42 U.S.C. § 18841 — Survey, analysis, and report on employment and demographics in the energy, energy efficiency, and motor vehicle sectors of the United States

(a) Energy Jobs Council. (1) The Secretary must set up a council called the "Energy Jobs Council." (2) Its members are appointed as follows: (A) the Secretary appoints one or more people from the Energy Information Administration and from a state energy office serving on the State Energy Advisory Board; (B) the Secretary of Commerce appoints people from the Department of Commerce and the Bureau of the Census; (C) the Secretary of Labor appoints people from the Bureau of Labor Statistics; and (D) any other needed federal agency appoints its own representatives, as the Secretary decides is necessary. (b) Survey and analysis. (1) The Council must (A) survey employers in the energy, energy efficiency, and motor vehicle sectors, and (B) analyze employment figures and demographics in those sectors, including how many workers spend a lot of time on regulatory compliance. (2) The Council must use a survey method that: (A) was approved by the Office of Management and Budget in 2016 (Control Number 1910–5179); (B) uses a representative, stratified sample of U.S. businesses; and (C) aims to get a similar number of responses across states and industry codes as the 2016 and 2017 "U.S. Energy and Employment Report" got. (3) The Council must consult key stakeholders, including: (A) relevant federal agency heads, such as the Secretaries of Commerce and Transportation, the Census Bureau Director, the Bureau of Labor Statistics Commissioner, and the EPA Administrator; (B) States; (C) the State Energy Advisory Board; and (D) energy industry trade groups. (c) Report. (1) Within 1 year after November 15, 2021, and every year after that, the Secretary must (A) publish on the Department's website a report called the "U.S. Energy and Employment Report," covering employment and demographics in these sectors and how many hours workers spend on compliance, and (B) make the Council's underlying data public too, following the confidentiality rules in title 44. (2) The report must cover: (A) figures for (i) the energy sector — split into electric power generation/fuels and transmission/storage/distribution — (ii) the energy efficiency sector, and (iii) the motor vehicle sector; and (B) for each sector, data broken down by (i) technology, subtechnology, and fuel type, and (ii), subject to confidentiality rules, by state, territory, the District of Columbia, and county.
