“medically underserved community” applies throughout its subchapter
The term “medically underserved community” means an urban or rural area or population that— (A) is eligible for designation under section 254e of this title as a health professional shortage area; (B) is eligible to be served by a migrant health center under section 254b 2 of this title, a community health center under section 254c 2 of this title, a grantee under section 254b(h) of this title (relating to homeless individuals), or a grantee under section 256a 2 of this title (relating to residents of public housing); (C) has a shortage of personal health services, as determined under criteria issued by the Secretary under section 1395x(aa)(2) of this title (relating to rural health …
“mental health service professional” applies throughout its subchapter
The term “mental health service professional” means an individual with a graduate or postgraduate degree from an accredited institution of higher education in psychiatry, psychology, school psychology, behavioral pediatrics, psychiatric nursing, social work, school social work, substance abuse disorder prevention and treatment, marriage and family counseling, school counseling, or professional counseling. (23) One-stop delivery system center .—
“one-stop delivery system” applies throughout its subchapter
The term “one-stop delivery system” means a one-stop delivery system described in section 3151(e) of title 29 . (24) Paraprofessional child and adolescent mental health worker .—
“paraprofessional child and adolescent mental health worker” applies throughout its subchapter
The term “paraprofessional child and adolescent mental health worker” means an individual who is not a mental or behavioral health service professional, but who works at the first stage of contact with children and families who are seeking mental or behavioral health services, including substance abuse prevention and treatment services. (25) Racial and ethnic minority group; racial and ethnic minority population .—
“physician assistant education program” applies throughout its subchapter
The term “physician assistant education program” means an educational program in a public or private institution in a State that— (A) has as its objective the education of individuals who, upon completion of their studies in the program, be 1 qualified to provide primary care medical services with the supervision of a physician; and (B) is accredited by the Accreditation Review Commission on Education for the Physician Assistant.;
“psychologist” applies throughout its subchapter
The term “psychologist” means an individual who— (A) holds a doctoral degree in psychology; and (B) is licensed or certified on the basis of the doctoral degree in psychology, by the State in which the individual practices, at the independent practice level of psychology to furnish diagnostic, assessment, preventive, and therapeutic services directly to individuals. (12) Area health education center .—
“racial and ethnic minority group” applies throughout its subchapter

“State” applies throughout its subchapter
The term “State” includes, in addition to the several States, only the District of Columbia, the Commonwealth of Puerto Rico, the Commonwealth of the Northern Mariana Islands, the Virgin Islands, Guam, American Samoa, and the Trust Territory of the Pacific Islands. (10) (A) Subject to subparagraph (B),
“teaching facilities” applies throughout its subchapter
The term “teaching facilities” means areas dedicated for use by students, faculty, or administrative or maintenance personnel for clinical purposes, research activities, libraries, classrooms, offices, auditoriums, dining areas, student activities, or other related purposes necessary for, and appropriate to, the conduct of comprehensive programs of education. Such term includes interim facilities but does not include off-site improvements or living quarters. (3) Physician assistant education program .—
“underrepresented minorities” applies throughout its subchapter
the term “underrepresented minorities” means, with respect to a health profession, racial and ethnic populations that are underrepresented in the health profession relative to the number of individuals who are members of the population involved. (B) For purposes of subparagraph (A), Asian individuals shall be considered by the various subpopulations of such individuals.;
“accelerated nursing degree program” applies throughout its subchapter
The term “accelerated nursing degree program” means a program of education in professional nursing offered by an accredited school of nursing in which an individual holding a bachelors degree in another discipline receives a BSN or MSN degree in an accelerated time frame as determined by the accredited school of nursing. (17) Bridge or degree completion program
“ambulatory surgical center” applies throughout its subchapter
The term “ambulatory surgical center” has the meaning applicable to such term under title XVIII of the Social Security Act [ 42 U.S.C. 1395 et seq.]. (10) Federally qualified health center
“associate degree school of nursing” applies throughout its subchapter
The term “associate degree school of nursing” means a department, division, or other administrative unit in a junior college, community college, college, or university which provides primarily or exclusively a two-year program of education in professional nursing and allied subjects leading to an associate degree in nursing or to an equivalent degree, but only if such program, or such unit, college, or university is accredited. (5) Diploma school of nursing
“bridge or degree completion program” applies throughout its subchapter
The term “bridge or degree completion program” means a program of education in professional nursing offered by an accredited school of nursing, as defined in paragraph (2), that leads to a baccalaureate degree in nursing. Such programs may include, Registered Nurse (RN) to Bachelor’s of Science of Nursing (BSN) programs, RN to MSN (Master of Science of Nursing) programs, or BSN to Doctoral programs. (18) Nurse managed health clinic
“collegiate school of nursing” applies throughout its subchapter
The term “collegiate school of nursing” means a department, division, or other administrative unit in a college or university which provides primarily or exclusively a program of education in professional nursing and related subjects leading to the degree of bachelor of arts, bachelor of science, bachelor of nursing, or to an equivalent degree, or to a graduate degree in nursing, or to an equivalent degree, and including advanced training related to such program of education provided by such school, but only if such program, or such unit, college or university is accredited. (4) Associate degree school of nursing
“diploma school of nursing” applies throughout its subchapter
The term “diploma school of nursing” means a school affiliated with a hospital or university, or an independent school, which provides primarily or exclusively a program of education in professional nursing and allied subjects leading to a diploma or to equivalent indicia that such program has been satisfactorily completed, but only if such program, or such affiliated school or such hospital or university or such independent school is accredited.
“eligible entities” applies throughout its subchapter
The term “eligible entities” means schools of nursing, nursing centers, academic health centers, State or local governments, and other public or private nonprofit entities determined appropriate by the Secretary that submit to the Secretary an application in accordance with section 296a of this title . (2) School of nursing
“Federally qualified health center” applies throughout its subchapter
The term “Federally qualified health center” has the meaning given such term under section 1861(aa)(4) of the Social Security Act [ 42 U.S.C. 1395x(aa)(4) ]. (11) Health care facility
“health care facility” applies throughout its subchapter
The term “health care facility” means an Indian Health Service health center, a Native Hawaiian health center, a hospital, a Federally qualified health center, a rural health clinic, a nursing home, a home health agency, a hospice program, a public health clinic, a State or local department of public health, a skilled nursing facility, an ambulatory surgical center, or any other facility designated by the Secretary. (12) Home health agency
“home health agency” applies throughout its subchapter
The term “home health agency” has the meaning given such term in section 1861( o ) of the Social Security Act [ 42 U.S.C. 1395x ( o )]. (13) Hospice program
“hospice program” applies throughout its subchapter
The term “hospice program” has the meaning given such term in section 1861(dd)(2) of the Social Security Act [ 42 U.S.C. 1395x(dd)(2) ]. (14) Rural health clinic
“nurse managed health clinic” applies throughout its subchapter
The term “nurse managed health clinic” means a nurse-practice arrangement, managed by advanced practice nurses, that provides primary care or wellness services to underserved or vulnerable populations and that is associated with a school, college, university or department of nursing, federally qualified health center, or independent nonprofit health or social services agency.
“rural health clinic” applies throughout its subchapter
The term “rural health clinic” has the meaning given such term in section 1861(aa)(2) of the Social Security Act [ 42 U.S.C. 1395x(aa)(2) ]. (15) Skilled nursing facility
“school of nursing” applies throughout its subchapter
The term “school of nursing” means an accredited (as defined in paragraph 6) collegiate, associate degree, or diploma school of nursing in a State where graduates are— (A) authorized to sit for the National Council Licensure EXamination-Registered Nurse (NCLEX–RN); or (B) licensed registered nurses who will receive a graduate or equivalent degree or training to become an advanced education nurse as defined by section 296j(b) of this title . (3) Collegiate school of nursing
“skilled nursing facility” applies throughout its subchapter
The term “skilled nursing facility” has the meaning given such term in section 1819(a) of the Social Security Act [ 42 U.S.C. 1395i–3(a) ]. (16) Accelerated nursing degree program
“State” applies throughout its subchapter
The term “State” means a State, the Commonwealth of Puerto Rico, the District of Columbia, the Commonwealth of the Northern Mariana Islands, Guam, American Samoa, the Virgin Islands, or the Trust Territory of the Pacific Islands. (9) Ambulatory surgical center
“advanced education nurses” applies in that section
the term “advanced education nurses” means individuals trained in advanced degree programs including individuals in combined R.N./graduate degree programs, post-nursing master’s certificate programs, or, in the case of nurse midwives, in certificate programs in existence on the date that is one day prior to November 13, 1998 , to serve as nurse practitioners, clinical nurse specialists, nurse midwives, nurse anesthetists, nurse educators, nurse administrators, clinical nurse leaders, or public health nurses, or in other nurse specialties determined by the Secretary to require advanced education.
“eligible entity” applies in that section
the term “eligible entity” includes an accredited school of nursing, as defined in section 296(2) of this title , a health care facility, including federally qualified health centers or nurse-managed health clinics, or a partnership of such a school and facility a health care facility, or a partnership of such a school and facility. 1
“default” applies in that section
the term “default” means the failure of a borrower of a loan made under this part to— (i) make an installment payment when due; or (ii) comply with any other term of the promissory note for such loan, except that a loan made under this part shall not be considered to be in default if the loan is discharged in bankruptcy or if the school reasonably concludes from written contacts with the borrower that the borrower intends to repay the loan;
“defaulted principal amount outstanding” applies in that section
the term “defaulted principal amount outstanding” means the total amount borrowed from the loan fund of a school that has reached the repayment stage (minus any principal amount repaid or cancelled) on loans— (i) repayable monthly and in default for at least 120 days; and (ii) repayable less frequently than monthly and in default for at least 180 days;
“grace period” applies in that section
the term “grace period” means the period of nine months beginning on the date on which the borrower ceases to pursue a full-time or half-time course of study at a school of nursing; and;
“matured loans” applies in that section
the term “matured loans” means the total principal amount of all loans made by a school of nursing under this part minus the total principal amount of loans made by such school to students who are— (i) enrolled in a full-time or half-time course of study at such school; or (ii) in their grace period.
“eligible individual” applies in that section
the term “eligible individual” means an individual who is enrolled or accepted for enrollment as a full-time or part-time student in a school of nursing. (3) Service requirement (A) In general The Secretary may not enter into a contract with an eligible individual under this subsection unless the individual agrees to serve as a nurse at a health care facility with a critical shortage of nurses for a period of full-time service of not less than 2 years, or for a period of part-time service in accordance with subparagraph (B).
“eligible individual” applies in that section
the term “eligible individual” means an individual who— (1) is a United States citizen, national, or lawful permanent resident; (2) holds an unencumbered license as a registered nurse; and (3) has either already completed a master’s or doctorate nursing program at an accredited school of nursing or is currently enrolled on a full-time or part-time basis in such a program. (f) Priority For the purposes of this section and section 297n–1 of this title , funding priority will be awarded to School of Nursing Student Loans 2 that support doctoral nursing students or Individual Student Loan Repayment 3 that support doctoral nursing students.
“eligible entity” applies in that section
the term “eligible entity” includes a school of nursing, a health care facility, a program leading to certification as a certified nurse assistant, a partnership of such a school and facility, or a partnership of such a program and facility. (e) Authorization of appropriations There are authorized to be appropriated to carry out this section such sums as may be necessary for each of fiscal years 2010 through 2014.
“health disparity population” applies in that section
The term “health disparity population” has the meaning given such term in section 285t of this title , except that in addition to the meaning so given, the Director may determine that such term includes populations for which there is a significant disparity in the quality, outcomes, cost, or use of health care services or access to or satisfaction with such services as compared to the general population. (2) The term “minority”, with respect to populations, refers to racial and ethnic minority groups as defined in section 300u–6 of this title .
“HIPAA confidentiality regulations” applies throughout its part
The term “HIPAA confidentiality regulations” means regulations promulgated under section 264(c) of the Health Insurance Portability and Accountability Act of 1996 ( Public Law 104–191 ; 110 Stat. 2033 ). (2) Identifiable patient safety work product
“identifiable patient safety work product” applies throughout its part
The term “identifiable patient safety work product” means patient safety work product that— (A) is presented in a form and manner that allows the identification of any provider that is a subject of the work product, or any providers that participate in activities that are a subject of the work product; (B) constitutes individually identifiable health information as that term is defined in the HIPAA confidentiality regulations; or (C) is presented in a form and manner that allows the identification of an individual who reported information in the manner specified in section 299b–22(e) of this title . (3) Nonidentifiable patient safety work product
“nonidentifiable patient safety work product” applies throughout its part
The term “nonidentifiable patient safety work product” means patient safety work product that is not identifiable patient safety work product (as defined in paragraph (2)). (4) Patient safety organization
“patient safety activities” applies throughout its part
The term “patient safety activities” means the following activities: (A) Efforts to improve patient safety and the quality of health care delivery. (B) The collection and analysis of patient safety work product. (C) The development and dissemination of information with respect to improving patient safety, such as recommendations, protocols, or information regarding best practices. (D) The utilization of patient safety work product for the purposes of encouraging a culture of safety and of providing feedback and assistance to effectively minimize patient risk. (E) The maintenance of procedures to preserve confidentiality with respect to patient safety work product.
“patient safety evaluation system” applies throughout its part
The term “patient safety evaluation system” means the collection, management, or analysis of information for reporting to or by a patient safety organization. (7) Patient safety work product (A) In general Except as provided in subparagraph (B),
“patient safety organization” applies throughout its part
The term “patient safety organization” means a private or public entity or component thereof that is listed by the Secretary pursuant to section 299b–24(d) of this title . (5) Patient safety activities
“patient safety work product” applies throughout its part
the term “patient safety work product” means any data, reports, records, memoranda, analyses (such as root cause analyses), or written or oral statements— (i) which— (I) are assembled or developed by a provider for reporting to a patient safety organization and are reported to a patient safety organization; or (II) are developed by a patient safety organization for the conduct of patient safety activities; and which could result in improved patient safety, health care quality, or health care outcomes; or (ii) which identify or constitute the deliberations or analysis of, or identify the fact of reporting pursuant to, a patient safety evaluation system.
“provider” applies throughout its part
The term “provider” means— (A) an individual or entity licensed or otherwise authorized under State law to provide health care services, including— (i) a hospital, nursing facility, comprehensive outpatient rehabilitation facility, home health agency, hospice program, renal dialysis facility, ambulatory surgical center, pharmacy, physician or health care practitioner’s office, long term care facility, behavior health residential treatment facility, clinical laboratory, or health center; or (ii) a physician, physician assistant, nurse practitioner, clinical nurse specialist, certified registered nurse anesthetist, certified nurse midwife, psychologist, certified social worker, registered …
“quality measure” applies throughout its subpart
the term “quality measure” means a standard for measuring the performance and improvement of population health or of health plans, providers of services, and other clinicians in the delivery of health care services.
“patient decision aid” applies in that section
The term “patient decision aid” means an educational tool that helps patients, caregivers or authorized representatives understand and communicate their beliefs and preferences related to their treatment options, and to decide with their health care provider what treatments are best for them based on their treatment options, scientific evidence, circumstances, beliefs, and preferences. (2) Preference sensitive care
“preference sensitive care” applies in that section
The term “preference sensitive care” means medical care for which the clinical evidence does not clearly support one treatment option such that the appropriate course of treatment depends on the values of the patient or the preferences of the patient, caregivers or authorized representatives regarding the benefits, harms and scientific evidence for each treatment option, the 4 use of such care should depend on the informed patient choice among clinically appropriate treatment options.
“Advisory Council” applies throughout its subchapter
The term “Advisory Council” means the National Advisory Council on Healthcare Research and Quality established under section 299c of this title . (2) Agency

“State” applies in that section
the term “State” includes the Commonwealth of Puerto Rico, the Northern Mariana Islands, Guam, American Samoa, the Virgin Islands, the District of Columbia, and the Trust Territory of the Pacific Islands. (d) Authorization of appropriations For the purpose of making grants under this section, there are authorized to be appropriated $10,000,000 for the fiscal year ending June 30, 1971 ; $15,000,000 for the fiscal year ending June 30, 1972 ; and $20,000,000 for the fiscal year ending June 30, 1973 .
“factors unrelated to the administration of the vaccine” applies in that section
the term “factors unrelated to the administration of the vaccine”— (A) does not include any idiopathic, unexplained, unknown, hypothetical, or undocumentable cause, factor, injury, illness, or condition, and (B) may, as documented by the petitioner’s evidence or other material in the record, include infection, toxins, trauma (including birth trauma and related anoxia), or metabolic disturbances which have no known relation to the vaccine involved, but which in the particular case are shown to have been the agent or agents principally responsible for causing the petitioner’s illness, disability, injury, condition, or death.
“record” applies in that section
the term “record” means the record established by the special masters of the United States Court of Federal Claims in a proceeding on a petition filed under section 300aa–11 of this title .
“convulsion” applies in that section
the terms “seizure” and “convulsion” include grand mal, petit mal, absence, myoclonic, tonic-clonic, and focal motor seizures and signs. If a provision of the table to which paragraph (1), (2), (3), or (4) applies is revised under subsection (c) or (d), such paragraph shall not apply to such provision after the effective date of the revision unless the revision specifies that such paragraph is to continue to apply. (c) Administrative revision of table (1) The Secretary may promulgate regulations to modify in accordance with paragraph (3) the Vaccine Injury Table.
“encephalopathy” applies in that section
The term “encephalopathy” means any significant acquired abnormality of, or injury to, or impairment of function of the brain. Among the frequent manifestations of encephalopathy are focal and diffuse neurologic signs, increased intracranial pressure, or changes lasting at least 6 hours in level of consciousness, with or without convulsions. The neurological signs and symptoms of encephalopathy may be temporary with complete recovery, or may result in various degrees of permanent impairment.
“seizure” applies in that section

“Advisory Commission on Childhood Vaccines” applies throughout its part
The term “Advisory Commission on Childhood Vaccines” means the Commission established under section 300aa–19 of this title .;
“health care provider” applies throughout its part
The term “health care provider” means any licensed health care professional, organization, or institution, whether public or private (including Federal, State, and local departments, agencies, and instrumentalities) under whose authority a vaccine set forth in the Vaccine Injury Table is administered.;
“legal representative” applies throughout its part
The term “legal representative” means a parent or an individual who qualifies as a legal guardian under State law.;
“manufacture” applies throughout its part
The term “manufacture” means to manufacture, import, process, or distribute a vaccine.;
“manufacturer” applies throughout its part
The term “manufacturer” means any corporation, organization, or institution, whether public or private (including Federal, State, and local departments, agencies, and instrumentalities), which manufactures, imports, processes, or distributes under its label any vaccine set forth in the Vaccine Injury Table, except that, for purposes of section 300aa–28 of this title , such term shall include the manufacturer of any other vaccine covered by that section.
“significant aggravation” applies throughout its part
The term “significant aggravation” means any change for the worse in a preexisting condition which results in markedly greater disability, pain, or illness accompanied by substantial deterioration of health.;
“Vaccine Injury Table” applies throughout its part
The term “Vaccine Injury Table” means the table set out in section 300aa–14 of this title .
“vaccine-related injury or death” applies throughout its part
The term “vaccine-related injury or death” means an illness, injury, condition, or death associated with one or more of the vaccines set forth in the Vaccine Injury Table, except that the term does not include an illness, injury, condition, or death associated with an adulterant or contaminant intentionally added to such a vaccine. (6);
“continuation coverage” applies in that section
the term “continuation coverage” means coverage under the plan which meets the following requirements: (1) Type of benefit coverage The coverage must consist of coverage which, as of the time the coverage is being provided, is identical to the coverage provided under the plan to similarly situated beneficiaries under the plan with respect to whom a qualifying event has not occurred. If coverage is modified under the plan for any group of similarly situated beneficiaries, such coverage shall also be modified in the same manner for all individuals who are qualified beneficiaries under the plan pursuant to this part 1 in connection with such group.
“qualifying event” applies throughout its subchapter
the term “qualifying event” means, with respect to any covered employee, any of the following events which, but for the continuation coverage required under this subchapter, would result in the loss of coverage of a qualified beneficiary: (1) The death of the covered employee. (2) The termination (other than by reason of such employee’s gross misconduct), or reduction of hours, of the covered employee’s employment. (3) The divorce or legal separation of the covered employee from the employee’s spouse. (4) The covered employee becoming entitled to benefits under title XVIII of the Social Security Act [ 42 U.S.C. 1395 et seq.].
“applicable premium” applies throughout its subchapter
The term “applicable premium” means, with respect to any period of continuation coverage of qualified beneficiaries, the cost to the plan for such period of the coverage for similarly situated beneficiaries with respect to whom a qualifying event has not occurred (without regard to whether such cost is paid by the employer or employee).
“election period” applies throughout its subchapter
The term “election period” means the period which— (A) begins not later than the date on which coverage terminates under the plan by reason of a qualifying event, (B) is of at least 60 days’ duration, and (C) ends not earlier than 60 days after the later of— (i) the date described in subparagraph (A), or (ii) in the case of any qualified beneficiary who receives notice under section 300bb–6(4) of this title , the date of such notice.
“nonelecting TAA-eligible individual” applies in that section
The term “nonelecting TAA-eligible individual” means a TAA-eligible individual who— (i) has a TAA-related loss of coverage; and (ii) did not elect continuation coverage under this part 2 during the TAA-related election period. (B) TAA-eligible individual
“TAA-eligible individual” applies in that section
The term “TAA-eligible individual” means— (i) an eligible TAA recipient (as defined in paragraph (2) of section 35(c) of title 26 ), and (ii) an eligible alternative TAA recipient (as defined in paragraph (3) of such section). (C) TAA-related election period
“TAA-related election period” applies in that section
The term “TAA-related election period” means, with respect to a TAA-related loss of coverage, the 60-day election period under this part 2 which is a direct consequence of such loss. (D) TAA-related loss of coverage
“TAA-related loss of coverage” applies in that section
The term “TAA-related loss of coverage” means, with respect to an individual whose separation from employment gives rise to being an TAA-eligible individual, the loss of health benefits coverage associated with such separation.
“covered employee” applies throughout its subchapter
The term “covered employee” means an individual who is (or was) provided coverage under a group health plan by virtue of the performance of services by the individual for 1 or more persons maintaining the plan (including as an employee defined in section 401(c)(1) of title 26 ). (3) Qualified beneficiary (A) In general
“group health plan” applies throughout its subchapter
The term “group health plan” has the meaning given such term in 5000(b) 1 of title 26. Such term shall not include any plan substantially all of the coverage under which is for qualified long-term care services (as defined in section 7702B(c) of title 26 ). Such term shall not include any qualified small employer health reimbursement arrangement (as defined in section 9831(d)(2) of title 26 ). (2) Covered employee
“plan administrator” applies throughout its subchapter
The term “plan administrator” has the meaning given the term “administrator” by section 1002(16)(A) of title 29 .
“qualified beneficiary” applies throughout its subchapter
The term “qualified beneficiary” means, with respect to a covered employee under a group health plan, any other individual who, on the day before the qualifying event for that employee, is a beneficiary under the plan— (i) as the spouse of the covered employee, or (ii) as the dependent child of the employee. Such term shall also include a child who is born to or placed for adoption with the covered employee during the period of continuation coverage under this subchapter. (B) Special rule for terminations and reduced employment In the case of a qualifying event described in section 300bb–3(2) of this title ,
“additional newborn condition” applies in that section
the term “additional newborn condition” means any condition that is not one of the core conditions recommended by the Advisory Committee and adopted by the Secretary. (b) Funding In carrying out the research program under this section, the Secretary and the Director shall ensure that entities receiving funding through the program will provide assurances, as practicable, that such entities will work in consultation with the appropriate State departments of health, and, as practicable, focus their research on screening technology not currently performed in the States in which the entities are located, and the conditions on the uniform screening panel (or the standard test existing on the …
“Administrator” applies in that section
The term “Administrator” means the Administrator of the Health Resources and Services Administration. (B) Eligible entity
“eligible entity” applies in that section
the term “eligible entity” includes the 50 States, the District of Columbia, the Commonwealth of Puerto Rico, the United States Virgin Islands, the Commonwealth of the Northern Mariana Islands, American Samoa, Guam, the Federated States of Micronesia, the Republic of Marshall 1 Islands, the Republic of Palau, Indian tribes, a State or local health department, an institution of higher education, or a nonprofit entity with appropriate experience to conduct the activities under this subsection.
“Federally-qualified health center” applies in that section
The term “Federally-qualified health center” has the meaning given that term in section 1905( l )(2)(B) of the Social Security Act ( 42 U.S.C. 1396d ( l )(2)(B)). (6) Authorization of appropriations There is authorized to be appropriated to carry out this subsection, $8,205,000 for each of fiscal years 2026 through 2030.
“eligible entity” applies in that section
the term “eligible entity” means— (1) a State or a political subdivision of a State; (2) a consortium of 2 or more States or political subdivisions of States; (3) a territory; (4) a health facility or program operated by or pursuant to a contract with or grant from the Indian Health Service; or (5) any other entity with appropriate expertise in newborn screening, as determined by the Secretary.
“new drug” applies in that section
the term “new drug” has the meaning given such term in section 321 of title 21 .
“priority request” applies in that section
the term “priority request” means any request that— (1) is designated as a priority request by the Administrator of the Substance Abuse and Mental Health Services Administration, the Director of the Centers for Disease Control and Prevention, the Commissioner of Food and Drugs, or the Director of the National Institutes of Health; and (2) (A) is made to the Director of the Office of Personnel Management for the allocation of personnel to carry out activities with respect to acquired immune deficiency syndrome; or (B) is made to the Administrator of General Services for administrative support or space in carrying out such activities.
“Fund” applies in that section
The term “Fund” means the fund established in subsection (a).;
“identified set of AIDS activities” applies in that section
The term “identified set of AIDS activities” means a particular set of AIDS activities identified under subsection (a)(2)(A). (f) Funding (1) Authorization of appropriations For the purpose of providing amounts for the Fund, there is authorized to be appropriated $100,000,000 for each of the fiscal years 1994 through 1996. (2) Availability Amounts appropriated for the Fund are available until expended.
“AIDS activities” applies throughout its part
The term “AIDS activities” means AIDS research and other activities that relate to acquired immune deficiency syndrome.;
“AIDS research” applies throughout its part
The term “AIDS research” means research with respect to acquired immune deficiency syndrome.;
“Office” applies throughout its part
The term “Office” means the Office of AIDS Research.;
“Plan” applies throughout its part
The term “Plan” means the plan required in section 300cc–40c(a)(1) of this title .
“sudden infant death syndrome” applies in that section
The term “sudden infant death syndrome” means a sudden unexpected infant death that remains unexplained after a thorough case investigation. (2) Sudden unexpected infant death
“sudden unexpected death in childhood” applies in that section
The term “sudden unexpected death in childhood” means the sudden death of a child who is at least 1 year of age but not more than 17 years of age that, when first discovered, did not have an obvious cause. Such term includes such deaths that are explained, as well as deaths that remain unexplained (which are known as sudden unexplained death in childhood). (4) Sudden unexplained death in childhood
“sudden unexpected infant death” applies in that section
The term “sudden unexpected infant death” means the sudden death of an infant under 1 year of age that when first discovered did not have an obvious cause. Such term includes such deaths that are explained, as well as deaths that remain unexplained (which are known as sudden infant death syndrome). (3) Sudden unexpected death in childhood
“sudden unexplained death in childhood” applies in that section
The term “sudden unexplained death in childhood” means a sudden unexpected death in childhood that remains unexplained after a thorough case investigation. (f) Authorization of appropriations For the purpose of carrying out this section, there is authorized to be appropriated $12,000,000 for each of fiscal years 2022 through 2026.
“blood components” applies in that section
the term “blood components” means those constituents of whole blood which are used for therapy and which are obtained by physical separation processes which result in licensed products such as red blood cells, platelets, white blood cells, AHF-rich plasma, fresh-frozen plasma, cryoprecipitate, and single unit plasma for infusion; and;
“blood fractions” applies in that section
the term “blood fractions” means those constituents of plasma which are used for therapy and which are obtained by licensed fractionation processes presently used in manufacturing which result in licensed products such as normal serum albumin, plasma, protein fraction, prothrombin complex, fibrinogen, AHF concentrate, immune serum globulin, and hyperimmune globulins.
“subacute care” applies in that section
The term “subacute care” means medical and health care services that are required for individuals recovering from acute care episodes that are less intensive than the level of care provided in acute-care hospitals, and includes skilled nursing care, hospice care, and other types of health services provided in other long-term-care facilities.
“designated trauma center” applies throughout its part
The term “designated trauma center” means a trauma center designated in accordance with the modifications to the State plan described in section 300d–13 of this title . (2) State plan regarding emergency medical services The term “State plan”, with respect to the provision of emergency medical services, means a plan for a comprehensive, organized system to provide for the access, response, triage, field stabilization, transport, hospital stabilization, definitive care, and rehabilitation of patients of all ages with respect to emergency medical services. (3) State
“State” applies throughout its part
The term “State” means each of the several States, the District of Columbia, the Commonwealth of Puerto Rico, the Virgin Islands, Guam, American Samoa, and the Commonwealth of the Northern Mariana Islands. (4) Trauma
“trauma” applies throughout its part
The term “trauma” means an injury resulting from exposure to— (A) a mechanical force; or (B) another extrinsic agent, including an extrinsic agent that is thermal, electrical, chemical, or radioactive. (5) Trauma care component of State plan The term “trauma care component”, with respect to components of the State plan for the provision of emergency medical services, means a plan for a comprehensive health care system, within rural and urban areas of the State, for the prompt recognition, prehospital care, emergency medical care, acute surgical and medical care, rehabilitation, and outcome evaluation of seriously injured patients.
“uncompensated care costs” applies throughout its part
the term “uncompensated care costs” means unreimbursed costs from serving self-pay, charity, or Medicaid patients, without regard to payment under section 1396r–4 of this title , all of which are attributable to emergency care and trauma care, including costs related to subsequent inpatient admissions to the hospital.
“American Indian consortium” applies in that section
The terms “American Indian consortium” and “State” have the meanings given to those terms in section 300d–53 of this title .;
“State” applies in that section

The Secretary may revise the definition of such term as the Secretary determines necessary, after consultation with States and other appropriate public or nonprofit private entities. (i) Authorization of appropriations For the purpose of carrying out this section, there are authorized to be appropriated $7,321,000 for each of fiscal years 2020 through 2024.
“American Indian consortium” applies in that section
The term “American Indian consortium” means a consortium established under subtitle C of title I of the Developmental Disabilities Assistance and Bill of Rights Act of 2000 ( 42 U.S.C. 15041 et seq.). (2) Protection and advocacy system
“eligible national association” applies in that section
the term “eligible national association” means a national association with demonstrated experience in providing training and technical assistance to protection and advocacy systems. (k) System authority In providing services under this section, a protection and advocacy system shall have the same authorities, including access to records, as such system would have for purposes of providing services under subtitle C of title I of the Developmental Disabilities Assistance and Bill of Rights Act of 2000 ( 42 U.S.C. 15041 et seq.). (l) Authorization of appropriations There are authorized to be appropriated to carry out this section $4,000,000 for each of fiscal years 2020 through 2024.
“protection and advocacy system” applies in that section
The term “protection and advocacy system” means a protection and advocacy system established under subtitle C of title I of the Developmental Disabilities Assistance and Bill of Rights Act of 2000 ( 42 U.S.C. 15041 et seq.). (3) State The term “State”, unless otherwise specified, means the several States of the United States, the District of Columbia, the Commonwealth of Puerto Rico, the United States Virgin Islands, Guam, American Samoa, and the Commonwealth of the Northern Mariana Islands.
“human trafficking” applies in that section
the term “human trafficking” has the meaning given the term “severe forms of trafficking in persons” as defined in section 7102 of title 22 . (h) Authorization of appropriations There is authorized to be appropriated to carry out this section, $4,000,000 for each of fiscal years 2020 through 2024.
“eligible entity” applies in that section
The term “eligible entity” means— (A) a State or consortia of States; (B) an Indian Tribe or Tribal organization (as defined in section 5304 of title 25 ); (C) a consortium of level I, II, or III trauma centers designated by applicable State or local agencies within an applicable State or region, and, as applicable, other emergency services providers; or (D) a consortium or partnership of nonprofit Indian Health Service, Indian Tribal, and urban Indian trauma centers. (2) Region
“emergency services” applies in that section
The term “emergency services” includes acute, prehospital, and trauma care. (c) Pilot projects The Secretary shall award a contract or grant under subsection (a) to an eligible entity to design, implement, and evaluate a new or existing emergency medical and trauma system. Such eligible entity shall use amounts awarded under this subsection to carry out 2 or more of the following activities: (1) Strengthening coordination and communication with public health and safety services, emergency medical services, medical facilities, trauma centers, and other entities in a region to develop approaches to improve situational awareness and emergency medical and trauma system access.
“region” applies in that section
The term “region” means an area within a State, an area that lies within multiple States, or a similar area (such as a multicounty area), as determined by the Secretary. (3) Emergency services
“designated trauma center” applies in that section
The term “designated trauma center” has the meaning given such term in section 300d–31(1) of this title .;
“Director” applies in that section
The term “Director” means the Director of the National Institutes of Health.;
“trauma” applies in that section

“eligible high-acuity trauma center” applies throughout its part
The term “eligible high-acuity trauma center” means a Level I trauma center that satisfies each of the following: (A) Such trauma center has an agreement with the Secretary of Defense to enable military trauma teams to provide trauma care and related acute care at such trauma center. (B) At least 20 percent of patients treated at such trauma center in the most recent 3-month period for which data are available are treated for a major trauma at such trauma center. (C) Such trauma center utilizes a risk-adjusted benchmarking system and metrics to measure performance, quality, and patient outcomes.
“eligible trauma center” applies throughout its part
The term “eligible trauma center” means a Level I, II, or III trauma center that satisfies each of the following: (A) Such trauma center has an agreement with the Secretary of Defense to enable military trauma care providers to provide trauma care and related acute care at such trauma center. (B) Such trauma center utilizes a risk-adjusted benchmarking system and metrics to measure performance, quality, and patient outcomes. (C) Such trauma center demonstrates a need for integrated military trauma care providers to maintain or improve the trauma clinical capability of such trauma center. (3) Major trauma
“major trauma” applies throughout its part
The term “major trauma” means an injury that is greater than or equal to 15 on the injury severity score. (4) Military trauma team
“military trauma care provider” applies throughout its part
The term “military trauma care provider” means a member of the Armed Forces who furnishes emergency, critical care, and other trauma acute care services (including a physician, surgeon, physician assistant, nurse, nurse practitioner, respiratory therapist, flight paramedic, combat medic, or enlisted medical technician) or other military trauma care provider as the Secretary determines appropriate. (g) Authorization of appropriations To carry out this section, there is authorized to be appropriated $11,500,000 for each of fiscal years 2019 through 2023.
“military trauma team” applies throughout its part
The term “military trauma team” means a complete military trauma team consisting of military trauma care providers. (5) Military trauma care provider
“health maintenance organization” applies throughout its subchapter
the term “health maintenance organization” means a public or private entity which is organized under the laws of any State and which (1) provides basic and supplemental health services to its members in the manner prescribed by subsection (b), and (2) is organized and operated in the manner prescribed by subsection (c).
“health professional” applies in that section
the term “health professional” means physicians, dentists, nurses, podiatrists, optometrists, and such other individuals engaged in the delivery of health services as the Secretary may by regulation designate.
“financial and compliance audit” applies in that section
the term “financial and compliance audit” means an audit to determine whether the financial statements of an audited entity present fairly the financial position, and the results of financial operations, of the entity in accordance with generally accepted accounting principles, and whether the entity has complied with laws and regulations that may have a material effect upon the financial statements. (c) Availability to public The Secretary may not make payments under section 300ee–11(a) of this title for a fiscal year unless the State involved agrees to make copies of the reports and audits described in this section available for public inspection.
“significant percentage” applies in that section
the term “significant percentage” means at least a percentage of 1 percent of the number of reported cases of acquired immune deficiency syndrome in the United States.
“infection with the etiologic agent for acquired immune deficiency syndrome” applies throughout its part
the term “infection with the etiologic agent for acquired immune deficiency syndrome” includes any condition arising from such etiologic agent.
“basic health services” applies throughout its subchapter
The term “basic health services” means— (A) physician services (including consultant and referral services by a physician); (B) inpatient and outpatient hospital services; (C) medically necessary emergency health services; (D) short-term (not to exceed twenty visits), outpatient evaluative and crisis intervention mental health services; (E) medical treatment and referral services (including referral services to appropriate ancillary services) for the abuse of or addiction to alcohol and drugs; (F) diagnostic laboratory and diagnostic and therapeutic radiologic services; (G) home health services; and (H) preventive health services (including (i) immunizations, (ii) well-child care from …
“community rating system” applies in that section
The term “community rating system” means the systems, described in subparagraphs (B) and (C), of fixing rates of payments for health services. A health maintenance organization may fix its rates of payments under the system described in subparagraph (B) or (C) or under both such systems, but a health maintenance organization may use only one such system for fixing its rates of payments for any one group.
“health systems agency” applies in that section
The term “health systems agency” means an entity which is designated in accordance with section 300 l –4 of this title.;
“home health services” applies in that section
the term “home health services” means health services provided at a member’s home by health care personnel, as prescribed or directed by the responsible physician or other authority designated by the health maintenance organization.;
“individual practice association” applies in that section
The term “individual practice association” means a partnership, corporation, association, or other legal entity which has entered into a services arrangement (or arrangements) with persons who are licensed to practice medicine, osteopathy, dentistry, podiatry, optometry, psychology, or other health profession in a State and a majority of whom are licensed to practice medicine or osteopathy.
“medical group” applies in that section
The term “medical group” means a partnership, association, or other group— (A) which is composed of health professionals licensed to practice medicine or osteopathy and of such other licensed health professionals (including dentists, optometrists, podiatrists, and psychologists) as are necessary for the provision of health services for which the group is responsible; (B) a majority of the members of which are licensed to practice medicine or osteopathy; and (C) the members of which (i) as their principal professional activity engage in the coordinated practice of their profession and as a group responsibility have substantial responsibility for the delivery of health services to members of …
“medically underserved population” applies in that section
The term “medically underserved population” means the population of an urban or rural area designated by the Secretary as an area with a shortage of personal health services or a population group designated by the Secretary as having a shortage of such services.
