42 U.S.C. § 12681 — Authorization of appropriations

(a) Subchapter I: (1) Division B: (A) In general -- Congress may appropriate money to fund division B of subchapter I: (i) $97,000,000 for fiscal year 2010, and (ii) whatever amount is needed for each of fiscal years 2011 through 2014. (B) Part IV reservation -- Each year, the Corporation may set aside part of that money -- as much as it needs -- to fund "part IV" of division B. (C) Section 12561a -- After that part IV set-aside, the Corporation can use no more than $7,000,000 per year for "Campuses of Service" awards under section 12561a. (D) Section 12563(c)(8) -- After the part IV set-aside, the Corporation can also use no more than $10,000,000 per year for summer-of-service program grants under section 12563(c)(8), plus no more than another $10,000,000 per year, deposited into the National Service Trust, for summer-of-service education awards. (E) Section 12563(c)(9) -- After the part IV set-aside, the Corporation can use no more than $20,000,000 per year for youth engagement zone programs under section 12563(c)(9). (F) General programs -- Whatever money is left after (A) through (E) is split three ways each year: (i) no more than 60 percent goes to part I of division B; (ii) no more than 25 percent goes to part II; and (iii) at least 15 percent goes to part III. (2) Divisions C and D: For each of fiscal years 2010 through 2014, Congress may appropriate whatever money is needed to fund division C, and to pay national service education awards under division D, for the number of participants set out in section 12571(f)(1) for that year. (3) Division E: (A) In general -- Congress may appropriate whatever money is needed, for each of fiscal years 2010 through 2014, to run the National Civilian Community Corps and fund division E. (B) Priority -- No matter what other law says, when the Corporation spends this money, it must give priority to programs working in areas where the President has declared a major disaster -- including major disasters from Hurricane Katrina or Rita. (4) Division H: (A) Authorization -- Congress may appropriate whatever money is needed, for each of fiscal years 2010 through 2014, to fund division H. (B) Section 12653b -- Of that money, each year, the Corporation must set aside whatever is needed to fund section 12653b and to pay national service education awards to the added or expanded participants described in section 12653b(b)(3) for that year. (C) Section 12653c -- Of that money, $12,000,000 each year must go to fund section 12653c. (D) Section 12653h -- Of that money, each year, the Corporation must set aside whatever is needed to fund section 12653h. (E) Section 12653k -- Of that money, these fixed amounts must go to section 12653k: (i) $50,000,000 for fiscal year 2010; (ii) $60,000,000 for fiscal year 2011; (iii) $70,000,000 for fiscal year 2012; (iv) $80,000,000 for fiscal year 2013; and (v) $100,000,000 for fiscal year 2014. (F) Section 12653p -- The exact same amounts, on the exact same schedule -- $50 million, $60 million, $70 million, $80 million, then $100 million from 2010 through 2014 -- must go to section 12653p. (5) Administration: (A) In general -- Congress may appropriate whatever money is needed, for each of fiscal years 2010 through 2014, to run this chapter's programs, including financial assistance under section 12576(a). (B) Corporation -- Of that money, each year, part must go toward the assistance described in section 12576(a). (6) Evaluation, training, and technical assistance: No matter what paragraphs (1), (2), and (4), or any other law, say, the Corporation must set aside no more than 2.5 percent of the money appropriated each year under divisions B, C, and H of subchapter I, and under titles I and II of the Domestic Volunteer Service Act of 1973. This set-aside funds sections 12523(e) and 12639a, and division K of subchapter I -- and $1,000,000 of it must go specifically to section 12639a. Money set aside this way can only be used in the fiscal year it was set aside for. (b) Availability of appropriations: Once Congress appropriates money under this section, that money stays available to spend until it is completely used up -- it doesn't expire at the end of the fiscal year.
