16 U.S.C. § 441e — Effective date of sections 441 to 441d

This section is the trigger that turns on sections 441 through 441d — the sections that establish Badlands National Park and set its rules. Those sections only become effective once every condition required by them has been fully satisfied, to the President's own satisfaction. Once that happens, the President must issue a proclamation. That proclamation must declare that the conditions required beforehand have been complied with. The same proclamation also formally dedicates and sets aside the area described in section 441 as the park — meaning the President's proclamation is the official act that actually creates the park, once all the earlier conditions (like South Dakota building the required highway, and land being acquired) have been met.
