“water resources development project” applies in that section
the term “water resources development project” means a project under the administrative jurisdiction of the Corps of Engineers that is subject to part 327 of title 36, Code of Federal Regulations (or successor regulations). (b) No consideration for easements The Secretary may not collect consideration for an easement across water resources development project land for the electric, telephone, or broadband service facilities of nonprofit organizations eligible for financing under the Rural Electrification Act of 1936 ( 7 U.S.C. 901 et seq.).
“managed aquifer recharge” applies in that section
The term “managed aquifer recharge” means the intentional banking and treatment of water in aquifers for storage and future use. (2) Managed aquifer recharge project
“managed aquifer recharge project” applies in that section
The term “managed aquifer recharge project” means a project to incorporate managed aquifer recharge features into a water resources development project.
“potentially infectious medical waste” applies throughout its chapter
The term “potentially infectious medical waste” includes isolation wastes; infectious agents; human blood and blood products; pathological wastes; sharps; body parts; contaminated bedding; surgical wastes; and other disposable medical equipment and material that may pose a risk to the public health, welfare or the marine environment. (2) Public vessel
“public vessel” applies throughout its chapter
The term “public vessel” means a vessel of any type whatsoever (including hydrofoils, air-cushion vehicles, submersibles, floating craft whether propelled or not, and fixed or floating platforms) that is owned, or demise chartered, and operated by the United States Government, and is not engaged in commercial service.
“Outer Continental Shelf facility” applies in that section
the term “Outer Continental Shelf facility” means an offshore facility which is located, in whole or in part, on the Outer Continental Shelf and is or was used for one or more of the following purposes: exploring for, drilling for, producing, storing, handling, transferring, processing, or transporting oil produced from the Outer Continental Shelf; (26) “owner or operator”— (A) means— (i) in the case of a vessel, any person owning, operating, or chartering by demise, the vessel; (ii) in the case of an onshore facility, offshore facility, or foreign offshore unit or other facility located seaward of the exclusive economic zone, any person or entity owning or operating such facility; (iii) in …
“contractual relationship” applies in that section
the term “contractual relationship” includes, but is not limited to, land contracts, deeds, easements, leases, or other instruments transferring title or possession, unless— (A) the real property on which the facility concerned is located was acquired by the responsible party after the placement of the oil on, in, or at the real property on which the facility concerned is located; (B) one or more of the circumstances described in subparagraph (A), (B), or (C) of paragraph (2) is established by the responsible party by a preponderance of the evidence; and (C) the responsible party complies with paragraph (3).
“foreign claimant” applies in that section
the term “foreign claimant” means— (1) a person residing in a foreign country; (2) the government of a foreign country; and (3) an agency or political subdivision of a foreign country.
“Prince William Sound and its adjacent waters” applies in that section
the term “Prince William Sound and its adjacent waters” means such sound and waters as generally depicted on the map entitled “EXXON VALDEZ oil spill dated March 1990”.
“Prince William Sound” applies in that section
the term “Prince William Sound” means all State and Federal waters within Prince William Sound, Alaska, including the approach to Hinchenbrook Entrance out to and encompassing Seal Rocks; and;
“worst case discharge” applies in that section
the term “worst case discharge” means— (A) in the case of a vessel, a discharge in adverse weather conditions of its entire cargo; and (B) in the case of a facility, the largest foreseeable discharge in adverse weather conditions.
“Chair” applies in that section
the term “Chair” means the Chairperson of the Interagency Committee designated under subsection (c)(2);
“Commandant” applies in that section
the term “Commandant” means the Commandant of the Coast Guard;
“institution of higher education” applies in that section
the term “institution of higher education” means an institution of higher education, as defined in section 1001(a) of title 20 ;
“Interagency Committee” applies in that section

The term “Council” means the Estuary Habitat Restoration Council established by section 2904 of this title . (2) Estuary
“estuary” applies throughout its chapter
The term “estuary” means a part of a river or stream or other body of water that has an unimpaired connection with the open sea and where the sea water is measurably diluted with fresh water derived from land drainage. The term also includes near coastal waters and wetlands of the Great Lakes that are similar in form and function to estuaries, including the area located in the Great Lakes biogeographic region and designated as a National Estuarine Research Reserve under the Coastal Zone Management Act of 1972 ( 16 U.S.C. 1451 et seq.) as of November 7, 2000 . (3) Estuary habitat
“estuary habitat” applies throughout its chapter
The term “estuary habitat” means the physical, biological, and chemical elements associated with an estuary, including the complex of physical and hydrologic features and living organisms within the estuary and associated ecosystems. (4) Estuary habitat restoration activity (A) In general
“estuary habitat restoration activity” applies throughout its chapter
The term “estuary habitat restoration activity” means an activity that results in improving degraded estuaries or estuary habitat or creating estuary habitat (including both physical and functional restoration), with the goal of attaining a self-sustaining system integrated into the surrounding landscape. (B) Included activities
“estuary habitat restoration plan” applies throughout its chapter
The term “estuary habitat restoration plan” means any Federal, State, or regional plan for restoration of degraded estuary habitat that was developed with the substantial participation of appropriate public and private stakeholders. (B) Included plans and programs
“estuary habitat restoration project” applies throughout its chapter
The term “estuary habitat restoration project” means a project to carry out an estuary habitat restoration activity. (6) Estuary habitat restoration plan (A) In general
“Indian tribe” applies throughout its chapter
The term “Indian tribe” has the meaning given such term by section 5304 of title 25 . (8) Non-Federal interest
“non-Federal interest” applies throughout its chapter
The term “non-Federal interest” means a State, a political subdivision of a State, an Indian tribe, a regional or interstate agency, or, as provided in section 2903(f)(2) of this title , a nongovernmental organization. (9) Secretary
“Secretary” applies throughout its chapter
The term “Secretary” means the Secretary of the Army. (10) State
“State” applies throughout its chapter
The term “State” means the States of Alabama, Alaska, California, Connecticut, Delaware, Florida, Georgia, Hawaii, Illinois, Indiana, Louisiana, Maine, Maryland, Massachusetts, Michigan, Minnesota, Mississippi, New Hampshire, New Jersey, New York, North Carolina, Ohio, Oregon, Pennsylvania, Rhode Island, South Carolina, Texas, Virginia, Washington, and Wisconsin, the District of Columbia, the Commonwealth of Puerto Rico, the Commonwealth of the Northern Mariana Islands, the United States Virgin Islands, American Samoa, and Guam.
“small project” applies in that section
the term “small project” means a project carried out under this chapter with an estimated Federal cost of less than $1,000,000. (B) Delegation of project implementation In carrying out this section, the Secretary, on recommendation of the Council, may delegate implementation of a small project to— (i) the Secretary of the Interior (acting through the Director of the United States Fish and Wildlife Service); (ii) the Under Secretary for Oceans and Atmosphere of the Department of Commerce; (iii) the Administrator of the Environmental Protection Agency; or (iv) the Secretary of Agriculture.
“Under Secretary” applies in that section
the term “Under Secretary” means the Under Secretary for Oceans and Atmosphere of the Department of Commerce. (b) Database of restoration project information The Under Secretary, in consultation with the Council, shall develop and maintain an appropriate database of information concerning estuary habitat restoration projects carried out under this chapter, including information on project techniques, project completion, monitoring data, and other relevant information. (c) Monitoring data standards The Under Secretary, in consultation with the Council, shall develop standard data formats for monitoring projects, along with requirements for types of data collected and frequency of monitoring.

The term “officer candidate” means an individual who is enrolled in the basic officer training program of the Administration and is under consideration for appointment as an officer under section 3021(a)(2)(A) of this title . (5) Flag officer

“Administrator” applies in that section
The term “Administrator” means the Under Secretary of Commerce for Oceans and Atmosphere and the Administrator of the National Oceanic and Atmospheric Administration. (2) Cooperative Aviation Center
“Cooperative Aviation Center” applies in that section
The term “Cooperative Aviation Center” means a Cooperative Aviation Center designated under subsection (b)(1). (b) Cooperative Aviation Centers (1) Designation required The Administrator shall designate one or more Cooperative Aviation Centers for the commissioned officer corps of the Administration at institutions described in paragraph (3). (2) Purpose The purpose of Cooperative Aviation Centers is to facilitate the development and recruitment of aviators for the commissioned officer corps of the Administration.
“military service academies of the United States” applies in that section
The term “military service academies of the United States” means the following: (i) The United States Military Academy, West Point, New York. (ii) The United States Naval Academy, Annapolis, Maryland. (iii) The United States Air Force Academy, Colorado Springs, Colorado. (iv) The United States Coast Guard Academy, New London, Connecticut. (v) The United States Merchant Marine Academy, Kings Point, New York. (B) State maritime academy
“State maritime academy” applies in that section
The term “State maritime academy” has the meaning given the term in section 51102 of title 46 . (b) Reappointment (1) In general Except as provided in paragraph (2), an individual who previously served in the commissioned officer corps of the Administration may be appointed by the Secretary to the grade the individual held prior to separation. (2) Reappointments to higher grades An appointment under paragraph (1) to a position of importance and responsibility designated under section 3028 of this title may only be made by the President.

The term “canal structure” means an embankment, wall, or structure along a canal or manmade watercourse that— (i) constrains water flows; (ii) is subject to frequent water loading; and (iii) is an integral part of a flood risk reduction system that protects the leveed area from flood waters associated with hurricanes, precipitation events, seasonal high water, and other weather-related events. (B) Exclusion The term “canal structure” does not include a barrier across a watercourse. (3) Committee
“committee” applies throughout its chapter
The term “committee” means the Committee on Levee Safety established by section 3302(a) of this title . (4) Floodplain management
“floodplain management” applies throughout its chapter
The term “floodplain management” means the operation of a community program of corrective and preventative measures for reducing flood damage. (5) Indian tribe
“Indian tribe” applies throughout its chapter
The term “Indian tribe” has the meaning given the term in section 5304 of title 25 . (6) Inspection
“inspection” applies throughout its chapter
The term “inspection” means an actual inspection of a levee— (A) to establish the global information system location of the levee; (B) to determine the general condition of the levee; and (C) to estimate the number of structures and population at risk and protected by the levee that would be adversely impacted if the levee fails or water levels exceed the height of the levee. (7) Levee (A) In general
“levee” applies throughout its chapter
The term “levee” means a manmade barrier (such as an embankment, floodwall, or other structure)— (i) the primary purpose of which is to provide hurricane, storm, or flood protection relating to seasonal high water, storm surges, precipitation, or other weather events; and (ii) that is normally subject to water loading for only a few days or weeks during a calendar year. (B) Inclusions
“levee feature” applies throughout its chapter
The term “levee feature” means a structure that is critical to the functioning of a levee, including— (A) an embankment section; (B) a floodwall section; (C) a closure structure; (D) a pumping station; (E) an interior drainage work; and (F) a flood damage reduction channel. (9) Levee system
“levee system” applies throughout its chapter
The term “levee system” means 1 or more levee segments, including all levee features that are interconnected and necessary to ensure protection of the associated leveed areas— (A) that collectively provide flood damage reduction to a defined area; and (B) the failure of 1 of which may result in the failure of the entire system. (10) National levee database
“national levee database” applies throughout its chapter
The term “national levee database” means the levee database established under section 3303 of this title . (11) Participating program
“participating program” applies throughout its chapter
The term “participating program” means a levee safety program developed by a State, regional district, or Indian tribe that includes the minimum components necessary for recognition by the Secretary. (12) Regional district
“regional district” applies throughout its chapter
The term “regional district” means a subdivision of a State government, or a subdivision of multiple State governments, that is authorized to acquire, construct, operate, and maintain projects for the purpose of flood damage reduction. (13) Rehabilitation (A) In general
“rehabilitation” applies throughout its chapter
The term “rehabilitation” means the repair, replacement, reconstruction, removal of a levee, or reconfiguration of a levee system, including a setback levee, that is carried out to reduce flood risk, increase resiliency to extreme weather events, or meet national levee safety guidelines. (B) Inclusions
“risk” applies throughout its chapter
The term “risk” means a measure of the probability and severity of undesirable consequences. (15) State
“State” applies throughout its chapter
The term “State” means— (A) a State; (B) the District of Columbia; (C) the Commonwealth of Puerto Rico; and (D) any other territory or possession of the United States. (16) State levee safety agency
“State levee safety agency” applies throughout its chapter
The term “State levee safety agency” means the agency of a State that has regulatory authority over the safety of any non-Federal levee in the State. (17) United States The term “United States”, when used in a geographical sense, means all of the States.
“levee system” applies in that section
the term “levee system” has the meaning given that term in section 3301(9) of this title . (h) Authorization of appropriations There is authorized to be appropriated to carry out this section $10,000,000, to remain available until expended.
“exclusive economic zone” applies in that section
the term “exclusive economic zone” means the zone established by Presidential Proclamation Number 5030, dated March 10, 1983 ( 16 U.S.C. 1453 note).
“appropriate committees of Congress” applies in that section
the term “appropriate committees of Congress” means— (1) the Committee on Commerce, Science, and Transportation and the Committee on Armed Services of the Senate; and (2) the Committee on Natural Resources, the Committee on Science, Space, and Technology, and the Committee on Armed Services of the House of Representatives.

The term “coastal Indian Tribe” means an “Indian Tribe”, as defined in section 5304 of title 25 , the land of which is located in a coastal State.

“exclusive economic zone” applies throughout its chapter
The term “exclusive economic zone” means the exclusive economic zone of the United States established by Presidential Proclamation No. 5030, of March 10, 1983 . (5) Ocean and coastal mapping
“nongovernmental entities” applies throughout its chapter
The term “nongovernmental entities” includes nongovernmental organizations, members of the academic community, and private sector organizations that provide products and services associated with measuring, locating, and preparing maps, charts, surveys, aerial photographs, satellite imagines, 2 or other graphical or digital presentations depicting natural or manmade physical features, phenomena, and legal boundaries of the Earth. (8) Outer Continental Shelf
“ocean and coastal mapping” applies throughout its chapter
The term “ocean and coastal mapping” means the acquisition, processing, management, maintenance, interpretation, certification, and dissemination of physical, biological, geological, chemical, and archaeological characteristics and boundaries of ocean and coastal areas, resources, and sea beds through the use of acoustics, satellites, aerial photogrammetry, light and imaging, direct sampling, and other mapping technologies. (6) Territorial sea
“Outer Continental Shelf” applies throughout its chapter
The term “Outer Continental Shelf” means all submerged lands lying seaward and outside of lands beneath navigable waters (as that term is defined in section 1301 of title 43 ), and of which the subsoil and seabed appertain to the United States and are subject to its jurisdiction and control. (9) Coastal Indian Tribe
“territorial sea” applies throughout its chapter
The term “territorial sea” means the belt of sea measured from the baseline of the United States determined in accordance with international law, as set forth in Presidential Proclamation Number 5928, dated December 27, 1988 . (7) Nongovernmental entities
“Working Group” applies throughout its chapter
The term “Working Group” means the Interagency Working Group on Ocean and Coastal Mapping under section 3502 of this title . (4) Exclusive economic zone
“Administrator” applies throughout its chapter
The term “Administrator” means the Under Secretary of Commerce for Oceans and Atmosphere in the Under Secretary’s capacity as Administrator of the National Oceanic and Atmospheric Administration. (2) Council
“Council” applies throughout its chapter
The term “Council” means the National Ocean Research Leadership Council established by section 8932 of title 10 . 1 (3) Federal assets
“Federal assets” applies throughout its chapter
The term “Federal assets” means all relevant non-classified civilian coastal and ocean observations, technologies, and related modeling, research, data management, basic and applied technology research and development, and public education and outreach programs, that are managed by member agencies of the Council. (4) Interagency Ocean Observation Committee
“Interagency Ocean Observation Committee” applies throughout its chapter
The term “Interagency Ocean Observation Committee” means the committee established under section 3603(c)(2) of this title . (5) Non-Federal assets
“non-Federal assets” applies throughout its chapter
The term “non-Federal assets” means all relevant coastal and ocean observation technologies, related basic and applied technology research and development, and public education and outreach programs that are managed through States, regional organizations, universities, nongovernmental organizations, or the private sector and integrated into the System by a regional coastal observing system, the National Oceanic and Atmospheric Administration, or the agencies participating in the Interagency Ocean Observation Committee. (6) Regional coastal observing system
“regional coastal observing system” applies throughout its chapter
The term “regional coastal observing system” means an organizational body that is certified or established by contract or memorandum by the lead Federal agency designated in section 3603(c)(3) of this title and coordinates State, Federal, local, tribal, and private interests at a regional level with the responsibility of engaging the private and public sectors in designing, operating, and improving regional coastal observing systems in order to ensure the provision of data and information that meet the needs of user groups from the respective regions. (7) Secretary
“Secretary” applies throughout its chapter
The term “Secretary” means the Secretary of Commerce, acting through the Administrator. (8) System
“System” applies throughout its chapter
The term “System” means the National Integrated Coastal and Ocean Observation System established under section 3603 of this title . (9) System Plan
“System Plan” applies throughout its chapter
The term “System Plan” means the plan contained in the document entitled “Ocean. US Publication No. 9, The First Integrated Ocean Observing System (IOOS) Development Plan”, as updated by the Council under this chapter.
“COASTAL Formula” applies in that section
The term “COASTAL Formula” has the meaning given the term in section 4057(a) of title 42 . (2) Coastal State
“coastal State” applies in that section
The term “coastal State” has the meaning given the term “coastal state” in section 1453 of title 16 , except that the term shall not apply with respect to a State or territory that has an operational wind and flood loss allocation system. (3) Coastal waters
“coastal waters” applies in that section
The term “coastal waters” has the meaning given the term in such section. (4) Covered data
“covered data” applies in that section
The term “covered data” means, with respect to a named storm identified by the Administrator under subsection (b)(2)(A), empirical data that are— (A) collected before, during, or after such storm; and (B) necessary to determine magnitude and timing of wind speeds, rainfall, the barometric pressure, river flows, the extent, height, and timing of storm surge, topographic and bathymetric data, and other measures required to accurately model and assess damage from such storm. (5) Indeterminate loss
“indeterminate loss” applies in that section
The term “indeterminate loss” has the meaning given the term in section 4057(a) of title 42 . (6) Named storm
“named storm” applies in that section
The term “named storm” means any organized weather system with a defined surface circulation and maximum sustained winds of at least 39 miles per hour which the National Hurricane Center of the United States National Weather Service names as a tropical storm or a hurricane. (7) Named Storm Event Model
“Named Storm Event Model” applies in that section
The term “Named Storm Event Model” means the official meteorological and oceanographic computerized model, developed by the Administrator under subsection (b)(1)(A), which utilizes covered data to replicate the magnitude, timing, and spatial variations of winds, rainfall, and storm surges associated with named storms for which post-storm assessments are conducted. (8) Participant
“participant” applies in that section
The term “participant” means a Federal, State, or private entity that chooses to cooperate with the Administrator in carrying out the provisions of this section by collecting, contributing, and maintaining covered data. (9) Post-storm assessment
“post-storm assessment” applies in that section
The term “post-storm assessment” means a scientific assessment produced and certified by the Administrator to determine the magnitude, timing, and spatial variations of winds, rainfall, and storm surges associated with a specific named storm to be used in the COASTAL Formula. (10) State
“State” applies in that section
The term “State” means a State of the United States, the District of Columbia, the Commonwealth of Puerto Rico, and any other territory or possession of the United States. (b) Named Storm Event Model and post-storm assessment (1) Establishment of Named Storm Event Model (A) In general Not later than December 31, 2020 , the Administrator shall develop the Named Storm Event Model. (B) Accuracy The Named Storm Event Model shall be designed to generate post-storm assessments, as provided in paragraph (2), that have a degree of accuracy of not less than 90 percent for an indeterminate loss for which a post-storm assessment is utilized.
“Historically Black Colleges and Universities” applies in that section

The term “coastal acidification” means the decrease in pH and changes in the water chemistry of coastal oceans, estuaries, and Great Lakes from atmospheric pollution, freshwater inputs, and excess nutrient run-off from land. (2) Ocean acidification
“ocean acidification” applies throughout its chapter
The term “ocean acidification” means the decrease in pH and changes in the water chemistry of the Earth’s oceans, coastal estuaries, marine waterways, and Great Lakes caused by carbon dioxide from the atmosphere and the breakdown of organic matter. (3) Secretary
“Secretary” applies throughout its chapter
The term “Secretary” means the Secretary of Commerce, acting through the Administrator of the National Oceanic and Atmospheric Administration. (4) Subcommittee
“State” applies throughout its chapter
The term “State” means each State of the United States, the District of Columbia, the Commonwealth of Puerto Rico, American Samoa, Guam, the Commonwealth of the Northern Mariana Islands, the Virgin Islands of the United States, and any other territory or possession of the United States.

The term “antifouling system” means a coating, paint, surface treatment, surface, or device that is used or intended to be used on a vessel to control or prevent attachment of unwanted organisms. (3) Convention
“Convention” applies throughout its chapter
The term “Convention” means the International Convention on the Control of Harmful Anti-Fouling Systems on Ships, 2001, including its annexes, and including any amendments to the Convention or annexes which have entered into force for the United States. (4) FPSO
“FPSO” applies throughout its chapter
The term “FPSO” means a floating production, storage, or offloading unit. (5) FSU
“FSU” applies throughout its chapter
The term “FSU” means a floating storage unit. (6) Gross tonnage The term “gross tonnage” as defined in chapter 143 of title 46 means the gross tonnage calculated in accordance with the tonnage measurement regulations contained in annex 1 to the International Convention on Tonnage Measurement of Ships, 1969. (7) International voyage
“international voyage” applies throughout its chapter
The term “international voyage” means a voyage by a vessel entitled to fly the flag of one country to or from a port, shipyard, offshore terminal, or other place under the jurisdiction of another country. (8) Organotin
“organotin” applies throughout its chapter
The term “organotin” means any compound or additive of tin bound to an organic ligand, that is used or intended to be used as biocide in an antifouling system. (9) Person
“person” applies throughout its chapter
The term “person” means— (A) any individual, partnership, association, corporation, or organized group of persons whether incorporated or not; (B) any department, agency, or instrumentality of the United States, except as provided in section 3802(b)(2) of this title ; or (C) any other government entity. (10) Secretary
“Secretary” applies throughout its chapter
The term “Secretary” means the Secretary of the department in which the Coast Guard is operating. (11) Sell or distribute
“sell or distribute” applies throughout its chapter
The term “sell or distribute” means to distribute, sell, offer for sale, hold for distribution, hold for sale, hold for shipment, ship, deliver for shipment, release for shipment, import, export, hold for import, hold for export, or receive and (having so received) deliver or offer to deliver. (12) Vessel
“territorial sea” applies throughout its chapter
The term “territorial sea” means the territorial sea as described in Presidential Proclamation No. 5928 on December 27, 1988 . (14) United States
“United States” applies throughout its chapter
The term “United States” means the several States of the United States, the District of Columbia, Puerto Rico, Guam, American Samoa, the Virgin Islands, the Commonwealth of the Northern Marianas, and any other territory or possession over which the United States has jurisdiction. (15) Use
“use” applies throughout its chapter
The term “use” includes application, reapplication, installation, or any other employment of an antifouling system.
“vessel” applies throughout its chapter
The term “vessel” has the meaning given that term in section 3 of title 1 , including hydrofoil boats, air cushion watercraft, submersibles, floating craft, fixed or floating platforms, floating storage units, and floating production, storage, and offloading units. (13) Territorial sea
“Administrator” applies throughout its chapter
The term “Administrator” means the Administrator of the Environmental Protection Agency. (2) Community water system
“community water system” applies throughout its chapter
The term “community water system” has the meaning given the term in section 300f of title 42 . (3) Federal credit instrument
“Federal credit instrument” applies throughout its chapter
The term “Federal credit instrument” means a secured loan or loan guarantee authorized to be made available under this chapter with respect to a project. (4) Investment-grade rating
“investment-grade rating” applies throughout its chapter
The term “investment-grade rating” means a rating of BBB minus, Baa3, bbb minus, BBB (low), or higher assigned by a rating agency to project obligations. (5) Lender (A) In general
“lender” applies throughout its chapter
The term “lender” means any non-Federal qualified institutional buyer (as defined in section 230.144A(a) of title 17, Code of Federal Regulations (or a successor regulation), known as Rule 144A(a) of the Securities and Exchange Commission and issued under the Securities Act of 1933 ( 15 U.S.C. 77a et seq.)). (B) Inclusions
“loan guarantee” applies throughout its chapter
The term “loan guarantee” means any guarantee or other pledge by the Secretary or the Administrator to pay all or part of the principal of, and interest on, a loan or other debt obligation issued by an obligor and funded by a lender. (7) Obligor

The term “obligor” means an eligible entity that is primarily liable for payment of the principal of, or interest on, a Federal credit instrument. (8) Project obligation (A) In general

The term “project obligation” means any note, bond, debenture, or other debt obligation issued by an obligor in connection with the financing of a project. (B) Exclusion The term “project obligation” does not include a Federal credit instrument. (9) Rating agency

The term “rating agency” means a credit rating agency registered with the Securities and Exchange Commission as a nationally recognized statistical rating organization (as defined in section 78c(a) of title 15 ). (10) Secured loan
“secured loan” applies throughout its chapter
The term “secured loan” means a direct loan or other debt obligation issued by an obligor and funded by the Secretary or Administrator, as applicable, in connection with the financing of a project under section 3908 of this title . (11) State
“State” applies throughout its chapter
The term “State” means— (A) a State; (B) the District of Columbia; (C) the Commonwealth of Puerto Rico; and (D) any other territory or possession of the United States. (12) State infrastructure financing authority
“State infrastructure financing authority” applies throughout its chapter
The term “State infrastructure financing authority” means the State entity established or designated by the Governor of a State to receive a capitalization grant provided by, or otherwise carry out the requirements of, title VI of the Federal Water Pollution Control Act ( 33 U.S.C. 1381 et. 1 seq.) or section 300j–12 of title 42 . (13) Subsidy amount
“subsidy amount” applies throughout its chapter
The term “subsidy amount” means the amount of budget authority sufficient to cover the estimated long-term cost to the Federal Government of a Federal credit instrument, as calculated on a net present value basis, excluding administrative costs and any incidental effects on governmental receipts or outlays in accordance with the Federal Credit Reform Act of 1990 ( 2 U.S.C. 661 et seq.). (14) Substantial completion The term “substantial completion”, with respect to a project, means the earliest date on which a project is considered to perform the functions for which the project is designed. (15) Treatment works
“treatment works” applies throughout its chapter
The term “treatment works” has the meaning given the term in section 212 of the Federal Water Pollution Control Act ( 33 U.S.C. 1292 ).
“iron and steel products” applies in that section
the term “iron and steel products” means the following products made primarily of iron or steel: lined or unlined pipes and fittings, manhole covers and other municipal castings, hydrants, tanks, flanges, pipe clamps and restraints, valves, structural steel, reinforced precast concrete, and construction materials.
“rural community” applies in that section
the term “rural community” means a city, town, or unincorporated area that has a population of not more than 10,000 inhabitants. (b) Outreach required Not later than 180 days after November 15, 2021 , the Administrator, in consultation with relevant Federal agencies, shall develop and begin implementation of an outreach plan to promote financial assistance available under this subtitle to small communities and rural communities.
“South Florida” applies in that section

(4) Hypoxia
“hypoxia” applies throughout its chapter
The term “hypoxia” means a condition where low dissolved oxygen in aquatic systems causes stress or death to resident organisms. (5) Program
“Program” applies throughout its chapter
The term “Program” means the national harmful algal bloom and hypoxia program established under section 4002 of this title . (6) State
“State” applies throughout its chapter
The term “State” means each of the several States of the United States, the District of Columbia, the Commonwealth of Puerto Rico, the Virgin Islands, Guam, American Samoa, the Commonwealth of the Northern Mariana Islands, any other territory or possession of the United States, and any Indian tribe. “Task Force” applies throughout its chapter
The term “Task Force” means the Inter-Agency Task Force on Harmful Algal Blooms and Hypoxia under section 4001(a) of this title . (8) Under Secretary

The term “Under Secretary” means the Under Secretary of Commerce for Oceans and Atmosphere. (9) United States coastal waters
“United States coastal waters” applies throughout its chapter
The term “United States coastal waters” includes the Great Lakes.
“appropriate Federal official” applies in that section
The term “appropriate Federal official” means— (i) in the case of a marine or coastal hypoxia or harmful algal bloom event, the Under Secretary of Commerce for Oceans and Atmosphere; and (ii) in the case of a freshwater hypoxia or harmful algal bloom event, the Administrator of the Environmental Protection Agency. (B) Event of national significance
“event of national significance” applies in that section
The term “event of national significance” means a hypoxia or harmful algal bloom event that has had or will likely have a significant detrimental environmental, economic, subsistence use, or public health impact on an affected State. (C) Hypoxia or harmful algal bloom event
“hypoxia or harmful algal bloom event” applies in that section
The term “hypoxia or harmful algal bloom event” means the occurrence of hypoxia or a harmful algal bloom as a result of a natural, anthropogenic, or undetermined cause.

The term “Administration” means the National Oceanic and Atmospheric Administration. (2) Administrator
