“employing office” applies in that section
the term “employing office” includes the Government Accountability Office and any entity listed in subsection (a) of section 1331 of this title that is responsible for correcting a violation of this section, irrespective of whether the entity has an employment relationship with any covered employee in any employing office in which such a violation occurs; and;
“claimant” applies in that section
the term “claimant” means an individual who received an award or settlement, or who made an allegation of a violation against an employing office, under part A of subchapter II. (m) Record retention The Office shall establish and maintain a program for the permanent retention of its records, including the records of preliminary reviews, mediations, hearings, and other proceedings conducted under subchapter IV.
“direct Act” applies in that section
The term “direct Act” means an Act (other than this Act), or provision of the Revised Statutes, that is specified in section 1311, 1312, or 1313 of this title. (B) Direct provision
“direct provision” applies in that section
The term “direct provision” means a provision (including a definitional provision) of a direct Act that applies the rights or protections of a direct Act (including rights and protections relating to nonretaliation or noncoercion) to a Library claimant. (C) Library claimant
“Library claimant” applies in that section
The term “Library claimant” means, with respect to a direct provision, an employee of the Library of Congress who is covered by that direct provision. (2) Election after proceedings initially brought under this chapter A Library claimant who initially files a claim for an alleged violation as provided in section 1402 of this title may, at any time before the date that is 10 days after a hearing officer submits the report on the preliminary review of the claim under section 1402a(c) of this title , elect to bring the claim for a proceeding before the corresponding Federal agency under the corresponding direct provision, instead of continuing with the procedures applicable to the claim under …
“Office of House Employment Counsel of the House of Representatives” applies in that section
the term “Office of House Employment Counsel of the House of Representatives” means— (A) the Office of House Employment Counsel established and operating under the authority of the Clerk of the House of Representatives as of November 12, 2001 ; (B) any successor office to the Office of House Employment Counsel which is established after November 12, 2001 ; and (C) any other person authorized and directed in accordance with the Rules of the House of Representatives to provide legal assistance and representation to employing offices of the House of Representatives in connection with actions brought under this subchapter.
“applicable Committee” applies in that section
the term “applicable Committee” means— (i) the Committee on House Administration of the House of Representatives, in the case of an individual who, at the time of the withholding, is a Member of the House; or (ii) the Committee on Rules and Administration of the Senate, in the case of an individual who, at the time of the withholding, is a Senator.
“non-Federal position” applies in that section
The term “non-Federal position” means a position other than the position of an employee, as defined in section 2105(a) of title 5 . (B) Payroll administrator
“payroll administrator” applies in that section
The term “payroll administrator” means— (i) in the case of an individual who is a Member of the House of Representatives, the Chief Administrative Officer of the House of Representatives, or an employee of the Office of the Chief Administrative Officer who is designated by the Chief Administrative Officer to carry out this subsection; or (ii) in the case of an individual who is a Senator, the Secretary of the Senate, or an employee of the Office of the Secretary of the Senate who is designated by the Secretary to carry out this subsection.
“senior staff” applies in that section
the term “senior staff” means any individual who, at the time a violation occurred, was required to file a report under title I of the Ethics in Government Act of 1978 (5 U.S.C. App. 101 et seq.). 1 (e) Final decisions A final decision entered under section 1405(g) or 1406(e) of this title shall be made public if it is in favor of the complaining covered employee, or in favor of the charging party under section 1331 of this title , or if the decision reverses a decision of a hearing officer which had been in favor of the covered employee or charging party. The Board may make public any other decision at its discretion.

the term “employee” means— (1) an employee on the staff of the leadership of the House of Representatives or the leadership of the Senate; (2) an employee on the staff of a committee or subcommittee of— (A) the House of Representatives; (B) the Senate; or (C) a joint committee of the Congress; (3) an employee on the staff of a Member of the House of Representatives or on the staff of a Senator; (4) an officer of the House of Representatives or the Senate or a congressional employee who is elected by the House of Representatives or Senate or is appointed by a Member of the House of Representatives or by a Senator (in addition an employee described in paragraph (1), (2), or (3)); or (5) an …
“Director” applies throughout its chapter
the term “Director” means the Director of the Congressional Budget Office.
“State mandate” applies in that section
the term “State mandate” means any provision in a State statute or regulation that imposes an enforceable duty on local governments, the private sector, or individuals, including a condition of State assistance or a duty arising from participation in a voluntary State program.
“Federal mandate” applies throughout its subchapter
the term “Federal mandate” means any provision in statute or regulation or any Federal court ruling that imposes an enforceable duty upon State, local, or tribal governments including a condition of Federal assistance or a duty arising from participation in a voluntary Federal program.
“agency” applies throughout its chapter
The term “agency” has the meaning given that term in section 551(1) of title 5 . (2) Client
“client” applies throughout its chapter
The term “client” means any person or entity that employs or retains another person for financial or other compensation to conduct lobbying activities on behalf of that person or entity. A person or entity whose employees act as lobbyists on its own behalf is both a client and an employer of such employees. In the case of a coalition or association that employs or retains other persons to conduct lobbying activities, the client is the coalition or association and not its individual members. (3) Covered executive branch official
“covered executive branch official” applies throughout its chapter
The term “covered executive branch official” means— (A) the President; (B) the Vice President; (C) any officer or employee, or any other individual functioning in the capacity of such an officer or employee, in the Executive Office of the President; (D) any officer or employee serving in a position in level I, II, III, IV, or V of the Executive Schedule, as designated by statute or Executive order; (E) any member of the uniformed services whose pay grade is at or above O–7 under section 201 of title 37 ; and (F) any officer or employee serving in a position of a confidential, policy-determining, policy-making, or policy-advocating character described in section 7511(b)(2)(B) of title 5 .
“covered legislative branch official” applies throughout its chapter
The term “covered legislative branch official” means— (A) a Member of Congress; (B) an elected officer of either House of Congress; (C) any employee of, or any other individual functioning in the capacity of an employee of— (i) a Member of Congress; (ii) a committee of either House of Congress; (iii) the leadership staff of the House of Representatives or the leadership staff of the Senate; (iv) a joint committee of Congress; and (v) a working group or caucus organized to provide legislative services or other assistance to Members of Congress; and (D) any other legislative branch employee serving in a position described under section 13101(13) of title 5 . (5) Employee
“employee” applies throughout its chapter
The term “employee” means any individual who is an officer, employee, partner, director, or proprietor of a person or entity, but does not include— (A) independent contractors; or (B) volunteers who receive no financial or other compensation from the person or entity for their services. (6) Foreign entity
“foreign entity” applies throughout its chapter
The term “foreign entity” means a foreign principal (as defined in section 1(b) of the Foreign Agents Registration Act of 1938 ( 22 U.S.C. 611(b) ). (7) Lobbying activities
“lobbying activities” applies throughout its chapter
The term “lobbying activities” means lobbying contacts and efforts in support of such contacts, including preparation and planning activities, research and other background work that is intended, at the time it is performed, for use in contacts, and coordination with the lobbying activities of others. (8) Lobbying contact (A) Definition
“lobbying contact” applies throughout its chapter
The term “lobbying contact” means any oral or written communication (including an electronic communication) to a covered executive branch official or a covered legislative branch official that is made on behalf of a client with regard to— (i) the formulation, modification, or adoption of Federal legislation (including legislative proposals); (ii) the formulation, modification, or adoption of a Federal rule, regulation, Executive order, or any other program, policy, or position of the United States Government; (iii) the administration or execution of a Federal program or policy (including the negotiation, award, or administration of a Federal contract, grant, loan, permit, or license); or …
“lobbying firm” applies throughout its chapter
The term “lobbying firm” means a person or entity that has 1 or more employees who are lobbyists on behalf of a client other than that person or entity. The term also includes a self-employed individual who is a lobbyist. (10) Lobbyist
“lobbyist” applies throughout its chapter
The term “lobbyist” means any individual who is employed or retained by a client for financial or other compensation for services that include more than one lobbying contact, other than an individual whose lobbying activities constitute less than 20 percent of the time engaged in the services provided by such individual to that client over a 3-month period. (11) Media organization
“media organization” applies throughout its chapter
The term “media organization” means a person or entity engaged in disseminating information to the general public through a newspaper, magazine, other publication, radio, television, cable television, or other medium of mass communication. (12) Member of Congress
“Member of Congress” applies throughout its chapter
The term “Member of Congress” means a Senator or a Representative in, or Delegate or Resident Commissioner to, the Congress. (13) Organization
“organization” applies throughout its chapter
The term “organization” means a person or entity other than an individual. (14) Person or entity
“person or entity” applies throughout its chapter
The term “person or entity” means any individual, corporation, company, foundation, association, labor organization, firm, partnership, society, joint stock company, group of organizations, or State or local government. (15) Public official
“public official” applies throughout its chapter
The term “public official” means any elected official, appointed official, or employee of— (A) a Federal, State, or local unit of government in the United States other than— (i) a college or university; (ii) a government-sponsored enterprise (as defined in section 622(8) of this title ); (iii) a public utility that provides gas, electricity, water, or communications; (iv) a guaranty agency (as defined in section 1085(j) of title 20 ), including any affiliate of such an agency; or (v) an agency of any State functioning as a student loan secondary market pursuant to section 1085(d)(1)(F) of title 20 ; (B) a Government corporation (as defined in section 9101 of title 31 ); (C) an organization …
“State” applies throughout its chapter
The term “State” means each of the several States, the District of Columbia, and any commonwealth, territory, or possession of the United States.
“leadership PAC” applies in that section
the term “leadership PAC” has the meaning given such term in section 30104(i)(8)(B) of title 52 . (e) Electronic filing required A report required to be filed under this section shall be filed in electronic form, in addition to any other form that the Secretary of the Senate or the Clerk of the House of Representatives may require or allow. The Secretary of the Senate and the Clerk of the House of Representatives shall use the same electronic software for receipt and recording of filings under this chapter.
“Board” applies throughout its chapter
The term “Board” means the National Recording Preservation Board.;
“Librarian” applies throughout its chapter
The term “Librarian” means the Librarian of Congress.;
“publication” applies throughout its chapter
The term “publication” has the meaning given such term in section 101 of title 17 .;
“Registry version” applies throughout its chapter
The term “Registry version” means, with respect to a sound recording, the version of a recording first published or offered for mass distribution whether as a publication or a broadcast, or as complete a version as bona fide preservation and restoration activities by the Librarian, an archivist other than the Librarian, or the copyright legal owner can compile in those cases where the original material has been irretrievably lost or the recording is unpublished.
“sound recording” applies throughout its chapter
The term “sound recording” has the meaning given such term in section 101 of title 17 .;
“appropriate committees of Congress” applies in that section
the term “appropriate committees of Congress” means— (i) the Committee on Rules and Administration and the Committee on Appropriations of the Senate; and (ii) the Committee on House Administration and the Committee on Appropriations of the House of Representatives. (4) Budget independence The Architect of the Capitol shall include the annual budget request of the Inspector General in the budget of the Office of the Architect of the Capitol without change.
“Capitol-flown flag” applies throughout its subchapter
the term “Capitol-flown flag” means a flag of the United States flown over the Capitol in honor of the deceased individual for whom the flag is requested;
“chaplain” applies throughout its subchapter
the terms “chaplain”, “firefighter”, “law enforcement officer”, “member of a rescue squad or ambulance crew”, and “public agency” have the meanings given such terms in section 10284 of title 34 ; (3) the term “immediate family member”, with respect to an individual, means— (A) the spouse, parent, brother, sister, or child of the individual or a person to whom the individual stands in loco parentis; or (B) any other person related to the individual by blood or marriage;
“firefighter” applies throughout its subchapter
the terms “chaplain”, “firefighter”, “law enforcement officer”, “member of a rescue squad or ambulance crew”, and “public agency” have the meanings given such terms in section 10284 of title 34 ; (3) the term “immediate family member”, with respect to an individual, means— (A) the spouse, parent, brother, sister, or child of the individual or a person to whom the individual stands in loco parentis; or (B) any other person related to the individual by blood or marriage;
“law enforcement officer” applies throughout its subchapter

“Representative” applies throughout its subchapter
the term “Representative” includes a Delegate or Resident Commissioner to the Congress.
“United States” applies in that section
the term “United States” means each of the several States of the United States, the District of Columbia, and territories and possessions of the United States.
“crime of violence” applies in that section
the term “crime of violence” has the meaning given that term in section 16 of title 18 .
“United States” applies in that section
the term “United States” means each of the several States of the United States, the District of Columbia, and the territories and possessions of the United States. (b) In general A member of the Capitol Police may travel outside of the United States if— (1) that travel is with, or in preparation for, travel of a Senator, including travel of a Senator as part of a congressional delegation; (2) the member of the Capitol Police is performing security advisory and liaison functions (including advance security liaison preparations) relating to the travel of that Senator; and (3) the Sergeant at Arms and Doorkeeper of the Senate gives prior approval to the travel of the member of the Capitol …
“Member of the House of Representatives” applies in that section
the term “Member of the House of Representatives” includes a Delegate or Resident Commissioner to the Congress; and;
“United States” applies in that section
the term “United States” means each of the several States of the United States, the District of Columbia, and the territories and possessions of the United States. (b) Reimbursement from Sergeant at Arms (1) In general From amounts made available for salaries and expenses of the Office of the Sergeant at Arms of the House of Representatives, the Sergeant at Arms of the House of Representatives shall reimburse the Capitol Police for the overtime pay, travel, and related expenses of any member of the Capitol Police who travels under the authority of this section.
“applicable Committee” applies in that section
the term “applicable Committee” means— (i) the Committee on Rules and Administration of the Senate, in the case of a claim of a Senator or an officer or employee whose pay is disbursed by the Secretary of the Senate; or (ii) the Committee on House Administration of the House of Representatives, in the case of a Member of the House of Representatives (including a Delegate or Resident Commissioner to the Congress) or an officer or employee whose pay is disbursed by the Chief Administrative Officer of the House of Representatives.
“security information” applies in that section
the term “security information” means information that— (1) is sensitive with respect to the policing, protection, physical security, intelligence, counterterrorism actions, or emergency preparedness and response relating to Congress, any statutory protectee of the Capitol Police, and the Capitol buildings and grounds; and (2) is obtained by, on behalf of, or concerning the Capitol Police Board, the Capitol Police, or any incident command relating to emergency response.
“servicing” applies in that section
the term “servicing” includes, with respect to an official motor vehicle, the washing and fueling of such vehicle, the checking of its tires and battery, and checking and adding oil.
“contractor” applies in that section
The term “contractor” means the private business concern that enters into a food services contract with the Architect of the Capitol. (2) Covered individual
“covered individual” applies in that section
The term “covered individual” means any individual who— (A) is a Senate Restaurants employee who is an employee of the Architect of the Capitol on July 17, 2008 , including— (i) a permanent, full-time or part-time employee; (ii) a temporary, full-time or part-time employee; and (iii) an employee in a position described under section 2048 1 of this title; (B) becomes an employee of the contractor under a food services contract on the transfer date; and (C) with respect to benefits under subsection (c)(2) or (3), files an election before the transfer date with the Office of Human Resources of the Architect of the Capitol to have 1 or more benefits continued in accordance with this section.
“food services contract” applies in that section
The term “food services contract” means a contract under which food services operations of the Senate Restaurants are transferred to, and performed by, a private business concern. (4) Transfer date
“transfer date” applies in that section
The term “transfer date” means the date on which a contractor begins the performance of food services operations under a food services contract. (b) Election of coverage (1) In general (A) Retirement coverage Not later than the day before the transfer date, an individual described under subsection (a)(2)(A) and (B) may file an election with the Office of Human Resources of the Architect of the Capitol to continue coverage under the retirement system under which that individual is covered on that day.
“agency of the legislative branch” applies in that section
the term “agency of the legislative branch” means the Office of the Architect of the Capitol, the Botanic Garden, the Government Accountability Office, the Government Publishing Office, the Library of Congress, the Office of Technology Assessment, the Congressional Budget Office, and the Copyright Royalty Tribunal; and;
“Member of the House of Representatives” applies in that section
the term “Member of the House of Representatives” means a Representative in, or a Delegate or Resident Commissioner to, the Congress;
“support personnel” applies in that section
the term “support personnel” means, with respect to the House of Representatives, any employee of a credit union or of the Architect of the Capitol, whose principal duties are to support the functions of the House of Representatives.
“Member of the House of Representatives” applies throughout its part
the term “Member of the House of Representatives” means a Representative in, or a Delegate or Resident Commissioner to, the Congress.
“qualified entity” applies in that section
the term “qualified entity” means— (A) the National Fund for the United States Botanic Garden; and (B) any other organization described in section 501(c) of title 26 and exempt from tax under section 501(a) of such title that the Architect of the Capitol determines shares interests complementary to the educational mission of the United States Botanic Garden. (c) Construction or improvement of real property Any authority under subsection (a) or (b) shall not apply to any agreement providing for the construction or improvement of real property. (d) Applicability This section shall apply with respect to fiscal year 2015 and each succeeding fiscal year.
“carbon dioxide energy efficiency” applies in that section
the term “carbon dioxide energy efficiency” means the quantity of electricity used to power equipment for carbon dioxide capture and storage or use. (c) Feasibility study The Architect of the Capitol shall conduct a feasibility study evaluating the available methods to capture, store, and use carbon dioxide emitted from the Capitol Power Plant as a result of burning fossil fuels.
“covered employee” applies in that section
the term “covered employee” means— (1) an employee whose pay is disbursed by the Secretary of the Senate; or (2) any other individual who is authorized to park in any parking area under the jurisdiction of the Senate on Capitol Grounds. (b) Authority (1) In general Subject to paragraph (3), funds appropriated to the Architect of the Capitol under the heading “Capitol Power Plant” under the heading “ARCHITECT OF THE CAPITOL” in any fiscal year are available to construct, operate, and maintain on a reimbursable basis battery recharging stations in parking areas under the jurisdiction of the Senate on Capitol Grounds for use by privately owned vehicles used by Senators or covered employees.
“covered employee” applies in that section
the term “covered employee” means— (1) an employee whose pay is disbursed by the Chief Administrative Officer of the House of Representatives; or (2) any other individual who is authorized to park in any parking area under the jurisdiction of the House of Representatives on Capitol Grounds.

the term “covered employee” means— (1) an employee of the Library of Congress; or (2) any other individual who is authorized to park in any parking area under the jurisdiction of the Library of Congress on the Library of Congress buildings and grounds.
“United States Capitol Complex” applies in that section
the term “United States Capitol Complex” means the Capitol buildings (as defined in section 5101 of title 40 ) and the United States Capitol Grounds (as described in section 5102 of such title). (b) Director of Accessibility Services (1) Appointment, pay, and removal (A) Appointment and pay The Director of Accessibility Services shall be appointed by the Congressional Accessibility Services Board and shall be paid at a rate of pay determined by the Congressional Accessibility Services Board.
“transfer date” applies throughout its subchapter
the term “transfer date” means the date occurring on the first day of the first pay period (applicable to employees transferred under section 2241 of this title ) occurring on or after 30 days after October 20, 2008 .
“covered grounds” applies in that section
the term “covered grounds” means— (1) the grounds described under section 5102 of title 40 ; (2) the Capitol Buildings defined under section 5101 of title 40 , including the Capitol Visitor Center; and (3) the Library of Congress buildings and grounds described under section 167j of this title . (b) Treatment of coins In the case of any coins in any fountains on covered grounds— (1) such coins shall be treated as gifts to the United States; and (2) the Architect of the Capitol shall— (A) collect such coins at such times and in such manner as the Architect determines appropriate; and (B) except as provided under subsection (c), deposit the collected coins in accordance with subsection (d).
“officer of the Congress” applies in that section
the term “officer of the Congress” means— (1) an elected officer of the Senate or House of Representatives who is not a Member of the Senate or House; and (2) The Architect of the Capitol.
“congressional leadership” applies in that section
the term “congressional leadership” means— (A) the Majority and Minority Leader of the Senate with respect to an agreement with the Sergeant at Arms and Doorkeeper of the Senate or the Secretary of the Senate; and (B) the Speaker and Minority Leader of the House of Representatives with respect to an agreement with the Chief Administrative Officer of the House of Representatives or the Sergeant at Arms of the House of Representatives; and;
“cybersecurity threat” applies in that section
the terms “cybersecurity threat” and “security vulnerability” have the meanings given those terms in section 650 of title 6 , as added by section 5171 1 of this division. (d) Requirement (1) Designation (A) In general Not later than 30 days after December 23, 2022 , the President shall designate— (i) an individual appointed by the President, by and with the advice and consent of the Senate, to serve as a single point of contact to the legislative branch on matters related to tactical and operational cybersecurity threats and security vulnerabilities; and (ii) an individual appointed by the President, by and with the advice and consent of the Senate, to serve as a single point of contact to …
“security vulnerability” applies in that section
the terms “cybersecurity threat” and “security vulnerability” have the meanings given those terms in section 650 of title 6 , as added by section 5171 1 of this division. (d) Requirement (1) Designation (A) In general Not later than 30 days after December 23, 2022 , the President shall designate— (i) an individual appointed by the President, by and with the advice and consent of the Senate, to serve as a single point of contact to the legislative branch on matters related to tactical and operational cybersecurity threats and security vulnerabilities; and (ii) an individual appointed by the President, by and with the advice and consent of the Senate, to serve as a single point of contact to …
“Capitol Buildings” applies in that section
the term “Capitol Buildings” has the meaning given such term in section 5101 of title 40 ; and;
“United States Capitol Grounds” applies in that section
the term “United States Capitol Grounds” has the meaning given such term in section 5102(a) of title 40 . (c) Effective date Subsection (a) shall take effect on January 23, 2004 , and shall apply during any fiscal year occurring on or after January 23, 2004 .
“Member of the House of Representatives” applies in that section
the term “Member of the House of Representatives” means a Representative in, or a Delegate or Resident Commissioner to, the Congress.
“Member” applies in that section
the term “Member” means each Member of the Senate and the House of Representatives, the Resident Commissioner from Puerto Rico, the Delegates from the District of Columbia, Guam, Virgin Islands, and American Samoa, and the Vice President.
“employment” applies in that section
the term “employment” includes employment under a personal services contract with the United States. (g) Effective date This section shall take effect on December 8, 2004 , and shall apply with respect to the portion of fiscal year 2005 occurring on and after December 8, 2004 , and to each succeeding fiscal year.
“Member of the House of Representatives” applies in that section
the term “Member of the House of Representatives” means a Member of the House of Representatives, a Delegate to the House of Representatives, and the Resident Commissioner from Puerto Rico.
“employee of the House of Representatives” applies in that section
the term “employee of the House of Representatives” means an employee whose pay is disbursed by the Clerk of the House of Representatives or the Chief Administrative Officer of the House of Representatives, as applicable, except that such term does not include a uniformed or civilian support employee under the Capitol Police Board. (d) Separations after June 30, 1995 Payments under this section may be made with respect to separations from employment taking place after June 30, 1995 .
“Member” applies in that section
the term “Member” means a Member of the House of Representatives, the Delegates from the District of Columbia, Guam, and the Virgin Islands, and the Resident Commissioner from Puerto Rico; and (3) the term “legislative days” does not include any calendar day on which the House of Representatives is not in session.
“State” applies in that section
the term “State” means any of the several States, the District of Columbia, the Commonwealth of Puerto Rico, or any other territory or possession of the United States;
“charitable organizations” applies in that section
the term “charitable organizations” means national voluntary health and welfare agencies designated by the Director of the Office of Personnel Management pursuant to Executive Order 10927, dated March 19, 1961 ; and;
“employee” applies in that section
the term “employee” means any employee of the House of Representatives whose compensation is disbursed by the Chief Administrative Officer of the House of Representatives.
“employee of the House of Representatives” applies in that section
the term “employee of the House of Representatives” means any person in the legislative branch of the Government whose salary, wages, or other compensation is disbursed by the Chief Administrative Officer of the House of Representatives.
“committee of the Senate” applies in that section
the term “committee of the Senate” means— (I) any standing committee (including the majority and minority policy committees) of the Senate; (II) any select committee (including the conference majority and conference minority of the Senate); or (III) any joint committee the expenses of which are paid from the contingent fund of the Senate; and (ii) an employee of a subcommittee shall be considered to be an employee of the full committee. (B) Subject to adjustment as provided by law, no employee of a committee of the Senate shall be paid at a per annum gross rate in excess of the annual rate of basic pay in effect for level II of the Executive Schedule under section 5313 of title 5 .
“qualifying position” applies in that section
the term “qualifying position” means a position that— (1) is designated as a shared position for purposes of this section by the Senator or other head of the office in which the position is located; and (2) is one of the following: (A) A position— (i) that is in the office of a Senator; and (ii) the pay of which is disbursed by the Secretary of the Senate.
“departing Senator or Vice President” applies in that section
The term “departing Senator or Vice President” means a Senator or Vice President who will not serve in the next term due to retirement, resignation, a decision to not seek reelection, or a failure to secure reelection. (3) Eligible employee
“departure date” applies in that section
The term “departure date” means the earlier of— (A) the date on which the term of a departing Senator or Vice President ends; or (B) the date on which the departing Senator or Vice President will retire or resign. (2) Departing Senator or Vice President
“eligible employee” applies in that section
The term “eligible employee” means an individual, except as provided under subsection (b)(3)— (A) who is an employee of the Senate; and (B) whose rate of pay as an employee of the Senate, on the date on which such eligibility is determined, does not exceed the rate of basic pay payable for a position at level IV of the Executive Schedule under section 5315 of title 5 . (4) Employee of the Senate
“employee of the Senate” applies in that section
The term “employee of the Senate”— (A) has the meaning given the term under section 1301 of this title ; and (B) includes any employee of the Office of Congressional Accessibility Services whose pay is disbursed by the Secretary of the Senate. (5) Employing office
“employing office” applies in that section
The term “employing office”— (A) means the employing office, as defined under section 1301 of this title , of an employee of the Senate; and (B) includes the Office of Congressional Accessibility Services with respect to employees of that office whose pay is disbursed by the Secretary of the Senate. (6) Secretary
“Secretary” applies in that section
The term “Secretary” means the Secretary of the Senate. (7) Student loan
“student loan” applies in that section
The term “student loan” means— (A) a loan made, insured, or guaranteed under part B, D, or E of title IV of the Higher Education Act of 1965 ( 20 U.S.C. 1071 et seq., 1087a et seq., or 1087aa et seq.); and (B) a health education assistance loan made or insured under part A of title VII of the Public Health Service Act ( 42 U.S.C. 292 et seq.), or under part E of title VIII of such Act ( 42 U.S.C. 297a et seq.).
“head of the employing office” applies in that section
the term “head of the employing office” means any person with the final authority to appoint, hire, discharge, and set the terms, conditions, or privileges of the employment of an individual whose pay is disbursed by the Secretary of the Senate. (e) Applicability This section shall apply to fiscal year 1996 and each fiscal year thereafter.
“gift” applies in that section
the term “gift” means a payment, subscription, advance, forbearance, rendering, or deposit of money, services, or anything of value, including food, lodging, transportation, or entertainment, and reimbursement for other than necessary expenses, unless consideration of equal or greater value is received, but does not include (1) a political contribution otherwise reported as required by law, (2) a loan made in a commercially reasonable manner (including requirements that the loan be repaid and that a reasonable rate of interest be paid), (3) a bequest, inheritance, or other transfer at death, (4) a bona fide award presented in recognition of public service and available to the general …
“relative” applies in that section
the term “relative” has the same meaning given to such term in section 13101(16) of title 5 . (4) If a Member, officer, or employee, after exercising reasonable diligence to obtain the information necessary to comply with this rule, unknowingly accepts a gift described in paragraph (1) such Member, officer, or employee shall, upon learning of the nature of the gift and its source, return the gift or, if it is not possible to return the gift, reimburse the donor for the value of the gift.
“Member of the House” applies in that section
the term “Member of the House” means a Representative in, and a Delegate or Resident Commissioner to, the Congress.
“House leadership office” applies in that section
the term “House leadership office” means, with respect to a fiscal year, any office for which the appropriation for salaries and expenses of the office for the fiscal year is provided under the heading “House Leadership Offices” in the Act making appropriations for the Legislative Branch for the fiscal year; and (2) term “intern”, with respect to a House leadership office, has the meaning given such term with respect to a Member of the House of Representatives in section 5321(c)(2) of this title . (d) Appropriations There are authorized to be appropriated to carry out this section such sums as may be necessary for fiscal year 2020 and each succeeding fiscal year.
“intern” applies in that section
the term “intern” means, with respect to a Member of the House of Representatives, an individual who serves in the office of the Member for not more than 120 days in a 12-month period and whose service is primarily for the educational experience of the individual;
“Member of the House of Representatives” applies in that section
the term “Member of the House of Representatives” means a Representative in, or a Delegate or Resident Commissioner to, the Congress;
“part-time employee” applies in that section
the term “part-time employee” means, with respect to a Member of the House of Representatives, an individual who is employed by the Member and whose normally assigned work schedule is not more than the equivalent of 15 full working days per month;
“shared employee” applies in that section
the term “shared employee” means an employee who is paid by more than one employing authority of the House of Representatives. (d) Regulations The Committee on House Oversight shall have authority to prescribe regulations to carry out this section.
“temporary employee” applies in that section
the term “temporary employee” means, with respect to a Member of the House of Representatives, an individual who is employed for a specific purpose or task and who is employed for not more than 90 days in a 12-month period, except that the term of such employment may be extended with the written approval of the Committee on House Oversight; and;
“intern” applies in that section
the term “intern” has the meaning given such term in section 5321(c)(2) of this title ; and;
“Member of the House of Representatives” applies in that section
the term “Member of the House of Representatives” means a Representative in, or a Delegate or Resident Commissioner to, the Congress. (f) Authorization of appropriations There are authorized to be appropriated to carry out this section $8,800,000 for fiscal year 2019, and such sums as may be necessary for fiscal year 2020 and each succeeding fiscal year.
“Member of the House of Representatives” applies in that section
the term “Member of the House of Representatives” means a Representative in, or a Delegate or Resident Commissioner to, the Congress. (d) Regulations The Committee on House Oversight of the House of Representatives shall have authority to prescribe regulations to carry out this section, including regulations establishing under subsection (a) the official and representational duties during a Congress of a Member-elect of the House of Representatives who is not an incumbent Member re-elected to the ensuing Congress. (e) Effective date This section shall take effect on September 1, 1995 and shall apply with respect to official and representational duties carried out on or after that date.
“Member of the House of Representatives” applies in that section
the term “Member of the House of Representatives” means a Representative in, or a Delegate or Resident Commissioner to, the Congress. (c) Regulations The Committee on House Oversight of the House of Representatives shall have authority to prescribe regulations to carry out this section.
“Member of the House of Representatives” applies in that section
the term “Member of the House of Representatives” means a Representative in, or a Delegate or Resident Commissioner to, the Congress; and;
“official records and papers” applies in that section
the term “official records and papers” means books, records, papers, and official files which could be sent as franked mail.
“applicable accounts of the House of Representatives” applies in that section
the term “applicable accounts of the House of Representatives” means accounts for salaries and expenses of committees (other than the Committee on Appropriations), the computer support organization of the House of Representatives, and allowances and expenses of Members of the House of Representatives, officers of the House of Representatives, and administrative and support offices of the House of Representatives; and;
“Member of the House of Representatives” applies in that section
the term “Member of the House of Representatives” means a Representative in, or a Delegate or Resident Commissioner to, the Congress.
“computer-related equipment” applies in that section
the term “computer-related equipment” includes desktops, laptops, printers, file servers, and peripherals which are appropriate for use in public school education;
“public elementary school” applies in that section
the terms “public elementary school” and “public secondary school” have the meaning given the terms elementary school and secondary school in section 7801 of title 20 ; and;
“public secondary school” applies in that section
the terms “public elementary school” and “public secondary school” have the meaning given the terms elementary school and secondary school in section 7801 of title 20 ; and;
“State” applies in that section
the term “State” means a State of the United States, the District of Columbia, the Commonwealth of Puerto Rico, and a territory or possession of the United States; and;
“used equipment” applies in that section
the term “used equipment” means such used or surplus equipment (including furniture and motor vehicles) as the Committee on House Oversight of the House of Representatives may prescribe by regulation.
“workstation” applies in that section
the term “workstation” includes desktops and peripherals, file servers and peripherals, laptops and peripherals, printers and peripherals, and workstations and peripherals. (C) The Committee on House Oversight shall have authority to issue regulations to carry out this paragraph. (4) The Committee on House Oversight of the House of Representatives shall have authority to prescribe regulations to carry out this subsection. (5) As used in this section—;
“handle” applies in that section
the term “handle” includes but is not limited to collecting, isolating, testing, opening, disposing, and destroying. (d) Effective date This section shall apply with respect to fiscal year 2004 and each succeeding fiscal year.
“General Counsel of the House of Representatives” applies in that section
the term “General Counsel of the House of Representatives” means— (1) the head of the Office of General Counsel established and operating under clause 8 of rule II of the Rules of the House of Representatives; (2) the head of any successor office to the Office of General Counsel which is established after September 29, 1999 ; and (3) any other person authorized and directed in accordance with the Rules of the House of Representatives to provide legal assistance and representation to the House in connection with the matters described in this section. (d) Effective date The provisions of this section shall become effective beginning with September 29, 1999 .
“Leader’s Representation Allowance” applies in that section
The term “Leader’s Representation Allowance” means the Representation Allowance Account for the Majority and Minority Leaders established by section 6135 of this title . (2) The term “Leader’s Expense Allowance”, when used in reference to the Majority or Minority Leader of the Senate, refers to the moneys available, for any fiscal year, to such Leader as an expense allowance and the appropriation account from which such moneys are funded.
“applicable conference” applies in that section
the term “applicable conference” means the majority or minority conference of the Senate, as applicable, that represents the Democratic party;
“covered Congress” applies in that section
the term “covered Congress” means the 118th and any subsequent Congress;
“covered period” applies in that section
the term “covered period” means the period beginning on the date on which the Secretary of the applicable conference submits the letter described in subsection (b); and;
“designated officer of the applicable conference” applies in that section
the term “designated officer of the applicable conference” means the member of the leadership of the applicable conference to whom the duties and authorities of the Secretary of the applicable conference are assigned under subsection (b). (b) The Secretary of the applicable conference may, by submission of a letter to the Disbursing Office of the Senate, at the direction of the Chair of the applicable conference, assign to a member of the leadership of the applicable conference the following duties and authorities for the duration of the covered Congress: (1) The authority over any amounts made available for the Office of the Secretary of the applicable conference.
“travel expenses” applies in that section
The term “travel expenses” includes actual transportation expenses, essential travel-related expenses, and, where applicable, per diem expenses (but not in excess of actual expenses). A Senator or an employee of the Senator shall not be reimbursed for any travel expenses (other than actual transportation expenses) for any travel occurring during the sixty days immediately before the date of any primary or general election (whether regular, special, or runoff) in which the Senator is a candidate for public office (within the meaning of section 30101(b) 1 of title 52), unless his candidacy in such election is uncontested.
“official records and papers” applies in that section
the term “official records and papers” means books, records, papers, and official files which could be sent as franked mail. (e) Effective date This section shall apply with respect to fiscal year 2005 and each succeeding fiscal year.
“appropriate committees of the Senate” applies in that section
the term “appropriate committees of the Senate” means the Committee on Appropriations and the Committee on Rules and Administration of the Senate;
“Fellowships Programs” applies in that section
the term “Fellowships Programs” means the SFC Sean Cooley and SPC Christopher Horton Congressional Gold Star Family Fellowship Program (commonly referred to as the “Green and Gold Congressional Aide Program”) established under Senate Resolution 442 (117th Congress), agreed to November 4, 2021 , and the McCain-Mansfield Fellowship Program established under Senate Resolution 443 (117th Congress), agreed to November 4, 2021 , or any successor program to such programs;
“Fund” applies in that section
the term “Fund” means the Sergeant at Arms Fellowships Fund established under subsection (b); and;
“Sergeant at Arms” applies in that section
the term “Sergeant at Arms” means the Sergeant at Arms and Doorkeeper of the Senate. (b) Establishment There is established under the heading “ Contingent Expenses of the Senate ” an account to be known as the “ sergeant at arms fellowships fund ”. (c) Use of amounts (1) In general Amounts in the Fund shall be available to the Sergeant at Arms for the costs of compensation of fellows under the Fellowships Programs and the administration of the Fellowships Programs, except as provided in paragraph (2). (2) Agency contributions Agency contributions for the Fellowships Programs shall be paid from the appropriations account for “Salaries, Officers and Employees” of the Senate.
“Fund” applies in that section
the term “Fund” means the Sergeant at Arms Business Continuity and Disaster Recovery Fund established under paragraph (2); and;
“Sergeant at Arms” applies in that section
the term “Sergeant at Arms” means the Sergeant at Arms and Doorkeeper of the Senate. (2) Establishment There is established under the heading “ Contingent Expenses of the Senate ” an account to be known as the “Sergeant at Arms Business Continuity and Disaster Recovery Fund”. (3) Use of amounts Amounts in the Fund shall be available to the Sergeant at Arms for purposes of the business continuity and disaster recovery needs of the Senate.
“agent of the Office of the SAA” applies in that section
the term “agent of the Office of the SAA” includes a provider of electronic communication service or remote computing service commissioned or used through the Office of the SAA by a Senate office to provide such services to the Senate office;
“electronic communication service” applies in that section
the term “electronic communication service” has the meaning given that term in section 2510 of title 18 ;
“Office of the SAA” applies in that section
the term “Office of the SAA” means the Office of the Sergeant at Arms and Doorkeeper of the Senate;
“provider for a Senate office” applies in that section
the term “provider for a Senate office” means a provider of electronic communication service or remote computing service directly commissioned or used by a Senate office to provide such services;
“remote computing service” applies in that section
the term “remote computing service” has the meaning given that term in section 2711 of title 18 ; (6) the term “Senate data”, with respect to a Senate office, means any electronic mail or other electronic or data communication, other data (including metadata), or other information of the Senate office; and;
“Senate office” applies in that section
the term “Senate office” means a committee or office of the Senate, including a Senator, an officer of the Senate, or an employee of, intern at, or other agent of a committee or office of the Senate. (b) Treatment (1) Retaining possession (A) In general A Senate office shall be deemed to retain possession of any Senate data of the Senate office, without regard to the use by the Senate office of any individual or entity described in paragraph (2) for the purposes of any function or service described in paragraph (2). (B) Rule of construction Subparagraph (A) shall not be construed to limit the use by an intended recipient of any Senate data from a Senate office.
“educationally useful equipment” applies in that section
The term “educationally useful equipment” means computers and related peripheral tools, including printers, modems, routers, servers, computer keyboards, scanners, and other telecommunications and research equipment, that are appropriate for use in public school education. (e) Effective date This section shall take effect beginning with fiscal year 1997 and shall be effective each fiscal year thereafter.
“public school” applies in that section
The term “public school” means a 2 elementary school or secondary school, as such terms are defined in section 7801 of title 20 .;
