“military installation” applies in that section
The terms “facility” and “military installation” have the meanings given, respectively, in section 2801 of this title .;
“repair project” applies in that section
The term “repair project” has the meaning given in section 2811 of this title .
“Department of Defense combating terrorism program” applies in that section
the term “Department of Defense combating terrorism program” means the programs, projects, and activities of the Department of Defense related to combating terrorism inside and outside the United States. (e) Termination .— The requirement to submit a budget justification display under this section shall terminate on December 31, 2020 .
“auxiliary vessel” applies in that section
The term “auxiliary vessel” means any ship designed to operate in the open ocean in a variety of sea states to provide general support to either combatant forces or shore based establishments.;
“combatant and support vessel” applies in that section
The term “combatant and support vessel” means any commissioned ship built or armed for naval combat or any naval ship designed to provide support to combatant ships and other naval operations. Such term does not include patrol coastal ships, non-commissioned combatant craft specifically designed for combat roles, or ships that are designated for potential mobilization.;
“expected service life” applies in that section
The term “expected service life” means the number of years a naval vessel is expected to be in service.
“national defense strategy” applies in that section
The term “national defense strategy” means the review of the defense programs and policies of the United States that is carried out every four years under section 113(g) of this title .;
“budget” applies in that section
the term “budget” means the budget of the President for a fiscal year as submitted to Congress pursuant to section 1105 of title 31 .
“current year” applies in that section
The term “current year” means the fiscal year during which the President’s budget is submitted in any year.
“O&M justification documents” applies in that section
The term “O&M justification documents” means Department of Defense budget justification documents with respect to accounts for operation and maintenance submitted to the congressional defense committees in support of the Department of Defense component of the President’s budget for any fiscal year.;
“President’s budget” applies in that section
The term “President’s budget” means the budget of the President submitted to Congress under section 1105 of title 31 for any fiscal year.;
“major weapon system” applies in that section
the term “major weapon system” has the meaning given that term in section 101(a) of this title .
“Department of Defense POW/MIA accounting and recovery organization” applies in that section
the term “Department of Defense POW/MIA accounting and recovery organization” means any of the following (and any successor organization): (1) The Defense Prisoner of War/Missing Personnel Office (DPMO). (2) The Joint POW/MIA Accounting Command (JPAC). (3) The Armed Forces DNA Identification Laboratory (AFDIL). (4) The Life Sciences Equipment Laboratory (LSEL) of the Air Force. (5) Any other element of the Department of Defense the mission of which (as designated by the Secretary of Defense) involves the accounting for and recovery of members of the armed forces who are missing in action or prisoners of war or who are unaccounted for.
“budget” applies in that section
The terms “budget” and “defense budget materials” have the meaning given those terms in section 234 of this title .;
“category of personal protection equipment” applies in that section
The term “category of personal protection equipment” means the following: (A) Body armor components. (B) Combat helmets. (C) Combat protective eyewear. (D) Other items as determined appropriate by the Secretary.
“defense budget materials” applies in that section
The terms “budget” and “defense budget materials” have the meaning given those terms in section 234 of this title .;
“budget” applies in that section
The term “budget” has the meaning given that term in section 231(f) 1 of this title.;
“defense budget materials” applies in that section
The term “defense budget materials” has the meaning given that term in section 231(f) 1 of this title.
“covered modification” applies in that section
The term “covered modification” means a modification that will result in a reduction in the quantity of end items to be procured.;
“head of an agency” applies in that section
The term “head of an agency” means— (A) the Secretary of Defense; (B) the Secretary of the Army; (C) the Secretary of the Navy; or (D) the Secretary of the Air Force.
“ammunition production facility” applies in that section
The term “ammunition production facility” means an ammunition organic industrial base production facility.;
“budget” applies in that section
The terms “budget” and “defense budget materials” have the meaning given those terms in section 234 of this title .;
“covered depot” applies in that section
The term “covered depot” has the meaning given that term in section 2476 of this title .;
“covered facility” applies in that section
The term “covered facility” means a covered depot or an ammunition production facility.
“defense budget materials” applies in that section
The terms “budget” and “defense budget materials” have the meaning given those terms in section 234 of this title .;
“nuclear command, control, and communications programs” applies in that section
The term “nuclear command, control, and communications programs” means programs through which presidential authority and operational command and control of nuclear weapons is conducted, including programs that facilitate senior-level decisions on nuclear weapons employment.
“critical capabilities” applies in that section
the term “critical capabilities” means the financial statement audit priorities designated by the Secretary of Defense for the fiscal year in which the report is submitted. (c) Selection of Audit Remediation Services .— The selection of audit remediation service providers shall be based, among other appropriate criteria, on qualifications, relevant experience, and capacity to develop and implement corrective action plans to address internal control and compliance deficiencies identified during a financial statement or program audit.
“appropriate committees of Congress” applies in that section
the term “appropriate committees of Congress” means— (A) the Committee on Armed Services, the Committee on Homeland Security and Governmental Affairs, and the Committee on Appropriations of the Senate; and (B) the Committee on Armed Services, the Committee on Oversight and Government Reform, and the Committee on Appropriations of the House of Representatives.
“defense business system” applies in that section
the term “defense business system” has the meaning given such term in section 2222(i)(1)(A) of this title .
“State” applies throughout its chapter
the term “State” includes Guam and the Virgin Islands.
“Federal law enforcement agency” applies in that section
The term “Federal law enforcement agency” means a Federal agency with jurisdiction to enforce any of the following: (i) The Controlled Substances Act ( 21 U.S.C. 801 et seq.) or the Controlled Substances Import and Export Act ( 21 U.S.C. 951 et seq.). (ii) Any of sections 274 through 278 of the Immigration and Nationality Act ( 8 U.S.C. 1324–132 8). (iii) A law relating to the arrival or departure of merchandise (as defined in section 401 of the Tariff Act of 1930 ( 19 U.S.C. 1401 ) into or out of the customs territory of the United States (as defined in general note 2 of the Harmonized Tariff Schedule of the United States) or any other territory or possession of the United States.
“land area of the United States” applies in that section
The term “land area of the United States” includes the land area of any territory, commonwealth, or possession of the United States. (c) The Secretary of Defense may, in accordance with other applicable law, make Department of Defense personnel available to any Federal, State, or local civilian law enforcement agency to operate equipment for purposes other than described in subsection (b)(2) only to the extent that such support does not involve direct participation by such personnel in a civilian law enforcement operation unless such direct participation is otherwise authorized by law.
“drug-interdiction area” applies in that section
the term “drug-interdiction area” means an area outside the land area of the United States (as defined in section 374(b)(4)(B) 1 of this title) in which the Secretary of Defense (in consultation with the Attorney General) determines that activities involving smuggling of drugs into the United States are ongoing.
“State” applies in that section
The term “State” includes the District of Columbia, the Commonwealth of Puerto Rico, the Commonwealth of the Northern Mariana Islands, and any territory or possession of the United States.;
“unit of local government” applies in that section
The term “unit of local government” means any city, county, township, town, borough, parish, village, or other general purpose political subdivision of a State; an Indian tribe which performs law enforcement or emergency response functions as determined by the Secretary of the Interior; or any agency of the District of Columbia government or the United States Government performing law enforcement or emergency response functions in and for the District of Columbia or the Trust Territory of the Pacific Islands.;
“emergency situation involving a weapon of mass destruction” applies in that section
the term “emergency situation involving a weapon of mass destruction” means a circumstance involving a weapon of mass destruction— (1) that poses a serious threat to the interests of the United States; and (2) in which— (A) civilian expertise and capabilities are not readily available to provide the required assistance to counter the threat immediately posed by the weapon involved; (B) special capabilities and expertise of the Department of Defense are necessary and critical to counter the threat posed by the weapon involved; and (C) enforcement of section 175, 229, or 2332a of title 18 would be seriously impaired if the Department of Defense assistance were not provided.
“explosive ordnance” applies in that section
The term “explosive ordnance”— (1) means— (A) bombs and warheads; (B) guided and ballistic missiles; (C) artillery, mortar, rocket, and small arms ammunition; (D) all mines, torpedoes, and depth charges; (E) grenades demolition charges; (F) pyrotechnics; (G) clusters and dispensers; (H) cartridge- and propellant- actuated devices; (I) electroexplosives devices; (J) clandestine and improvised explosive devices; and (K) all similar or related items or components explosive in nature; and (2) includes all munitions containing explosives, propellants, nuclear fission or fusion materials, and biological and chemical agents.
“appropriate committees of Congress” applies in that section
The term “appropriate committees of Congress” means— (A) the Committee on Armed Services, the Committee on Appropriations, and the Committee on Foreign Affairs of the House of Representatives; and (B) the Committee on Armed Services, the Committee on Appropriations, and the Committee on Foreign Relations of the Senate.;
“Indian tribe” applies in that section
The term “Indian tribe” means a Federally recognized Indian tribe.;
“small scale construction” applies in that section
The term “small scale construction” means construction at a cost not to exceed $1,000,000 for any project.;
“transnational organized crime” applies in that section
The term “transnational organized crime” means self-perpetuating associations of individuals who operate transnationally for the purpose of obtaining power, influence, monetary, or commercial gains, wholly or in part by illegal means, while protecting their activities through a pattern of corruption or violence or through a transnational organization structure and the exploitation of transnational commerce or communication mechanisms.
“tribal government” applies in that section
The term “tribal government” means the governing body of an Indian tribe, the status of whose land is “Indian country” as defined in section 1151 of title 18 or held in trust by the United States for the benefit of the Indian tribe.;
“tribal law enforcement agency” applies in that section
The term “tribal law enforcement agency” means the law enforcement agency of a tribal government.;
“appropriate committees of Congress” applies throughout its chapter
The terms “appropriate congressional committees” and “appropriate committees of Congress” mean— (A) the Committee on Armed Services, the Committee on Foreign Relations, and the Committee on Appropriations of the Senate; and (B) the Committee on Armed Services, the Committee on Foreign Affairs, and the Committee on Appropriations of the House of Representatives.;
“appropriate congressional committees” applies throughout its chapter
The terms “appropriate congressional committees” and “appropriate committees of Congress” mean— (A) the Committee on Armed Services, the Committee on Foreign Relations, and the Committee on Appropriations of the Senate; and (B) the Committee on Armed Services, the Committee on Foreign Affairs, and the Committee on Appropriations of the House of Representatives.;
“defense article” applies throughout its chapter
The term “defense article” has the meaning given that term in section 644 of the Foreign Assistance Act of 1961 ( 22 U.S.C. 2403 ).;
“defense service” applies throughout its chapter
The term “defense service” has the meaning given that term in section 644 of the Foreign Assistance Act of 1961 ( 22 U.S.C. 2403 ).;
“developing country” applies throughout its chapter
The term “developing country” has the meaning prescribed by the Secretary of Defense for purposes of this chapter in accordance with section 1241(n) of the National Defense Authorization Act for Fiscal Year 2017.
“security cooperation programs and activities of the Department of Defense” applies throughout its chapter
The term “security cooperation programs and activities of the Department of Defense” means any program, activity (including an exercise), or interaction of the Department of Defense with the security establishment of a foreign country to achieve a purpose as follows: (A) To build and develop allied and friendly security capabilities for self-defense and multinational operations. (B) To provide the armed forces with access to the foreign country during peacetime or a contingency operation. (C) To build relationships that promote specific United States security interests.;
“small-scale construction” applies throughout its chapter
The term “small-scale construction” means construction at a cost not to exceed $2,000,000 for any project.;
“training” applies throughout its chapter
The term “training” has the meaning given the term “military education and training” in section 644 of the Foreign Assistance Act of 1961 ( 22 U.S.C. 2403 ).
“administrative services and support” applies in that section
the term “administrative services and support” includes base or installation support services, office space, utilities, copying services, fire and police protection, training programs conducted to familiarize, orient, or certify liaison personnel regarding unique aspects of the assignments of the liaison personnel, and computer support.
“special operations forces” applies in that section
The term “special operations forces” includes civil affairs forces and military information support operations forces. (2) The term “incremental expenses”, with respect to a developing country, means the reasonable and proper cost of rations, fuel, training ammunition, transportation, and other goods and services consumed by such country, except that the term does not include pay, allowances, and other normal costs of such country’s personnel. (e) Reports .— Not later than April 1 of each year, the Secretary of Defense shall submit to Congress a report regarding training during the preceding fiscal year for which expenses were paid under this section.
“logistic support, supplies, and services” applies in that section
the term “logistic support, supplies, and services” has the meaning given that term in section 2350(1) of this title .
“administrative services and support” applies in that section
The term “administrative services and support” means base or installation support services, facilities use, base operations support, office space, office supplies, utilities, copying services, computer support, communication services, fire and police protection, postal services, bank services, transportation services, housing and temporary billeting (including ancillary services), specialized clothing required to perform assigned duties, temporary loan of special equipment, storage services, training services, and repair and maintenance services.;
“covered foreign defense personnel” applies in that section
The term “covered foreign defense personnel” means members of the military of a foreign country who are assigned to— (A) the United Nations Command; or (B) the Neutral Nations Supervisory Commission.;
“developing country” applies in that section
The term “developing country” has the meaning given the term in section 301(4) of this title .;
“Neutral Nations Supervisory Commission” applies in that section
The term “Neutral Nations Supervisory Commission” means the delegations from Sweden and Switzerland (or successor delegations) appointed in accordance with the Korean War Armistice Agreement of 1953 or its subsequent agreements.;
“United Nations Command” applies in that section
The term “United Nations Command” means the headquarters of the United Nations Command, the United Nations Command Military Armistice Commission, the United Nations Command-Rear, and the United Nations Command Honor Guard.
“multinational center of excellence” applies in that section
the term “multinational center of excellence” means— (1) an entity sponsored by one or more nations that is accredited and approved by the Military Committee of the North Atlantic Treaty Organization (NATO) as offering recognized expertise and experience to personnel participating in the activities of such entity for the benefit of NATO by providing such personnel opportunities to— (A) enhance education and training; (B) improve interoperability and capabilities; (C) assist in the development of doctrine; (D) validate concepts through experimentation; (2) the European Centre of Excellence for Countering Hybrid Threats, established in 2017 and located in Helsinki, Finland; and (3) the …
“Service Academy” applies in that section
the term “Service Academy” means the following: (1) The United States Military Academy. (2) The United States Naval Academy. (3) The United States Air Force Academy.
“logistic support, supplies, and services” applies in that section
the term “logistic support, supplies, and services” has the meaning given that term in section 2350 of this title .
“international terrorism” applies in that section
the term “international terrorism” has the meaning given that term in section 140(d) of the Foreign Relations Authorization Act, Fiscal Years 1988 and 1989 ( 22 U.S.C. 2656f(d) ).
“security cooperation workforce” applies in that section
the term “security cooperation workforce” means the following: (1) Members of the armed forces and civilian employees of the Department of Defense working in the security cooperation organizations of United States missions overseas. (2) Members of the armed forces and civilian employees of the Department of Defense in the geographic combatant commands and functional combatant commands responsible for planning, monitoring, or conducting security cooperation activities.
“cyber incident” applies in that section
The term “cyber incident” means actions taken through the use of computer networks that result in an actual or potentially adverse effect on an information system or the information residing therein. (2) Operationally critical contractor .—
“operationally critical contractor” applies in that section
The term “operationally critical contractor” means a contractor designated by the Secretary for purposes of this section as a critical source of supply for airlift, sealift, intermodal transportation services, or logistical support that is essential to the mobilization, deployment, or sustainment of the Armed Forces in a contingency operation.
“willful misconduct” applies in that section
the term “willful misconduct” means an act or omission that is taken— (i) intentionally to achieve a wrongful purpose; (ii) knowingly without legal or factual justification; and (iii) in disregard of a known or obvious risk that is so great as to make it highly probable that the harm will outweigh the benefit. (e) Definitions .— In this section: (1) Cyber incident .—
“covered armed force” applies in that section
The term “covered armed force” means the Army, Navy, Air Force, Marine Corps, or Space Force.;
“covered provision of law” applies in that section
The term “covered provision of law” means the following: (A) Section 1647 of the National Defense Authorization Act for Fiscal Year 2016 ( Public Law 114–92 ; 129 Stat. 1118 ). (B) Section 1650 of the National Defense Authorization Act for Fiscal Year 2017 ( Public Law 114–328 ; 10 U.S.C. 2224 note). (C) Section 1505 of the National Defense Authorization Act for Fiscal Year 2022 ( Public Law 117–81 ; 10 U.S.C. 394 note). (D) Section 1559 of the National Defense Authorization Act for Fiscal Year 2023.
“covered statutory requirement” applies in that section
The term “covered statutory requirement” means a requirement under any covered provision of law.;
“designated cyber and information technology range” applies in that section
The term “designated cyber and information technology range” includes the National Cyber Range, the Joint Information Operations Range, the Defense Information Assurance Range, and the C4 Assessments Division of J6 of the Joint Staff.;
“Directive 5101.1” applies in that section
The term “Directive 5101.1” means Department of Defense Directive 5101.1, or any successor directive relating to the responsibilities of an executive agent of the Department of Defense.;
“executive agent” applies in that section
The term “executive agent” has the meaning given the term “DoD Executive Agent” in Directive 5101.1.
“cleared defense contractor” applies in that section
The term “cleared defense contractor” means a private entity granted clearance by the Department of Defense to access, receive, or store classified information for the purpose of bidding for a contract or conducting activities in support of any program of the Department of Defense. (2) Covered network .—
“covered network” applies in that section
The term “covered network” means a network or information system of a cleared defense contractor that contains or processes information created by or for the Department of Defense with respect to which such contractor is required to apply enhanced protection.
“willful misconduct” applies in that section
the term “willful misconduct” means an act or omission that is taken— (i) intentionally to achieve a wrongful purpose; (ii) knowingly without legal or factual justification; and (iii) in disregard of a known or obvious risk that is so great as to make it highly probable that the harm will outweigh the benefit. (e) Definitions .— In this section: (1) Cleared defense contractor .—
“clandestine military activity or operation in cyberspace” applies in that section
The term “clandestine military activity or operation in cyberspace” means a military activity or military operation carried out in cyberspace, or associated preparatory actions, authorized by the President or the Secretary that— (A) is marked by, held in, or conducted with secrecy, where the intent is that the activity or operation will not be apparent or acknowledged publicly; and (B) is to be carried out— (i) as part of a military operation plan approved by the President or the Secretary in anticipation of hostilities or as directed by the President or the Secretary; (ii) to deter, safeguard, or defend against attacks or malicious cyber activities against the United States or Department …
“foreign power” applies in that section
The term “foreign power” has the meaning given such term in section 101 of the Foreign Intelligence Surveillance Act of 1978 ( 50 U.S.C. 1801 ).;
“United States person” applies in that section
The term “United States person” has the meaning given such term in such section.
“sensitive military cyber operation” applies in that section
the term “sensitive military cyber operation” means an action described in paragraph (2) that— (A) is carried out by the armed forces of the United States; (B) is intended to achieve a cyber effect against a foreign terrorist organization or a country, including its armed forces and the proxy forces of that country located elsewhere— (i) with which the armed forces of the United States are not involved in hostilities (as that term is used in section 4 of the War Powers Resolution ( 50 U.S.C.
“appropriate committees of Congress” applies in that section
The term “appropriate committees of Congress” means— (A) the congressional defense committees; (B) the Committee on Foreign Relations of the Senate; and (C) Committee on Foreign Affairs of the House of Representatives.;
“cyber capability” applies in that section
The term “cyber capability” means a device or computer program, including any combination of software, firmware, or hardware, designed to create an effect in or through cyberspace. (h) Rule of Construction .— Nothing in this section shall be construed as amending, diminishing, or otherwise impacting reporting or other obligations under the War Powers Resolution.
“humanitarian and civic assistance” applies in that section
the term “humanitarian and civic assistance” means any of the following: (1) Medical, surgical, dental, and veterinary care provided in areas of a country that are rural or are underserved by medical, surgical, dental, and veterinary professionals, respectively, including education, training, and technical assistance related to the care provided. (2) Construction of rudimentary surface transportation systems. (3) Well drilling and construction of basic sanitation facilities. (4) Rudimentary construction and repair of public facilities.
“complex operation” applies in that section
The term “complex operation” means an operation as follows: (A) A stability operation. (B) A security operation. (C) A transition and reconstruction operation. (D) A counterinsurgency operation. (E) An operation consisting of irregular warfare.;
“gift or donation” applies in that section
The term “gift or donation” means any gift or donation of funds, materials (including research materials), real or personal property, or services (including lecture services and faculty services).
“congressional intelligence committees” applies in that section
The term “congressional intelligence committees” has the meaning given that term in section 3 of the National Security Act of 1947 ( 50 U.S.C. 3003 ).;
“Defense Intelligence Enterprise” applies in that section
The term “Defense Intelligence Enterprise” means the organizations, infrastructure, and measures, including policies, processes, procedures, and products, of the intelligence, counterintelligence, and security components of each of the following: (i) The Department of Defense. (ii) The Joint Staff. (iii) The combatant commands. (iv) The military departments. (v) Other elements of the Department of Defense that perform national intelligence, defense intelligence, intelligence-related, counterintelligence, or security functions.;
“fulfillment rate” applies in that section
The term “fulfillment rate” means the percentage of combatant command intelligence and counterintelligence requirements satisfied by available, acquired, or realigned intelligence and counterintelligence capabilities or activities.;
“intelligence community” applies in that section
The term “intelligence community” has the meaning given that term in section 3 of the National Security Act of 1947 ( 50 U.S.C. 3003 ).
“captured record” applies in that section
The term “captured record” means a document, audio file, video file, or other material captured during combat operations from countries, organizations, or individuals, now or once hostile to the United States.;
“gift or donation” applies in that section
The term “gift or donation” means any gift or donation of funds, materials (including research materials), real or personal property, or services (including lecture services and faculty services).
“Defense intelligence element” applies in that section
the term “Defense intelligence element” means any of the Department of Defense agencies, offices, and elements included within the definition of “intelligence community” under section 3(4) of the National Security Act of 1947 ( 50 U.S.C. 3003(4) ).
“congressional intelligence committees” applies in that section
the term “congressional intelligence committees” means— (1) the Select Committee on Intelligence of the Senate; and (2) the Permanent Select Committee on Intelligence of the House of Representatives.
“Directive 5101.1” applies in that section
The term “Directive 5101.1” means Department of Defense Directive 5101.1, or any successor directive relating to the responsibilities of an executive agent of the Department of Defense.;
“executive agent” applies in that section
The term “executive agent” has the meaning given the term “DoD Executive Agent” in Directive 5101.1.;
“open-source intelligence tools” applies in that section
The term “open-source intelligence tools” means tools for the systematic collection, processing, and analysis of publicly available information for known or anticipated intelligence requirements.
“clandestine activity” applies in that section
the term “clandestine activity” means any activity where it is intended that the role of the United States Government will not be apparent or acknowledged publicly.
“commercial activities” applies throughout its subchapter
The term “commercial activities” means activities that are conducted in a manner consistent with prevailing commercial practices and includes— (A) the acquisition, use, sale, storage and disposal of goods and services; (B) entering into employment contracts and leases and other agreements for real and personal property; (C) depositing funds into and withdrawing funds from domestic and foreign commercial business or financial institutions; (D) acquiring licenses, registrations, permits, and insurance; and (E) establishing corporations, partnerships, and other legal entities.;
“intelligence collection activities” applies throughout its subchapter
The term “intelligence collection activities” means the collection of foreign intelligence and counterintelligence information.
“United States person” applies in that section
the term “United States person” means an individual who is a citizen of the United States or an alien lawfully admitted to the United States for permanent residence.
“congressional intelligence committees” applies in that section
the term “congressional intelligence committees” has the meaning given the term in section 3 of the National Security Act of 1947 ( 50 U.S.C. 3003 ).
“NGA foreign data acquisition fee” applies in that section
the term “NGA foreign data acquisition fee” means any licensing or other fee imposed by a foreign country or international organization for the acquisition or use of data or products by the National Geospatial-Intelligence Agency.
“geomatics product” applies in that section
the term “geomatics product” means imagery, imagery intelligence, or geospatial information. (c) (1) Regulations to implement this section (including any amendments to such regulations) shall be published in the Federal Register for public comment for a period of not less than 30 days before they take effect.
“operational files” applies in that section
the term “operational files” has the meaning given that term in section 701(b) of the National Security Act of 1947 ( 50 U.S.C. 3141(b) ).
“function” applies throughout its chapter
The term “function” means any duty, obligation, responsibility, privilege, activity, or program. (2);
“geospatial information” applies throughout its chapter
The term “geospatial information” means information that identifies the geographic location and characteristics of natural or constructed features and boundaries on or about the earth and includes— (A) data and information derived from, among other things, remote sensing, mapping, and surveying technologies; and (B) mapping, charting, geomatics data, and related products and services.;
“geospatial intelligence” applies throughout its chapter
The term “geospatial intelligence” means the exploitation and analysis of imagery and geospatial information to describe, assess, and visually depict physical features and geographically referenced activities on or about the earth. Geospatial intelligence consists of imagery, imagery intelligence, and geospatial information.
“imagery” applies throughout its chapter
The term “imagery” means, except as provided in subparagraph (B), a likeness or presentation of any natural or manmade feature or related object or activity and the positional data acquired at the same time the likeness or representation was acquired, including— (i) products produced by space-based national intelligence reconnaissance systems; and (ii) likenesses or presentations produced by satellites, airborne platforms, unmanned aerial vehicles, or other similar means. (B) Such term does not include handheld or clandestine photography taken by or on behalf of human intelligence collection organizations.;
“imagery intelligence” applies throughout its chapter
The term “imagery intelligence” means the technical, geographic, and intelligence information derived through the interpretation or analysis of imagery and collateral materials.;
“report” applies in that section
the term “report” includes any certification, notification, or other communication in writing.
“covered military unit” applies in that section
The term “covered military unit” means a unit of the armed forces whose initial assignment to a military installation or relocation from a military installation to a different military installation requires the preparation of an environmental impact statement in accordance with the National Environmental Policy Act of 1969 ( 42 U.S.C. 4321 et seq.).;
“major headquarters” applies in that section
The term “major headquarters” means the headquarters of a military unit or command that is the appropriate command of a general officer or flag officer.;
“major weapon system” applies in that section
The term “major weapon system” means a weapon system that is treatable as a major system under section 3041(a) and (b) of this title.;
“military installation” applies in that section
The term “military installation” means a base, camp, post, station, yard, center, homeport facility for any ship, or other activity under the jurisdiction of the Department of Defense, including any leased facility. Such term does not include any facility used primarily for civil works, rivers and harbors projects, or flood control projects.;
“Secretary concerned” applies in that section
The term “Secretary concerned” means— (A) the Secretary of the military department concerned; and (B) the Secretary of Defense with respect to matters concerning the Defense Agencies and the Joint Staff.
“covered official” applies in that section
the term “covered official” means— (1) the Commander of the United States Strategic Command; (2) the Director of the Strategic Systems Program of the Navy; (3) the Commander of the Global Strike Command of the Air Force; and (4) the Commander of the United States Air Forces in Europe.
“appropriate congressional committees” applies in that section
The term “appropriate congressional committees” means— (I) the congressional defense committees; and (II) the Committee on Foreign Relations of the Senate and the Committee on Foreign Affairs of the House of Representatives.;
“New START Treaty” applies in that section
The term “New START Treaty” means the Treaty between the United States of America and the Russian Federation on Measures for the Further Reduction and Limitation of Strategic Offensive Arms, signed on April 8, 2010 , and entered into force on February 5, 2011 . (b) Annual Report on the Nuclear Weapons Stockpile of the United States.— (1) Sense of congress .— It is the sense of Congress that— (A) sustained investments in the nuclear weapons stockpile and the nuclear security complex are needed to ensure a safe, secure, reliable, and credible nuclear deterrent; and (B) such investments could enable additional future reductions in the hedge stockpile.
“New START Treaty” applies in that section
The term “New START Treaty” means the Treaty between the United States of America and the Russian Federation on Measures for the Further Reduction and Limitation of Strategic Offensive Arms, signed on April 8, 2010 , and entered into force on February 5, 2011 .;
“strategic delivery system” applies in that section
The term “strategic delivery system” means a delivery system for nuclear weapons.
“appropriate congressional committees” applies in that section
the term “appropriate congressional committees” means the following: (1) The congressional defense committees. (2) The Committee on Foreign Affairs of the House of Representatives and the Committee on Foreign Relations of the Senate.
“appropriate congressional committees” applies in that section
the term “appropriate congressional committees” means— (1) the Committees on Armed Services of the House of Representatives and the Senate; and (2) the Committee on Foreign Affairs of the House of Representatives and the Committee on Foreign Relations of the Senate.
“dual-capable aircraft” applies in that section
the term “dual-capable aircraft” means aircraft that can perform both conventional and nuclear missions.
“New START Treaty” applies in that section
the term “New START Treaty” means the Treaty between the United States of America and the Russian Federation on Measures for the Further Reduction and Limitation of Strategic Offensive Arms, signed on April 8, 2010 , and entered into force on February 5, 2011 .
“anomaly” applies in that section
The term “anomaly” means a malicious, suspicious or abnormal cyber incident that potentially threatens the national security or interests of the United States, or that is likely to result in demonstrable harm to the national security of the United States.;
“intrusion” applies in that section
The term “intrusion” means an unauthorized and malicious cyber incident that compromises a nuclear command, control, and communications system by breaking the security of such a system or causing it to enter into an insecure state. (e) Termination .— The requirements of this section shall terminate on December 31, 2032 .
“nuclear security enterprise” applies in that section
the term “nuclear security enterprise” has the meaning given that term in section 6101.
“nuclear forces” applies in that section
the term “nuclear forces” includes, at a minimum— (1) nuclear weapons; (2) the delivery platforms and systems for nuclear weapons; (3) nuclear command, control, and communications systems; and (4) the infrastructure and facilities of the Department of Defense and the National Nuclear Security Administration that support nuclear weapons, the delivery platforms and systems for nuclear weapons, and nuclear command, control, and communications systems, including with respect to personnel, construction, operation, and maintenance.
“electromagnetic superiority implementation plan” applies in that section
the term “electromagnetic superiority implementation plan” means the Electromagnetic Superiority Implementation Plan signed by the Secretary of Defense on July 15, 2021 , and any successor plan.
“electromagnetic order of battle” applies in that section
The term “electromagnetic order of battle” has the meaning given such term in Joint Publication 3–85 entitled “Joint Electromagnetic Spectrum Operations”, dated May 2020.;
“high interest training issue” applies in that section
The terms “high interest training issue”, “high interest training requirement”, “Tier 1”, and “Tier 2” have the meanings given such terms in the Joint Training Manual for the Armed Forces of the United States (Document No. CJCSM 3500.03E), dated April 20, 2015 .;
“high interest training requirement” applies in that section

The term “local educational agency” means— (i) a local educational agency, within the meaning of that term in section 8101 of the Elementary and Secondary Education Act of 1965; and (ii) a private secondary school.;

The term “member of the House of Representatives” includes a Delegate or Resident Commissioner to Congress.
“PII” applies in that section
the term “PII” means personally identifiable information. (b) Compilation of Directory Information .— (1) The Secretary of Defense may collect and compile directory information pertaining to each student who is 17 years of age or older or in the eleventh grade (or its equivalent) or higher and who is enrolled in a secondary school in the United States or its territories, possessions, or the Commonwealth of Puerto Rico. (2) The Secretary may make directory information collected and compiled under this subsection available to the armed forces for military recruiting purposes. Such information may not be disclosed for any other purpose.
“recruiting access” applies in that section
The term “recruiting access” means access requested as described in paragraph (1).;
“senior executive” applies in that section
The term “senior executive” has the meaning given that term in section 3132(a)(3) of title 5 .;
“specified congressional committees” applies in that section
The term “specified congressional committees” means the following: (i) The Committee on Armed Services and the Committee on Health, Education, Labor, and Pensions of the Senate. (ii) The Committee on Armed Services and the Committee on Education and the Workforce of the House of Representatives.;
“State” applies in that section
The term “State” includes the District of Columbia, the Commonwealth of Puerto Rico, the Commonwealth of the Northern Mariana Islands, Guam, the Virgin Islands, American Samoa, the Federated States of Micronesia, the Republic of the Marshall Islands, and the Republic of Palau.;
“Americorps” applies in that section
The term “Americorps” means the Americorps program carried out under subtitle C of title I of the National and Community Service Act of 1990 ( 42 U.S.C. 12571 et seq.).;
“National Call to Service participant” applies in that section
the term “National Call to Service participant” means a person who has not previously served in the armed forces who enters into an original enlistment pursuant to a written agreement with the Secretary of a military department (in such form and manner as may be prescribed by that Secretary) under which the person agrees to perform a period of national service as specified in subsection (c). (c) National Service .— The total period of national service to which a National Call to Service participant is obligated under the agreement under this section shall be specified in the agreement.
“qualifying student loan” applies in that section
The term “qualifying student loan” means a loan, the proceeds of which were used to pay any part or all of the cost of attendance (as defined in section 472 of the Higher Education Act of 1965 ( 20 U.S.C. 1087 ll ) at an institution of higher education (as defined in section 101 of the Higher Education Act of 1965 ( 20 U.S.C. 1001 ).;
“Secretary of a military department” applies in that section
The term “Secretary of a military department” includes, with respect to matters concerning the Coast Guard when it is not operating as a service in the Navy, the Secretary of the Department in which the Coast Guard is operating.
“baseline” applies in that section
the term “baseline” means the lower of— (A) the statutory limit on general officer and flag officer positions that are joint duty assignments under subsection (b)(1); or (B) the actual number of general officers and flag officers who, as of January 1, 2023 , were in joint duty assignments counted toward the statutory limit under subsection (b)(1).
“creditable active service” applies in that section
the term “creditable active service” means active service that could be credited to a warrant officer under section 511 of the Career Compensation Act of 1949, as amended ( 70 Stat. 114 ). (b) The Secretary concerned may defer, for not more than four months, the retirement or separation under this section of a warrant officer if, because of unavoidable circumstances, evaluation of his physical condition and determination of his entitlement to retirement or separation for physical disability require hospitalization or medical observation that cannot be completed before the date on which he would otherwise be required to retire or be separated under this section.
“promotion zone” applies throughout its chapter
The term “promotion zone” means a promotion eligibility category consisting of officers on a warrant officer active-duty list in the same grade (or the same grade and competitive category) who— (A) in the case of grades below chief warrant officer, W–5, have neither (i) failed of selection for promotion to the next higher grade, nor (ii) been removed from a list of warrant officers recommended for promotion to that grade (other than after having been placed on that list after a selection from below the promotion zone); and (B) are senior to the warrant officer designated by the Secretary concerned to be the junior warrant officer in the promotion zone eligible for promotion to the next …
“warrant officers above the promotion zone” applies throughout its chapter
The term “warrant officers above the promotion zone” means a group of officers on a warrant officer active-duty list in the same grade (or the same grade and competitive category) who— (A) are eligible for consideration for promotion to the next higher grade; (B) are in the same grade as warrant officers in the promotion zone; and (C) are senior to the senior warrant officer in the promotion zone.;
