The term “preference eligible” has the meaning given that term in section 2108(3) of title 5 .;

The term “qualified position” means a position, designated by the Secretary for the purpose of this section, in which the individual occupying such position performs, manages, or supervises functions that execute the responsibilities of the United States Cyber Command relating to cyber operations.;

The term “appropriate congressional committees” means— (i) the congressional defense committees; and (ii) the Permanent Select Committee on Intelligence of the House of Representatives and the Select Committee on Intelligence of the Senate.;

covered employee applies in that section

The term “covered employee” means an employee in a defense intelligence position who is assigned to the Defense Clandestine Service at a location in the United States that the Secretary determines has living costs equal to or higher than the District of Columbia.

time-limited appointment applies in that section

the term “time-limited appointment” means an appointment (subject to the condition in subsection (b)) for a period not to exceed two years.

The term “senior contracting official” means a director of contracting, or a principal deputy to a director of contracting, serving in the office of the Secretary of a military department, the headquarters of a military department, the head of a Defense Agency, a subordinate command headquarters, or in a major systems or logistics contracting activity in the Department of Defense.

significant nonmajor defense acquisition program applies throughout its subchapter

The term “significant nonmajor defense acquisition program” means a Department of Defense acquisition program that is not a major defense acquisition program (as defined in section 4201 of this title ) and that is estimated by the Secretary of Defense to require an eventual total expenditure for research, development, test, and evaluation of more than the dollar threshold set forth in section 3041(b)(1) of this title for such purposes for a major system or an eventual total expenditure for procurement of more than the dollar threshold set forth in section 3041(b)(1) of this title for such purpose for a major system.;

the term “defense acquisition university” includes the Defense Systems Management College. (c) Curriculum Development .— The President of the Defense Acquisition University shall work with the relevant professional schools and degree-granting institutions of the Department of Defense and military departments, and with extramural institutions (as defined in section 1746a(g) of this title ), to ensure that best practices are used in curriculum development to support acquisition workforce positions.

The term “acquisition workforce” has the meaning given such term in section 1705(g) of this title . (2) Extramural institutions .—

The term “extramural institutions” means participants in an activity established under section 4142 of this title , public sector organizations, and nonprofit credentialing organizations.

covered congressional committees applies in that section

the term “covered congressional committees” means— (1) the Committees on Armed Services of the Senate and the House of Representatives; (2) the Committee on Homeland Security and Governmental Affairs of the Senate; and (3) the Committee on Oversight and Government Reform of the House of Representatives. (g) Termination of Authority .— The authority to conduct a demonstration project under this section shall terminate on December 31, 2031 .

non-medical counseling services applies in that section

the term “non-medical counseling services” means mental health care services that are non-clinical, short-term and solution focused, and address topics related to personal growth, development, and positive functioning.

covered military housing applies in that section

The term “covered military housing” means housing acquired or constructed pursuant to subchapter IV of chapter 169 of this title that is owned by an entity other than the Federal Government.

landlord applies in that section

The term “landlord” has the meaning given that term in section 2871 of this title .;

portable career applies in that section

the term “portable career” includes an occupation identified by the Secretary of Defense, in consultation with the Secretary of Labor, as requiring education and training that results in a credential that is recognized nationwide by industry or specific businesses. (f) Regulations .— The Secretary of Defense shall prescribe regulations to govern the availability and use of assistance under this section. The Secretary shall ensure that programs established under this section do not result in inequitable treatment for spouses of members of the armed forces who are also members, since they are excluded from participation in the programs under subsection (c)(2).

child abuse and neglect applies in that section

the term “child abuse and neglect” has the meaning provided in section 3 of the Child Abuse Prevention and Treatment Act ( Public Law 93–247 ; 42 U.S.C. 5101 note).

Commander applies in that section

The term “Commander” means the Commander of the United States Special Operations Command.;

covered individuals applies in that section

The term “covered individuals” means— (A) members of the Armed Forces (including the reserve components) assigned to special operations forces; (B) service personnel assigned to support special operations forces; (C) immediate family members of individuals described in subparagraphs (A) and (B); and (D) immediate family members of individuals described in subparagraphs (A) or (B) in a case in which such individual died— (i) as a direct result of armed conflict; (ii) while engaged in hazardous service; (iii) in the performance of duty under conditions simulating war; or (iv) through an instrumentality of war.

family support services applies in that section

The term “family support services” includes psychological support, spiritual support, and costs of transportation, food, lodging, child care, supplies, fees, and training materials for covered individuals while participating in programs under subsection (a).;

immediate family members applies in that section

The term “immediate family members” has the meaning given that term in section 1789(c) of this title .;

special operations forces applies in that section

The term “special operations forces” means those forces of the armed forces identified as special operations forces under section 167(j) of this title .;

covered individual applies in that section

the term “covered individual” means— (1) a member of the armed forces on active duty; (2) a member of the reserve components in an active status; or (3) a dependent of an individual described in paragraph (1) or (2).

competitive service position applies in that section

the term “competitive service position” means a position in the competitive service, as defined in section 2102(a)(1) of title 5 .

covered incident applies in that section

the term “covered incident” means alleged or suspected abuse or neglect of a child that occurs at a military child development center.

child care employee applies throughout its subchapter

The term “child care employee” means a civilian employee of the Department of Defense who is employed to work in a military child development center (regardless of whether the employee is paid from appropriated funds or nonappropriated funds).;

child care fee receipts applies throughout its subchapter

The term “child care fee receipts” means those nonappropriated funds that are derived from fees paid by members of the armed forces for child care services provided at military child development centers.

family home day care applies throughout its subchapter

The term “family home day care” means home-based child care services that are provided for members of the armed forces by an individual who (A) is certified by the Secretary of the military department concerned as qualified to provide those services, and (B) provides those services on a regular basis for compensation.;

military child development center applies throughout its subchapter

The term “military child development center” means a facility on a military installation (or on property under the jurisdiction of the commander of a military installation) at which child care services are provided for members of the armed forces or any other facility at which such child care services are provided that is operated by the Secretary of a military department.;

dependent applies in that section

the term “dependent” has the same meaning that it has under section 401 of title 37 .

advanced education applies in that section

The term “advanced education” means education or training above the secondary school level but does not include technical training provided to a member of the armed forces to qualify such member to perform a specified military function, to workshops, or to short-term training programs.;

assistance applies in that section

The term “assistance” means the direct provision of any course of advanced education by the Secretary concerned, reimbursement by the Secretary concerned for any course of advanced education provided by another department or agency of the Federal Government, or the payment, in whole or in part, by the Secretary concerned for any course of advanced education provided by any public or private educational institution or other entity, but such term does not include the payment for any course of advanced education which is paid for under chapter 106 or 107 of this title.;

cost of advanced education applies in that section

The term “cost of advanced education” means those costs which are, under regulations prescribed by the Secretary concerned, directly attributable to the education of the person to whom a course of advanced education is provided, including the cost of tuition and other fees (or, if none is charged, an amount determined by the Secretary concerned to be a reasonable charge for the education provided), the cost of books, supplies, transportation, and miscellaneous expenses, and the cost of room and board, but such term does not include pay or allowances under title 37 or a stipend under section 2121 of this title .

armed forces education liabilities applies in that section

The term “armed forces education liabilities” means liabilities of the armed forces for benefits under chapter 30 or 33 of title 38 and for Department of Defense benefits under paragraphs (3) and (4) of section 510(e) and chapters 1606 and 1607 of this title, including funds provided by the Secretary of Homeland Security for education liabilities for the Coast Guard when it is not operating as a service in the Department of the Navy.

institution of higher education applies in that section

The term “institution of higher education” has the meaning given that term in section 102 of the Higher Education Act for 1965 ( 20 U.S.C. 1002 ).

non-Government facility applies in that section

the term “non-Government facility” means any of the following: (A) The government of a State or of a territory or possession of the United States, including the Commonwealth of Puerto Rico, an interstate governmental organization, and a unit, subdivision, or instrumentality of any of the foregoing. (B) A foreign government or international organization, or instrumentality of either, which is designated by the President as eligible to provide training under this section. (C) A medical, scientific, technical, educational, research, or professional institution, foundation, or organization.

Executive agency applies in that section

the term “Executive agency” has the meaning given such term in section 105 of title 5 , except that the term does not include the Government Accountability Office.

expenses applies in that section

the term “expenses” means expenses for class room instruction, hands-on training (and associated materials), manuals, study guides and materials, text books, processing fees, and test fees and related fees.

postsecondary educational institution applies in that section

the term “postsecondary educational institution” means a school or other educational institution that is intended to provide students with a course of instruction that is comparable, in length and academic rigor, to a course of instruction for which an associate’s, bachelor’s, or graduate degree may be awarded.

covered subjects applies in that section

The term “covered subjects” means— (A) science; (B) technology; (C) engineering; (D) mathematics; (E) computer science; (F) computational thinking; (G) artificial intelligence; (H) machine learning; (I) data science; (J) quantum information sciences; (K) cybersecurity; (L) robotics; (M) health sciences; and (N) other subjects determined by the Secretary of Defense to be related to science, technology, engineering, and mathematics.

eligible entity applies in that section

The term “eligible entity” means a local education agency that hosts a unit of the Junior Reserve Officers’ Training Corps.;

advanced training applies throughout its chapter

The term “advanced training” means the training and instruction offered in the Senior Reserve Officers’ Training Corps to students enrolled in an advanced education program beyond the baccalaureate degree level or to students in the third and fourth years of a four-year Senior Reserve Officers’ Training Corps course, or the equivalent period of training in an approved two-year Senior Reserve Officers’ Training Corps course (except that, in the case of a student enrolled in an academic program which has been approved by the Secretary of the military department concerned and which requires more than four academic years for completion of baccalaureate degree requirements, including elective …

The term “member of the program” means a student who is enrolled in the Senior Reserve Officers’ Training Corps of an armed force.;

The term “program” means the Senior Reserve Officers’ Training Corps of an armed force.;

National Capital Region applies in that section

the term “National Capital Region” means the area, or portion thereof, as determined by the Secretary, in the vicinity of the District of Columbia.

commissioned service obligation applies in that section

the term “commissioned service obligation” means, with respect to an officer who is a graduate of the University, the period beginning on the date of the appointment of the officer in a regular component after graduation and ending on the tenth anniversary of that appointment.

covered employee applies in that section

the term “covered employee” means an employee of the Department of Veterans Affairs, a civilian employee of the Public Health Service, a member of the commissioned corps of the Public Health Service, a member of the Coast Guard, or a civilian employee of the Coast Guard; and;

head of the Federal agency concerned applies in that section

the term “head of the Federal agency concerned” means the head of the Federal agency that employs, or has jurisdiction over the uniformed service of, a covered employee permitted to receive instruction at the University under subparagraph (A) in the relevant position described in such subparagraph.

military nursing research applies in that section

The term “military nursing research” means research on the furnishing of care and services by nurses in the armed forces.;

TriService Nursing Research Program applies in that section

The term “TriService Nursing Research Program” means the program of military nursing research authorized under this section. (b) Program Authorized .— The Secretary of Defense may establish at the University a program of military nursing research. (c) TriService Research Group .— The TriService Nursing Research Program shall be administered by a TriService Nursing Research Group composed of Army, Navy, and Air Force nurses who are involved in military nursing research and are designated by the Secretary concerned to serve as members of the group.

course of study applies throughout its subchapter

The term “course of study” means education received at an accredited college, university, or institution in medicine, dentistry, or other health profession, leading, respectively, to a degree related to the health professions as determined under regulations prescribed by the Secretary of Defense.;

member of the program applies throughout its subchapter

The term “member of the program” means a person appointed a commissioned officer in a reserve component of the armed forces who is enrolled in the Armed Forces Health Professions Scholarship and Financial Assistance program.;

The term “program” means the Armed Forces Health Professions Scholarship and Financial Assistance program provided for in this subchapter.;

specialized training applies throughout its subchapter

The term “specialized training” means advanced training in a health professions specialty received in an accredited program that is beyond the basic education required for appointment as a commissioned officer with a designation as a health professional.

the term “enlistment” means original enlistment or reenlistment.

accredited institution applies in that section

the term “accredited institution” means a civilian college or university or a trade, technical, or vocational school in the United States (including the District of Columbia, the Commonwealth of Puerto Rico, Guam, and the Virgin Islands) that provides education at the postsecondary level and that is accredited by a nationally recognized accrediting agency or association or by an accrediting agency or association recognized by the Secretary of Education.

actual cost of attendance applies in that section

the term “actual cost of attendance” has the meaning given the term “cost of attendance” by section 472 of the Higher Education Act of 1965 ( 20 U.S.C. 1087 ll ).

dependent child applies in that section

The term “dependent child” has the meaning given the term “dependent” in section 1072(2)(D) of this title .;

surviving spouse applies in that section

The term “surviving spouse” means a widow or widower who is not remarried.

intermediate level service school applies throughout its chapter

The term “intermediate level service school” means any of the following: (A) The United States Army Command and General Staff College. (B) The College of Naval Command and Staff. The term “joint intermediate level school” includes the National Intelligence University.

The term “senior level service school” means any of the following: (A) The Army War College. (B) The College of Naval Warfare. (C) The Air War College. (D) The Marine Corps War College. (E) The Space Force Senior Level Education Program.;

distance education applies in that section

the term “distance education” has the meaning given such term in section 103 of the Higher Education Act of 1965 ( 20 U.S.C. 1003 ).

principal course of instruction applies in that section

the term “principal course of instruction” means any course of instruction offered at the Joint Forces Staff College as Phase II joint professional military education.

children with disabilities applies in that section

The term “children with disabilities” has the meaning given the term in section 602 of the Individuals with Disabilities Education Act ( 20 U.S.C. 1401 ).;

defense dependents’ education system applies in that section

the term “defense dependents’ education system” means the program established and operated under section 1402(a) of the Defense Dependents’ Education Act of 1978 ( 20 U.S.C. 921(a) ). (f) Substantive and Procedural Rights and Protections for Children .— (1) The Secretary shall provide the following substantive rights, protections, and procedural safeguards (including due process procedures) in the educational programs provided for under this section: (A) In the case of children with disabilities aged 3 to 5, inclusive, all substantive rights, protections, and procedural safeguards (including due process procedures) available to children with disabilities aged 3 to 5, inclusive, under part B …

home-schooled student applies in that section

the term “home-schooled student” means a student in a grade equivalent to kindergarten or any of grades 1 through 12 who receives educational instruction at home or by other nontraditional means outside of a public or private school system, either all or most of the time. (m) Meal Programs .— (1) The Secretary of Defense may administer a meal program, consistent with Federal law and standards prescribed by the Secretary of Agriculture for that meal program, for students enrolled in a school established under this section. (2) In this subsection,

infants or toddlers with disabilities applies in that section

The term “infants or toddlers with disabilities” has the meaning given the term in section 632 of such Act ( 20 U.S.C. 1432 ). (g) Reimbursement .— When the Secretary of Defense provides educational services under this section to an individual who is a dependent of an employee of a Federal agency outside the Department of Defense, the head of the other Federal agency shall, upon request of the Secretary of Defense, reimburse the Secretary for those services at rates routinely prescribed by the Secretary for those services.

the term “meal program” means a program established under the Child Nutrition Act of 1966 ( 42 U.S.C. 1771 et seq.) or the Richard B. Russell National School Lunch Act ( 42 U.S.C. 1751 et seq.). (n) Eligibility of Dependents of Certain Members of the Reserve Components .— (1) A dependent of a member described in paragraph (2) shall be eligible to attend a school established under this section at the military installation that is the permanent station of such member and such dependent shall automatically be granted enrollment at such school at the request of such member if there is sufficient space in the school to accommodate the dependent.

medical examination or screening applies in that section

The term “medical examination or screening”— (A) means a physical examination provided by a health care provider; and (B) does not include an evaluation by, or an encounter with, non-clinical school staff.;

The term “school” means— (A) a Department of Defense domestic dependent elementary or secondary school, as described in section 2164 of this title ; or (B) any elementary or secondary school or program for dependents operated by the Department of Defense Education Activity.

covered DODEA school applies in that section

the term “covered DODEA school” means a domestic dependent elementary or secondary school operated by the Department of Defense Education Activity that— (1) was established on or before the date of the enactment of the National Defense Authorization Act for Fiscal Year 2025; and (2) is located in the continental United States.

The term “appropriate congressional committees” means— (A) the Committee on Armed Services of the Senate; and (B) the Committee on Armed Services and the Committee on Education and Workforce of the House of Representatives.;

The term “Defense Dependent School” means— (A) a school operated under the Defense Dependents’ Education System, as authorized under the Defense Dependents’ Education Act of 1978 ( 20 U.S.C. 921 et seq.); or (B) a Department of Defense domestic dependent elementary and secondary school, as authorized under section 2164 of this title .;

dual or concurrent enrollment program applies in that section

The term “dual or concurrent enrollment program” means a program offered by an arrangement between the Department of Defense Education Activity and an institution of higher education and through which a student enrolled in a Defense Dependent School who has not graduated from high school with a regular high school diploma is able to enroll in one or more postsecondary courses and earn credit that applies— (A) toward completion of a postsecondary degree or recognized educational credential as described in the Higher Education Act of 1965 ( 20 U.S.C. 1001 et seq.); and (B) toward completion of high school.;

the term “special allowance” means a special allowance that is payable under section 438 of the Higher Education Act of 1965 ( 20 U.S.C. 1087–1 ).

The terms “captive status” and “former captive” have the meanings given those terms in section 559 of title 37 .;

The term “dependent” has the meaning given that term in section 551 of that title.

The term “State” means any State of the United States, the District of Columbia, the Commonwealth of Puerto Rico, Guam, the United States Virgin Islands, the Commonwealth of the Northern Mariana Islands, American Samoa, and any other territory or possession of the United States. (c) The Secretary shall designate an individual within the Office of the Secretary of Defense to advise and assist the Secretary regarding matters relating to science, mathematics, and engineering education and training.

the term “covered schools” means elementary or secondary schools at which the Secretary determines a significant number of dependents of members of the armed forces are enrolled.

covered academic engagement program applies in that section

the term “covered academic engagement program” means any of the following: (1) A primary, secondary, or post-secondary educational program with a cyber focus. (2) A program of the Department of Defense for the recruitment or retention of cyberspace civilian and military personnel (including scholarship programs) other than a Reserve Officers’ Training Corps program. (3) An academic partnership focused on establishing cyber talent among the personnel referred to in paragraph (2).

The term “cost of attendance” has the meaning given such term in section 472 of the Higher Education Act of 1965 ( 20 U.S.C. 1087 ll ).

institution of higher education applies in that section

The term “institution of higher education” has the meaning given such term in section 101 of the Higher Education Act of 1965.;

the term “State” includes the District of Columbia, the Commonwealth of Puerto Rico, the Virgin Islands, the Commonwealth of the Northern Mariana Islands, American Samoa, and Guam.

defense laboratory applies in that section

The term “defense laboratory” means any laboratory, product center, test center, depot, training and educational organization, or operational command under the jurisdiction of the Department of Defense.;

The term “United States” includes the Commonwealth of Puerto Rico, the Commonwealth of the Northern Mariana Islands, and any other territory or possession of the United States.

regional center for the transfer of manufacturing technology applies throughout its chapter

The term “regional center for the transfer of manufacturing technology” means a manufacturing extension center for the transfer of manufacturing technology and best business practices referred to in section 25(b) of the National Institute of Standards and Technology Act ( 15 U.S.C. 278k ).

Center of Academic Excellence in Cyber Education applies throughout its chapter

The term “Center of Academic Excellence in Cyber Education” means an institution of higher education that is designated by the Director of the National Security Agency as a Center of Academic Excellence in Cyber Education.

The term “cyber” includes the following: (A) Offensive cyber operations. (B) Defensive cyber operations. (C) Department of Defense information network operations and defense. (D) Any other information technology that the Secretary of Defense considers to be related to the cyber activities of the Department of Defense.;

institution of higher education applies throughout its chapter

The term “institution of higher education” has the meaning given the term in section 101 of the Higher Education Act of 1965 ( 20 U.S.C. 1001 ).;

member of the program applies throughout its chapter

The term “member of the program” means a student at an accredited civilian educational institution who is enrolled in the program.

The term “program” means the Defense Civilian Training Corps program established under section 2200g.;

The term “customer” means a requisitioning component or agency. (m) Capital Asset Subaccounts .— Amounts charged for depreciation of capital assets shall be credited to a separate capital asset subaccount established within a working-capital fund. (n) Separate Accounting, Reporting, and Auditing of Funds and Activities .— The Secretary of Defense, with respect to the working-capital funds of each Defense Agency, and the Secretary of each military department, with respect to the working-capital funds of the military department, shall provide for separate accounting, reporting, and auditing of funds and activities managed through the working-capital funds.

(R) Large vertical array. (S) Atmosphere control equipment. (T) Diesel systems and components. (U) Hydraulic valves and components. (V) Bearings.

The term “commercially available off-the-shelf item”— (A) means any item of supply (including construction material) that is— (i) a commercial item, as defined by section 2.101 of title 48, Code of Federal Regulations (as in effect on the date of the enactment of the National Defense Authorization Act for Fiscal Year 2024); and (ii) sold in substantial quantities in the commercial marketplace; and (B) does not include bulk cargo, as defined in section 40102(4) of title 46 , such as agricultural products and petroleum products.

The term “priority defense business system” means a defense business system that is— (A) expected to have a total amount of budget authority over the period of the current future-years defense program submitted to Congress under section 221 of this title in excess of $250,000,000; or (B) designated by the Chief Information Officer of the Department of Defense as a priority defense business system, based on specific program analyses of factors including complexity, scope, and technical risk, and after notification to Congress of such designation. (4) The term “budget”, with respect to a fiscal year, means the budget for that fiscal year that is submitted to Congress by the President under section 1105(a) of title 31 . (5) The term “defense budget materials”, with respect to a fiscal year, means the materials submitted to Congress by the Secretary of Defense in support of the budget for that fiscal year.;

The term “military equipment” includes all weapon systems, weapon platforms, vehicles, and munitions of the Department of Defense, and the components of such items.;
