10 U.S.C. § 7451 — Cadets: deficiencies in conduct or studies; effect of failure on successor

A cadet reported deficient in conduct or studies and recommended for discharge generally may not return to or be reappointed to the Academy. A cadet who fails one subject may receive one timely reexamination, and a graduating class member’s delay does not delay the successor’s admission.
(a) A cadet reported deficient in conduct or studies and recommended for discharge may not be returned or reappointed to the Academy unless the Academic Board recommends it. (b) A cadet who fails a required examination because of deficiency in one subject is entitled to one reexamination in that subject, with the same scope and difficulty, if the cadet applies in writing to the Academic Board within 10 days after official notice of the failure. The reexamination must occur within 60 days after the application. If the cadet passes and is otherwise qualified, the cadet must be readmitted. If the cadet fails, there may be no further examination. (c) If a member of a graduating class does not finish the course with that class, the admission of the successor is not delayed.
A cadet who is reported as deficient in conduct or studies and recommended to be discharged from the Academy may not, unless recommended by the Academic Board, be returned or reappointed to the Academy.
Any cadet who fails to pass a required examination because he is deficient in any one subject of instruction is entitled to a reexamination of equal scope and difficulty in that subject, if he applies in writing to the Academic Board within 10 days after he is officially notified of his failure. The reexamination shall be held within 60 days after the date of his application. If the cadet passes the reexamination and is otherwise qualified, he shall be readmitted to the Academy. If he fails, he may not have another examination.
The failure of a member of a graduating class to complete the course with his class does not delay the admission of his successor.
