port engineer concerned applies in that section

The term “port engineer concerned” means, with respect to a naval vessel, the technical expert on the condition of such vessel responsible for advising on repairs and related standards for such vessel.;

project manager concerned applies in that section

The term “project manager concerned” means, with respect to a naval vessel undergoing maintenance or repair, the individual responsible for overseeing the overhaul period with respect to such maintenance or repair.;

regional maintenance center applies in that section

The term “regional maintenance center”— (A) means an organization of the Navy that supports ship maintenance in a designated geographic region; and (B) includes the Mid-Atlantic Regional Maintenance Center in Nofolk, Virginia, the Southwest Regional Maintenance Center in San Diego, California, the Southeast Regional Maintenance Center in Mayport, Florida, and the Hawaii Regional Maintenance Center in Pearl Harbor, Hawaii.;

type commander applies in that section

The term “type commander” means the flag officer in command of a naval surface force, such as the following: (A) Commander, Naval Surface Force, Atlantic. (B) Commander, Naval Surface Force, Pacific Fleet.

the term “salvage facilities” includes equipment and gear utilized to prevent, abate, or minimize damage to the environment.

salvage services applies in that section

the term “salvage services” includes services performed in connection with a marine salvage operation that are intended to prevent, abate, or minimize damage to the environment.

maximum efficient rate applies throughout its chapter

The term “maximum efficient rate” means the maximum sustainable daily oil or gas rate from a reservoir which will permit economic development and depletion of that reservoir without detriment to the ultimate recovery.

national defense applies throughout its chapter

The term “national defense” includes the needs of, and the planning and preparedness to meet, essential defense, industrial, and military emergency energy requirements relative to the national safety, welfare, and economy, particularly resulting from foreign military or economic actions.;

naval petroleum reserves applies throughout its chapter

The term “petroleum” includes crude oil, gases (including natural gas), natural gasoline, and other related hydrocarbons, oil shale, and the products of any of such resources.;

Secretary applies throughout its chapter

The term “Secretary” means the Secretary of Energy.;

small refiner applies throughout its chapter

The term “small refiner” means an owner of a refinery or refineries (including refineries not in operation) who qualifies as a small business refiner under the rules and regulations of the Small Business Administration.;

antitrust laws applies in that section

the term “antitrust laws” means— (1) the Sherman Act ( 15 U.S.C. 1 et seq.); (2) the Clayton Act ( 15 U.S.C. 12 et seq.); (3) the Federal Trade Commission Act ( 15 U.S.C. 41 et seq.); (4) sections 73 and 74 of the Wilson Tariff Act ( 15 U.S.C. 8 and 9); and (5) sections 2, 3, and 4 of the Act of June 19, 1936 (commonly referred to as the “Robinson-Patman Act”) ( 15 U.S.C. 13a , 13b, and 21a).

The term “adversarial capital flow” means an investment by— (A) the government of a country that is an adversary of the United States; or (B) an entity organized under the laws of, or otherwise subject to the jurisdiction of, such a country.;

The term “air refueling tanker aircraft” means an aircraft that has as its primary mission the refueling of other aircraft.;

(m) (1) During the period beginning on the date of the enactment of the National Defense Authorization Act for Fiscal Year 2024 and ending on September 30, 2030 , the Secretary of the Air Force may not— (A) retire an RQ–4 aircraft; (B) reduce funding for unit personnel or weapon system sustainment activities for RQ–4 aircraft in a manner that presumes future congressional authority to divest such aircraft; (C) keep an RQ–4 aircraft in a status considered excess to the requirements of the possessing command and …

fighter aircraft applies in that section

The term “fighter aircraft” means an aircraft that— (i) is designated by a mission design series prefix of F– or A–; (ii) is manned by one or two crewmembers; and (iii) executes single-role or multi-role missions, including air-to-air combat, air-to-ground attack, air interdiction, suppression or destruction of enemy air defenses, close air support, strike control and reconnaissance, combat search and rescue support, or airborne forward air control.;

The term “tranche 1 capabilities” means capabilities relating to transport, battle management, tracking, custody, navigation, deterrence, and support, that are intended to be achieved by September 30, 2024 .

the term “enlistment” means original enlistment or reenlistment.

eligible individual applies in that section

the term “eligible individual” means an individual— (1) whom the Secretary of the Air Force determines served in support of space operations as a member of the Air Force; and (2) who separates (or previously separated) from the armed forces as a member of the Air Force.

KDSM eligibility period applies in that section

the term “KDSM eligibility period” means the period beginning on July 28, 1954 , and ending on such date after the date of the enactment of this section as may be determined by the Secretary of Defense to be appropriate for terminating eligibility for the Korea Defense Service Medal. (c) The Secretary of the Air Force shall prescribe service requirements for eligibility for the Korea Defense Service Medal. Those requirements shall not be more stringent than the service requirements for award of the Armed Forces Expeditionary Medal for instances in which the award of that medal is authorized.

covered private sector employee applies in that section

the term “covered private sector employee” means— (A) an individual employed by a private firm that is engaged in providing to the Department of Defense significant and substantial defense-related systems, products, or services; or (B) an individual employed by a private firm in one of the critical infrastructure sectors identified in Presidential Policy Directive 21 (Critical Infrastructure Security and Resilience). (2) A covered private sector employee admitted for instruction at the United States Air Force Institute of Technology remains eligible for such instruction only so long as the person remains employed by the same firm.

basic training applies in that section

the term “basic training” means the initial entry training program of the Air Force or the Space Force that constitutes the basic training of new recruits.

cadet strength limit applies in that section

the term “cadet strength limit” means the authorized maximum strength of cadets of the Academy.

The term “major project” means a project for the purchase or other procurement of real or personal property, or for the construction, renovation, or repair of real or personal property, the total cost of which is, or is estimated to be, at least $1,000,000.

major United States commercial bank applies in that section

The term “major United States commercial bank” means a commercial bank that— (A) is an insured bank (as defined in section 3 of the Federal Deposit Insurance Act ( 12 U.S.C. 1813 )); (B) is headquartered in the United States; and (C) has net assets in a total amount considered by the Secretary of the Air Force to qualify the bank as a major bank. (5) Major united states investment management firm .—

major United States investment management firm applies in that section

The term “major United States investment management firm” means any broker, dealer, investment adviser, or provider of investment supervisory services (as defined in section 3 of the Securities Exchange Act of 1934 ( 15 U.S.C. 78c ) or section 202 of the Investment Advisers Act of 1940 ( 15 U.S.C. 80b–2 )) or a major United States commercial bank that— (A) is headquartered in the United States; and (B) holds for the account of others investment assets in a total amount considered by the Secretary of the Air Force to qualify the firm as a major investment management firm.

Academy mixed-funded athletic or recreational extracurricular program applies in that section

the term “Academy mixed-funded athletic or recreational extracurricular program” means an athletic or recreational extracurricular program of the Academy to which each of the following applies: (1) The program is not considered a morale, welfare, or recreation program. (2) The program is supported through appropriated funds. (3) The program is supported by a nonappropriated fund instrumentality. (4) The program is not a private organization and is not operated by a private organization.

support services applies in that section

the term “support services” includes utilities, office furnishings and equipment, communications services, records staging and archiving, audio and video support, and security systems in conjunction with the leasing or licensing of property. Any such support services may only be provided without any liability of the United States to the corporation. (g) Contracts and Cooperative Agreements .— The Secretary of the Air Force may enter into contracts and cooperative agreements with the corporation for the purpose of supporting the athletic programs of the Academy.

The terms “aircraft”, “citizen of the United States”, “civil aircraft”, “person”, and “public aircraft” have the meanings given those terms by section 40102(a) of title 49 .;

The term “Civil Reserve Air Fleet” means those aircraft allocated, or identified for allocation, to the Department of Defense under section 101 of the Defense Production Act of 1950 ( 50 U.S.C. 4511 ), or made available (or agreed to be made available) for use by the Department of Defense under a contract made under this title, as part of the program developed by the Department of Defense through which the Department of Defense augments its airlift capability by use of civil aircraft.;

Civil Reserve Air Fleet program applies throughout its chapter

The term “Civil Reserve Air Fleet program” means the program developed by the Department of Defense through which the Department of Defense augments its airlift capability by use of civil aircraft.

contractor applies throughout its chapter

The term “contractor” means a citizen of the United States (A) who owns or controls, or who will own or control, a new or existing aircraft and who contracts with the Secretary under section 9513 of this title to modify that aircraft by including or incorporating specified defense features in that aircraft and to commit that aircraft to the Civil Reserve Air Fleet, (B) who subsequently obtains ownership or control of a civil aircraft covered by such a contract and assumes all existing obligations under that contract, or (C) who owns or controls, or will own or control, new or existing aircraft and who, by contract, commits some or all of such aircraft to the Civil Reserve Air Fleet.;

defense feature applies throughout its chapter

The term “defense feature” means equipment or design features included or incorporated in a civil aircraft which ensures the compatibility of such aircraft with the Department of Defense airlift system. Such term includes any equipment or design feature which enables such aircraft to be readily modified for use as an aeromedical aircraft or a cargo-convertible, cargo-capable, or passenger-cargo combined aircraft.;

existing aircraft applies throughout its chapter

The term “existing aircraft” means a civil aircraft other than a new aircraft.;

new aircraft applies throughout its chapter

The term “new aircraft” means a civil aircraft that a manufacturer has not begun to assemble before the aircraft is covered by a contract under section 9513 of this title .;

passenger aircraft applies throughout its chapter

The term “passenger aircraft” means a civil aircraft equipped so that its main deck can be used for the carriage of individuals and cannot be used principally, without major modification, for the carriage of property or mail.;

passenger-cargo combined aircraft applies throughout its chapter

The term “passenger-cargo combined aircraft” means a civil aircraft equipped so that its main deck can be used to carry both passengers and property (including mail) simultaneously.;

person applies throughout its chapter

The terms “aircraft”, “citizen of the United States”, “civil aircraft”, “person”, and “public aircraft” have the meanings given those terms by section 40102(a) of title 49 .;

public aircraft applies throughout its chapter

The term “defense-related aviation insurance” means aviation insurance and reinsurance provided through policies issued by the Secretary of Transportation under chapter 443 of title 49 that pursuant to section 44305(b) of that title is provided by that Secretary without premium at the request of the Secretary of Defense and is covered by an indemnity agreement between the Secretary of Transportation and the Secretary of Defense. (2) Loss .—

The term “loss” includes damage to or destruction of property, personal injury or death, and other liabilities and expenses covered by the defense-related aviation insurance.

charter air transportation applies in that section

the term “charter air transportation” has the meaning given such term in section 40102(14) of title 49 .

citizen of the United States applies in that section

The term “citizen of the United States” means— (A) an individual who is a citizen of the United States; (B) a partnership each of whose partners is an individual who is a citizen of the United States; or (C) a corporation or association organized under the laws of the United States or a State, the District of Columbia, or a territory or possession of the United States.;

qualified contractor applies in that section

The term “qualified contractor” means a contractor that is a citizen of the United States.;

Secretary applies in that section

The term “Secretary” means the Secretary of Defense.;

space products or services applies in that section

The term “space products or services” means commercial products and commercial services (as those terms are defined in section 2.101 of the Federal Acquisition Regulation) and noncommercial products and noncommercial services offered by commercial companies that operate to, through, or from space, including any required terrestrial ground, support, and network systems and associated services that can be used to support military functions and missions.

employee of the United States applies in that section

The term “support” includes fuel, fire rescue, use of facilities, improvements necessary to accommodate use by civil air carriers, police, safety, housing, food, air traffic control, suspension of military operations on the island (including operations at the Johnston Atoll Chemical Agent Demilitarization System), repairs, and any other construction, services, or supplies.

settle applies throughout its chapter

the term “settle” means consider, ascertain, adjust, determine, and dispose of a claim, whether by full or partial allowance or by disallowance.

State applies in that section

the term “State” includes the District of Columbia, the Commonwealth of Puerto Rico, the Virgin Islands, and Guam.

Member of Congress applies in that section

the term “Member of Congress” includes a Delegate or Resident Commissioner to Congress and a Member-elect. (c) Under regulations to be prescribed by the Secretary of Defense, and by the Secretary of Homeland Security with respect to the Coast Guard when it is not operating as a service in the Navy, a member of the Ready Reserve who is designated as a member not to be retained in the Ready Reserve as a result of screening under subsection (a) shall, as appropriate, be— (1) transferred to the Standby Reserve; (2) discharged; or (3) if the member is eligible and applies therefor, transferred to the Retired Reserve.

partial mobilization applies in that section

the term “partial mobilization” means the mobilization resulting from action by Congress or the President, under any law, to bring units of any reserve component, and members not assigned to units organized to serve as units, to active duty for a limited expansion of the active armed forces.

the term “covered period” means the fiscal year beginning after the date on which a report is submitted under paragraph (1).

full-time reserve component duty applies in that section

the term “full-time reserve component duty” means the following duty: (1) Active duty described in sections 10211, 10302, 10303, 10304, 10305, 12310, or 12402 of this title. (2) Full-time National Guard duty (other than for training) under section 502(f) of title 32 , except for duty under section 115(b)(1)(B) and (C) of this title and section 115(i)(9) of this title . (3) Active duty described in section 708 of title 32 .

full-time reserve component duty applies in that section

the term “full-time reserve component duty” has the meaning given the term in section 12011(e) of this title .

enlistment applies throughout its chapter

the term “enlistment” means original enlistment or reenlistment.

captive status applies in that section

the term “captive status” means the status of a member of the armed forces who is in a missing status (as defined in section 551(2) of title 37 ) which occurs as the result of a hostile action and is related to the member’s military status. (h) (1) When authorized by the Secretary of Defense, the Secretary of a military department may, with the consent of the member, order a member of a reserve component to active duty— (A) to receive authorized medical care; (B) to be medically evaluated for disability or other purposes; or (C) to complete a required Department of Defense health care study, which may include an associated medical evaluation of the member.

The term “covered incident” means— (A) a cyber incident involving a Department of Defense information system, or a breach of a Department of Defense system that involves personally identifiable information, that the Secretary of Defense determines is likely to result in demonstrable harm to the national security interests, foreign relations, or the economy of the United States, or to the public confidence, civil liberties, or public health and safety of the people of the United States; (B) a cyber incident involving a Department of Homeland Security information system, or a breach of a Department of Homeland Security system that involves personally identifiable information, that the …

The term “Individual Ready Reserve mobilization category” means, in the case of any reserve component, the category of the Individual Ready Reserve described in section 10144(b) of this title .;

The term “weapon of mass destruction” has the meaning given that term in section 1403 of the Defense Against Weapons of Mass Destruction Act of 1996 ( 50 U.S.C. 2302(1) ).

defense budget materials applies in that section

the term “defense budget materials” has the meaning given that term in section 231(f)(2) 1 of this title.

United States applies in that section

the term “United States” includes the Commonwealth of Puerto Rico, Guam, and the Virgin Islands. (d) Training .— A Reserve on active duty as described in subsection (a) may be provided training consistent with training provided to other members on active duty, as the Secretary concerned sees fit.

Board of Actuaries applies throughout its chapter

The term “Board of Actuaries” means the Department of Defense Board of Actuaries under section 183 of this title .;

covered service applies throughout its chapter

The term “covered service” means active duty performed by a member of a reserve component under an order to active duty for a period of more than 30 days which specifies that the member’s service— (A) is in support of an operational mission for which members of the reserve components have been ordered to active duty without their consent; or (B) is in support of forces activated during a period of war declared by Congress or a period of national emergency declared by the President or Congress.;

The term “Fund” means the Reserve Mobilization Income Insurance Fund established by section 12528(a) of this title .

The term “insured member” means a member of the Ready Reserve who is enrolled for coverage under the insurance program in accordance with section 12524 of this title .;

The term “Secretary” means the Secretary of Defense.;

Berlin crisis applies in that section

The term “Berlin crisis” means the period beginning on August 14, 1961 , and ending on May 30, 1963 .;

The term “Korean conflict” means the period beginning on June 27, 1950 , and ending on July 27, 1953 .;

The term “Vietnam era” means the period beginning on August 5, 1964 , and ending on March 27, 1973 . (d) The Secretary concerned shall notify each person who has completed the years of service required for eligibility for retired pay under this chapter. The notice shall be sent, in writing, to the person concerned within one year after the person completes that service. The notice shall include notice of the elections available to such person under the Survivor Benefit Plan established under subchapter II of chapter 73 of this title and the Supplemental Survivor Benefit Plan established under subchapter III of that chapter, and the effects of such elections.

World War I applies in that section

The term “World War I” means the period beginning on April 6, 1917 , and ending on November 11, 1918 .;

The term “World War II” means the period beginning on September 9, 1940 , and ending on December 31, 1946 .;

covered emergency period applies in that section

the term “covered emergency period” means the period beginning on March 1, 2020 , and ending on the day that is 60 days after the date on which the travel or duty restriction applicable to the person concerned is lifted. (G) Points at the rate of 1 per inactive-duty training period, under section 206 of title 37 , during which the member is on parental leave under section 711 of this title .

the term “promotion eligibility period” means, with respect to an officer whose name is on a list of officers approved for promotion under section 14308(a) of this title to a grade for which appointment is required by section 12203(a) of this title to be made by and with the advice and consent of the Senate, the period beginning on the date on which the list is so approved and ending on the first day of the eighteenth month following the month during which the list is so approved.

the term “promotion board” means a selection board convened by the Secretary of a military department under section 14101(a) of this title .

established charge applies in that section

the term “established charge” means the lesser of— (i) the charge for the course or courses determined on the basis of the lowest extended time payment plan offered by the institution and approved by the appropriate State approving agency; or (ii) the actual charge to the person for such course or courses. (C) Such allowance shall be paid quarterly on a pro rata basis for the lessons completed by the person and serviced by the institution.

Secretary concerned applies in that section

the term “Secretary concerned” has the meaning given in section 101(a)(9) in the case of a member of the armed forces.

institution of higher education applies in that section

the term “institution of higher education” has the meaning given that term in section 101 of the Higher Education Act of 1965 ( 20 U.S.C. 1001 ).

armory applies throughout its chapter

The terms “armory” and “readiness center” mean a structure that houses one or more units of a reserve component and is used for training and administering those units. Such terms include a structure that is appurtenant to such a structure and houses equipment used for that training and administration.

facility applies throughout its chapter

The term “facility” includes any (A) interest in land, (B) armory, readiness center, or other structure, and (C) storage or other facility normally needed for the administration and training of any unit of the reserve components of the armed forces.;

readiness center applies throughout its chapter

The terms “armory” and “readiness center” mean a structure that houses one or more units of a reserve component and is used for training and administering those units. Such terms include a structure that is appurtenant to such a structure and houses equipment used for that training and administration.

State applies throughout its chapter

The term “State” means any of the States of the United States, the District of Columbia, the Commonwealth of Puerto Rico, and each territory and possession of the United States and includes political subdivisions and military units thereof and tax-supported agencies therein.;

promotion eligibility period applies in that section

the term “promotion eligibility period” means, with respect to an officer whose name is on a list of officers approved for promotion under section 20238(a) of this title to a grade for which appointment is required by section 20201(a) of this title to be made by and with the advice and consent of the Senate, the period beginning on the date on which the list is so approved and ending on the first day of the eighteenth month following the month during which the list is so approved.
