterprise Operational Lead created under section 500e — must evaluate whether the combatant commands' plans and posture can carry out the operations described in (A) the Electromagnetic Spectrum Superiority Strategy and (B) the Joint Staff's concept of operations. (2) Each evaluation must assess, as relevant: (A) operation and contingency plans; (B) how well-staffed, organized, and capable joint electromagnetic spectrum operations cells are; (C) mission rehearsals and exercises; and (D) force positioning, posture, and readiness. (3) By December 31 of each year an evaluation is required, the Chairman — acting through the operational lead — must brief the congressional defense committees on the results.
