After notice and a hearing opportunity, the Secretary must issue a plan if the hearing evidence supports a finding that the plan and all its terms and conditions would carry out this chapter’s policy.
After giving notice and an opportunity for a hearing, the Secretary* must issue a plan if the evidence presented at the hearing leads the Secretary to find, and the plan states, that issuing the plan and all its terms and conditions would carry out this chapter’s stated policy.
After notice and opportunity for hearing, the Secretary* shall issue a plan if he finds, and sets forth in such plan, upon the evidence introduced at such hearing, that the issuance of such plan and all the terms and conditions thereof will tend to effectuate the declared policy of this chapter.
